QUESTIONS AND ANSWERS

Q1. Page C-6 Incident Commander Type 5

Is power saws (S-212) required training for the ICT5 position, or should this fall under additional training?

A. We appreciate your comment. The S-212 requirement will be moved to (2) ADDITIONAL

TRAINING WHICH SUPPORTS DEVELOPMENT OF KNOWLEDGE AND SKILLS for ICT5.

Q2. Page C-4 Experience

To meet the 60% experience requirement what is the definition of “season of experience”?

Suggested definition:

“Season,” for the purposes of firefighting experience, means a period of time of indeterminate length during the same calendar year or longer, within which a firefighter has documented satisfactory performance on Type 5, Type 4, Type 3, Type 2, Type 1 and RX fire assignments that included at least fifteen (15) Operational Periods.

A. A total of 15 operational periods with 10 of those periods on a type 3, 2, 1 within a calendar year constitutes a season of experience.

Q3. Page H-1 Section H.3 Key personnel

Required crew composition: 1 CRWB 3 Squad Bosses

4 ICT5

Is the position of ICT5 separate from the management position?

Example: If one of the squad bosses on a crew was not ICT5 qualified but a CRWB trainee was ICT5 qualified would this crew makeup meet the contract requirements?

1 CRWB/ICT5

1 CRWB T/ICT5

2 FFT1/ICT5

1 FFT1

This example will provide clarification in utilizing trainees on a crew while remaining contract compliant.

A. Table C.2 Minimum Requirement for type 2-1A leadership Qualifications shows 1 CRWB and 3 FFT1 all qualified as Incident Commanders, Type 5 (ICT5). This totals the 4 ICT5 in Section H.3 Key personnel. Example above would not meet the intent of the contract and does not meet the minimum requirements for type 2-1A leadership requirements.

Q4. Page C-10 Trainees

For FFT1 trainee and CRWB trainee positions, only three training positions will be permitted per crew on each incident assignment.

Is a Crew Boss trainee considered to be filling a Squad Boss role while in training or only an FFT2 role? Is it allowed to have multiple CRWB trainees per crew?

A. Please refer to C-10 (f) Additional Requirements (4) FFT1 Trainee and CRWB Trainee only three training positions are permitted per crew on each incident. A Trainee position will be considered filled when that position has been clearly identified on the Crew Manifest.

Contractors may configure the three training trainee positions that best meets their training needs.

Q5. Hotline

Please provide an unambiguous definition of “hotline”. The definition of hotline has become a point of contention on the fireline between crews and overhead management with the lack of an unequivocal definition and personal interpretation.

Suggested definition: “Hotline” means fire suppression activities applied directly to burning fuel to stop active fire spread by either Direct or Indirect Attack methods. Activities include backfiring, burn out, holding actions, and other actions to physically separate the burning from unburned fuel. These activities may be on wildfires, prescribed fire or other fire use incidents.

A. Under this contract Hotline construction is considered line building and holding of burning fuels (active flame) and to stop the spread of the fire during wildland fire suppression activities.

Q6. Page C-8 for the position of Advanced Firefigher/Squad Boss (FFT1)

Satisfactory position performance as an advanced firefighter/squad boss (FFT1) supervising a minimum of four (4) firefighters, on wildfire or prescribed fire incidents documented in PTB.

The requirement that a FFT1 (T) supervises a minimum of 4 firefighters on wildfire or prescribed fire incidents in an unreasonable expectations. The number of crewmembers a trainee supervises is subject to their skill level, fire conditions, squad assignment or prescribed fire objectives. If an FFT1 (T) is supervising one or more individuals they are in a management role and it should be document in the PTB as a qualifying assignment validating position performance.

