SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 Scope of Contract

Scope of Work:

Furnish and install a 16’ wide gate, 2 locking posts, signs and associated hardware on the Herbert River road according to the attached drawing. Furnish and install large riprap, in the 3-4’ size range, on each side of the gate to eliminate motorized vehicle passage around the gate.

C.2 Description and Location

The project is located in Juneau on the Herbert River road. The Herbert River road is located approximately 26 miles from Juneau. The gate shall be installed approximately 63’ beyond the edge of the pavement on the Herbert River road as shown on the following photos.

SECTION D -- PACKAGING AND MARKING

D.1 Project Labeling for Official Correspondence The Government singularly identifies each project with a contract number at time of Award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.

SECTION F--DELIVERIES OR PERFORMANCE

F.1 FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) The Contractor shall be required to—

(a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed,

(b) prosecute the work diligently, and

(c) complete the entire work ready for use no later than 60 days after the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

SECTION G – CONTRACT ADMINISTRATION DATA

G.1 Submission of Invoices

(a) This clause supplements the contract clause at FAR 52.213-4 (a) (2) (ii) Terms and Conditions – Simplified Acquisitions.

(b) The designated billing office is Tongass National Forest, Attn: Contracts, 648 Mission St, Ketchikan AK 99901.

(c) Paper invoices are contemplated. If the Contractor chooses to submit a facsimile or e-mail invoice, the Government will not be responsible for any failure attributable to the transmission of receipt of the invoice including, but not limited to-

(1) Receipt of garbled or incomplete invoice.

(2) Availability or condition of the receiving facsimile equipment or e-mail system or account.

(3) Incompatibility between the sending and receiving equipment or systems.

(4) Delay in transmission or receipt of invoice.

(5) Failure of the Contractor to properly identify the invoice.

(6) Absence or unavailability of the person to whose attention or account the facsimile or e-mail is sent.

G.2 Progress Payments

(a) This clause supplements the contract clause at FAR 52.213-4 (a) (2) (ii) Terms and Conditions – Simplified Acquisitions.

(b) Progress payments [ ] will [ X] will not be made more frequently than monthly.

G.3 Payment by Electronic Funds Transfer

(a) Payment will be made by electronic funds transfer (EFT). The payment office uses the Central Contractor Registration (CCR) database as its source of EFT information.

SECTION H – SPECIAL CONTRACT REQUIREMENTS

AGAR 452.236-73 Archaeological Or Historic Sites (Feb. 1988) If a previously unidentified archaeological or historic site(s) is encountered, the contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

H.1 Order Of Precedence - Requirements, Specifications, Drawings

(a) This clause supplements the clause at FAR 52.214-29, Order of Precedence – Sealed Bidding or FAR 52.215-8, Order of Precedence – Uniform Contract Format, if included in this solicitation or contract.

(b) Resolve any inconsistencies in the Specifications of this solicitation and any resultant contract by giving precedence in the following order:

(1) Special Project Specifications

(2) Standard Specifications (FP03)

(3) Drawings

(i) Drawings, figured dimensions over scaled dimensions

(ii) Drawings, large scale contract drawings over small scale contract drawings

(iii) Schedules on contract drawings over any conflicting notations on contract drawings.

(iv) Shop Drawings - (The term "Shop Drawings", includes drawings, diagrams, layouts, schematics, descriptive literature, illustrations, schedules, performance and test data, and similar materials furnished by the Contractor to explain in detail specific portions of the work required by the contract.)

H.2 Landscape Preservation

(a) Confine operations to within the clearing limits or other areas designated in contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Unless otherwise agreed to by the CO, retrieve material which falls outside of these limits and either incorporate the material in the work or dispose of the material as directed by the CO.

(b) Schedule and conduct operations to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.). Install silt fencing around areas immediately next to streams and ponds to mitigate suspended sediments when designated on the drawings.

(c) Do not discharge pollutants such as raw sewage, and other harmful materials into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Do not allow wash water or waste water from concrete or aggregate operations to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(d) Collect and return waste motor oils, fuels, lubricants, bitumens and similar hydrocarbons to the supplier.

Comply with the requirements of 40 CFR 279, Standards for the Management of Used Oil. Do not discharge hydrocarbon products on the ground, use them for road oiling, or bury them in a landfill.

(e) Do not operate mechanized equipment in live streams without written approval of the Contracting Officer.

(f) CREEK CROSSINGS: Schedule and conduct bridge and instream work to minimize disturbance to streams.

(1) Do not cross streams without Contracting Officer approval.

(2) Submit a written equipment crossing plan to the Contracting Officer for approval 14 calendar days before creek crossing is planned. Two machine crossings will be permitted in the designated window for all streams designated on the drawings as fish streams. Outside of this time period, no machine crossings will be permitted if fish eggs are present in the gravel or adult fish are present in the stream; otherwise two machine crossings will be permitted.

(3) Limit machine crossings to two times for all live streams not designated on the drawings as fish streams with pipes 48” and larger to be installed.

(4) Do not leave temporary bridges in place between September 15 and March 15, unless approved in advance in writing by the Contracting Officer.

(g) Obtain necessary permits for floating camps, floats, shore ramps, and other appurtenances associated with project operations from the following State of Alaska and Federal Agencies:

(1) ADNR - Alaska Department of Natural Resources.

(2) ADEC - Alaska Department of Environmental Conservation.

(3) ADGC – Alaska Department of Governmental Coordination.

(4) EPA – US Environmental Protection Agency.

(5) DA, COE – US Army Corps of Engineers.

(6) USCG – US Coast Guard.

