About this file
This file contains affidavit templates required by the Missouri Highways and Transportation Commission (MHTC) and the Missouri Department of Transportation (MoDOT) for contractors bidding on state transportation contracts, specifically for the Polymer Modified Emulsified Asphalt (CRS2P) chip seal project on Route W in Washington County, Missouri. Exhibit A is an Annual Worker Eligibility Verification Affidavit that must be completed by authorized representatives of each business entity, including joint venture partners. This affidavit requires contractors to affirm enrollment in a federal work authorization program operated by the United States Department of Homeland Security and to certify that the business entity will not knowingly employ unauthorized aliens in connection with MHTC services. Contractors must provide documentation of their federal work authorization program enrollment with the signed affidavit.
Exhibit B is an Affidavit of Lawful Presence for Sole-Proprietorship or Partnership that must be completed separately by each owner and general partner. This affidavit requires the affiant to declare their status as either a United States citizen or an alien lawfully admitted for permanent residence, as required under Missouri law Section 208.009. The affidavit includes warnings regarding criminal penalties for fraudulent statements, with Class C felony charges for stolen public benefits valued between $500 and $25,000 and Class B felony charges for benefits valued at $25,000 or more. Both affidavits must be notarized and submitted as conditions for contract eligibility, with MHTC/MoDOT required to provide assistance in obtaining documentation to prove citizenship or lawful presence in the United States.