A. Thank you for your comment. This requirement will remain in the NCC Contract as is.

Q7. Page C-24 Section C.17 Campsite

A designated campsite may be provided by the Government upon arrival of the NCC at the incident. The Contractor shall provide sleeping equipment to suit the conditions such as tents, shelter, ground cloths and sleeping bags. If available, food, drink and shower facilities are provided at the incident at no charge, (see sections G.2(h)(i) and H.10)

The verbiage “shall” provide has been used in other contract language that was later interpreted by the department of labor to indicate the contractor would provide equipment to the employee at no cost the employee. By keeping the “shall” verbiage in the contact the contractor will have to mitigate their risk by calculating the potential cost of providing sleeping equipment to an employee. Our historical contract experience has shown us this has the potential to be a large unknown expense over the duration of a five year contract.

If the contractor is required to provide sleeping equipment to suit the conditions, are they considered to be providing housing and subject to the appropriate authorization to furnish housing? If the employee chooses to provide their own sleeping equipment as it is of a personal nature can the contractor grant this request? As the government has indicated it “may” provide a campsite it is suggested similar verbiage be stated, the contractor “may” provide the appropriate sleeping equipment.

A. The Contractor shall provide sleeping equipment to suit the conditions such as tents, shelters, ground cloths, and sleeping bags (See Section C.17). The Contractor may allow employees to provide their own sleeping equipment, however it is the Contractor’s responsibility to ensure each employee has he proper sleeping equipment to suit the conditions of each incident assigned.

Q8. Is there a map with circles drawn for the radius for each HUCC so that contractor can be sure that the DDL they want to use is with-in the radius. Some DDL may be very close in or out.

Some may be inside more then one. Wouldn’t want to think you were in and be ruled out.

Would it be possible for you to create a map like that so contractor can be sure?

A. There is no map. The Designated Dispatch Point (DDP) for each crew will be the contractually approved physical location for the crew during the Mandatory Availability Period (MAP). A physical address (no PO Boxes) must be provided by the Contractor within 30 calendar days after contract award for each CLIN awarded. The address provided must be within the maximum air mileage radius identified in the Schedule of Items for each Host Unit Coordination Center.

Q9. C.11 says that personal and equipment must located at the physical address. (Like a fire station)

Then under (d) it says 1 hour to confirm and 2 hours to depart. So the personnel have time to assemble them depart. It’s not like living at the fire station. Please clarify exactly what is expected. How have the contractors, currently awarded, been housing there crews.

A. The Contractor is expected to confirm availability within 1 hour upon receiving a dispatch call. The Contractor will have a maximum of 2 hours after confirming availability to begin travel to the Government’s designated delivery location on the Resource Order. Once the Contractor agrees to a delivery schedule at the time the order is placed, the Contractor is required to perform in accordance with the agreed upon schedule.

Q10. I think NWCG says that anyone CRWB qualified is ICT4 qualified. Is this true?

A. A crew person may be qualified as ICT4 and may not meet qualification as a CRWB.

However, once certified as a CRWB an ICT4 assignment will maintain currency of a CRWB Certification.

Q11. We have locations where we are much stronger and costs are lower because all infra- structure is in place. How can we differentiate between a very strong location at a lower price and a weaker location with a higher price if we cannot discuss price in the technical part of the proposal.

A. Technical proposals will be evaluated based only on the technical evaluation factors listed in

Section L: 1) Past Performance, 2) Organizational Experience, 3) Equipment, Vehicles and Facilities, 4) Quality Control Plan, 5) Safety and Training. Once evaluation of the technical proposals is complete the Technical Evaluation Team will take price into consideration to make a Best Value determination. The non-price factors are approximately equal to price.

Q12. Key Personnel: Let’s say we want to list 6 overhead per crew. Two crew bosses and 4 FFT1/ICT5. If we do that are all 6 required to be on the crew for 90 days or can we use only 4 of the 6. What happens if you bid for 5 CLIN and show 4 overhead per crew then are awarded only 1 or 2 locations.