H.3 Contractor's Use And Maintenance Of Existing Roads

(a) The Contractor is authorized to use roads in the immediate construction project area for performance of work under this contract. Such roads are those which are necessary for direct access to designated borrow sites, quarries, stockpile sites, waste areas, campsites, equipment unloading ramps, and other approved work areas. The roads authorized for use will be subject to the following general conditions:

(b) Federal Regulations contained in 36 CFR 261.12; except vehicle weight will not exceed that of AASHTO HS20-44 and/or U80 Loading. Submit written requests to the CO for approval to use L90 and U102 overload Loadings on roads authorized for use. Regulations prohibit damaging a road or blocking a road open to use by others, except as otherwise provided in Special Project Specification 104.

(c) The Government will not snowplow roads for the Contractor's use. The Contractor may snowplow any road designated for his use. A permit defining snowplowing requirements is required and will be issued by the District Ranger, upon request by the Contractor. Repair any damage to the road structure caused by snow removal operations. Vehicles, other than conventional over-the-snow vehicles (snowmobiles), will not be permitted to use roads when there is an average of more than 4” of snow unless the road has been snowplowed.

(d) The Contractor is responsible for and will perform road maintenance on Forest Service roads in the construction area commensurate with his use. Perform road maintenance at such intervals that prevent deterioration of the roadway, or as directed by the Contracting Officer.

H.4 Emergency Fire Precautions

(a) Contractor shall restrict operations in accordance with the Emergency Fire Precautions Schedule.

(b) It shall be the Contractors responsibility to monitor and obtain the predicted Fire Precautions Class from the appropriate Forest Service Office. If predictions made after 1800 local time are significantly different than originally estimated, Forest service will inform the Contractor when a change in restrictions or fire precautions are indicated.

EMERGENCY FIRE PRECAUTIONS SCHEDULE

(c) Forest Service may change the fire danger values to other essentially equivalent values, when the Fire Danger Rating Systems is revised. In this event a new Emergency Fire Precaution Schedule will be prepared.

When sent to the Contractor it will supersede the schedule here.

(d) During periods of high fire danger, the Forest Service may suspend operation until danger is passed. An adjustment in contract time may be made for this period.

Fire Precaution Class Fire Precautions

M.A.C. I & M.A.C. II

Normal fire precautions only.

Spark arresters installed.

M.A.C. III

All prior fire precautions required.

No warming or lunch fire permitted.

Smoking materials permitted only in designated areas.

A #0 shovel is to be located where re-fueling of power saws takes place.

On the third consecutive day of M.A.C. III, the Forest Service may suspend felling, cutting operations from 1200 (12 p.m.) until 1800 (6 p.m.) (Hoot Owl).

Contract time during shutdown period will be 50% time, 50% count.

Other operations including use of power saws at loading or landing sites are permitted, during the shutdown times.

M.A.C. IV

All prior fire precautions required.

Shutdown all power saws, from 1200 (12 p.m.) until 2000(8 p.m.) local time (Hoot Owl).

Contract time during shutdown 50% time 50% count.

Use of power saws at this time may continue at landing/loading sites with Forest Service permission.

M.A.C. V Shutdown all operations.

No Contract time will be charged under this Fire precaution Class.

H.5 Contractor Responsibility to Notify Government The Contractor will notify the COR when leaving the project area for 3 or more days and within 24 hours before returning to the project area.

I.2 Agriculture Acquisition Regulation (AGAR) (48 CFR) Clauses AGAR Clause Title and Date 452.209-71 Assurance Regarding Felony Conviction Or Tax Delinquent Status For Corporate Applicants

(FEB 2012), Alternate 1 (FEB 2012)

(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.

Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report and include the following:

• Description of the item spilled (including identity, quantity, manifest number, and other identifying information).

• Whether amount spilled is EPA or state reportable, and if so whether it was reported, and to whom.

• Exact time and location of spill including a description of the area involved.

• Containment procedures.

• Summary of any communications the Contractor had with news media, Federal, state and local regulatory agencies and officials, or Forest Service officials.

• Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.

When available provide copies of all spill related clean up and closure documentation and correspondence from regulatory agencies.

The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.

Description

650.01 Work. Furnish and install, or install only, road closure devices using fabricated gates and accessories, combination post and rail barriers, concrete barriers, earth mound barriers, and other devices.

Materials

650.02 Requirements. Furnish materials to be used in fabricating gates and barriers. Ensure that all hardware is galvanized in accordance with AASHTO M 232 and meets the requirements of ASTM A 307. Furnish plain or cut washers that are American Standard Washers.

Furnish timber posts, rails, and lumber that meet the requirements of AASHTO M 168. Provide timber of the species and type, and rate of preservative treatment.

Furnish concrete that meets the requirements of Subsection 601.03, method B or C.

Construct earth mound barriers from excavated material adjacent to the barrier location, or from other designated locations.

Construction

650.03 Performance. Place road closure devices at designated locations. Construct all devices to the required dimensions. In assembling gates, perform required welding in accordance with the best modern practice and the applicable requirements of AWS D1.1.

After assembly, clean non-galvanized steel pipe gates and paint them with one coat of zinc-rich primer and two coats of exterior enamel of the required type and color.

Set all posts vertically and embed them to the required depth. Place concrete for embedment against undisturbed earth within an excavation sized to achieve the embedment dimensions.

Compact the backfill in 6 inch layers to finished grade.

Furnish and install all signs and/or reflective warning markers accessory to the road closure device.

650.04 Acceptance. Construction of road closure devices will be evaluated under Subsections

106.02 and 106.04

Measurement

650.05 Measure the items listed in the bid schedule according to Subsection 109.02.

Payment