A. For EACH crew proposed, identify at least one (1) qualified Crew Boss and at least three (3) qualified Squad Bosses who will be assigned leadership positions within each proposed crew as a Crew Boss or Squad Boss. You will be required to provide the 4 individuals proposed for each crew that is awarded. Contractors may use the table at H.4 to identify all Key Personnel proposed. Ensure you list a sufficient number of Key Personnel for the number of crews you wish to offer. If you offer 5 crews and are only awarded 3 crews you may provide any of the Key Personnel for the three crews amongst the Key Personnel you proposed for all 5 crews.

Q13. When is the first period when services may be requested under this contract for the R8 DDP?

Am I correct that it would be for the Spring 2011 MAP in MAR/APR?

A. The Mandatory Availability Period for the Region 8 DDPs is March 15 through April 30 and October 15 through November 30. See Section F.3.

Q14. If all options periods are utilized under the solicitation as written, would this preclude any additional competition for national T2IA crews until after the contract period ends in 2015? For example, will any other opportunities exist between now and 2015 for this particular service?

A. No, at this time the Government does not anticipate adding more crews at this location, however if the Government’s needs change additional crews could be added or deleted.

Q15. If the National Health Care bill is passed as currently proposed this could have a major impact on our costs for the option years. Will the government allow us to change our price for the optional periods if we are impacted?

A. No, these are Firm-Fixed price contracts. There are no provisions that would allow the awarded Contractors to make such a change to their price. If the National Health Care bill is passed and significantly impacts the contracts we will consider not exercising the Option Periods and issuing a new solicitation to allow all contractors an opportunity to submit new prices based on the current market conditions.

Q16. Can we use personnel for project work that do not necessarily meet the training and experience requirements required for the firefighting crew positions of this contract?

A. No, all personnel performing any work under the contract must meet the minimum training and experience requirements required for the firefighting crew positions of this contract.

Q17 Does the government ensure all contractors are complying with the E-verify clause.

A. In accordance with the E-Verify MOU United States Department of Homeland Security posts the E-Verify Federal Contracts list - a list of Contractors who currently use E-Verify on the Federal Acquisition Clause. We intend to check the list to ensure all contractors are complying with this requirement. In addition, we will verify employment eligibility of workers by selecting a random sample and requesting that the Contractor submit all I-9 (Employment Eligibility Verification Form) for a particular crew for review. After review, these will be submitted to the U.S. Customs and Immigration Enforcement Agency for further verification.

Any discrepancies will be investigated and taken into consideration for contract suspension and/or termination.

Q18. If a contractor has multiple crews and would like to secure 5 awards and the contractor can spread its costs over the 5 crews (G&A, etc.) and therefore achieve economies of scale. As a result, contractor would like to pass this benefit on to the government in the form of a discount.

Can the contractor propose two pricing structures as follows?

1) If awarded the 5 CLINS, the price is 10% less than if awarded less than the 5 CLINS.

2) If awarded less than the 5 CLINS, the price is 10% more than if awarded the 5 CLINS.

A. No, the Contractor may only propose one pricing scheme per CLIN. However, a Contractor may propose different prices for each CLIN item they wish to bid on.

Q19. Are CRWB & ICT5's the same thing?

A. No, both have different training and experience requirements. Please refer to both position’s qualification requirements in the contract. Single Resource Boss Crew (clause C.5 (a) page C-5). Incident Commander Type 5 (clause C.5 (b) page C-6).

(b) CREW VEHICLES

(1) The Government reserves the right to conduct safety inspections of Contractor vehicles at any time while under hire. If Contractor’s vehicles have recently passed safety inspection by US Department of Transportation (DOT) or another Cooperator Agency such as the Oregon Department of Forestry (ODF), the Contractor may provide the inspection documentation and the Government may choose to accept the results of the recently passed inspection.

(2) Initial inspection upon arrival at an incident could result in a determination that a Contactor’s vehicle is unsafe for operation. If this occurs, the vehicle will be removed from service and will be considered noncompliant. The NCC may be demobilized from the incident and/or suspended if contract requirements are not met. At the discretion of the Government Representative at the incident, the Contractor may be allowed to bring the vehicle into compliance or replace it within 24 hours, or within the timeframe identified by the Government Inspector.
