INSTRUCTIONS TO BIDDERS
IB-1 GENERAL
The Bid shall be for all the Work to be performed as shown and specified in the IFB Documents included hereto and generally described as supplying all labor, equipment, materials, and work force (personnel) necessary to complete the Work.
Bids shall be submitted on the Bid Submittal Forms provided by OC SAN, and in the manner as described in the Notice Inviting Bids.
A Bid may only be withdrawn prior to the date and time the Bids must be submitted.
A Bid submitted to OC SAN at the date and time the Bids are due shall be deemed irrevocable, and Bidder may not withdraw this Bid for a period of one hundred twenty
(120) calendar days after the deadline for submitting Bids. Extensions to this one hundred twenty-day period may be requested in writing by OC SAN prior to the expiration date and may be extended pursuant to agreement by Bidder.
A Pre-Bid Conference which may include a job walk will be held as noted in the Notice Inviting Bids.
IB-2 EXAMINATION OF IFB DOCUMENTS AND SITE OF WORK
All Bids shall be in strict accordance with the IFB Documents.
Copies of the IFB Documents, OC SAN responses to all written questions, and responses to requests for interpretation and clarification will be available for examination and/or download through the methods identified in the Notice Inviting Bids under Plans and Specifications. The Bidder shall be solely responsible for examining the IFB Documents, review of all addenda, and comprehension of all conditions that may impact the Bid and the performance of the Work should the Bidder be selected. Failure of the Bidder to so examine and inform itself shall be at its sole risk, and the CONTRACTOR shall bear all costs arising therefrom.
The Bidder acknowledges that a careful examination was made of the IFB Documents as well as the site where Work is to be performed. The Bidder further acknowledges that the Bidder is familiar with all local conditions and federal, state and local laws, ordinances, rules and regulations that may affect in any manner the performance of the Work. The Bidder represents that a study was made of all surveys and investigation reports about subsurface and latent physical conditions pertaining to the worksite, has performed such additional surveys and investigations as deemed necessary to complete the Work at the Bid price, and has correlated the results of all such data with the requirements of the Contract Agreement. The submittal of a Bid shall be conclusive evidence that the Bidder is aware of and fully understands all the conditions to be encountered, including locality, weather conditions, and all other contingencies pertaining to the character, quality, quantities, and scope of the Work.
The IFB Documents for the Work show subsurface conditions or otherwise hidden conditions as they are supposed or believed by the ENGINEER to exist; but it is not intended or to be inferred that the conditions as shown thereon constitute a representation that such conditions actually exist. Except as otherwise specifically provided therein; OC SAN, the ENGINEER, and their CONSULTANTS shall not be liable for any loss sustained by the CONTRACTOR as a result of any variance to such conditions as shown on the IFB Documents or the actual conditions revealed or otherwise discovered during the progress of the Work.
When OC SAN or the ENGINEER has made independent investigations of subsurface conditions in areas where the Work is to be performed, such investigations were made only for the purpose of study and design. The conditions indicated by such investigations apply only at the specific location of each boring or excavation at the time the borings or excavations were made. Where such investigations have been made, Bidders may inspect the records of such investigations, subject to and upon the conditions hereinafter set forth. Any inspection of the records shall be made at the office of the ENGINEER.
The records of such independent investigations performed by OC SAN or the ENGINEER are not a part of the IFB Documents and are disclosed solely for the convenience to the Bidder or CONTRACTOR. It is expressly understood and agreed that OC SAN and the ENGINEER assume no responsibility whatsoever with respect to the sufficiency or accuracy of the investigations; the records thereof; or of the interpretations set forth therein or made by OC SAN, or the ENGINEER in the use thereof by the ENGINEER, and there is no warranty or guarantee, either express or implied, that the conditions indicated by such investigations or records thereof are representative of those existing throughout such areas, or any part thereof, or that unforeseen developments may not occur, or that materials other than, or in proportions, densities, or other characteristics different from those indicated may not be encountered.
When a log of test borings showing a record of the data obtained by the investigation of subsurface conditions by OC SAN, or the ENGINEER is included with the IFB Documents, it is expressly understood and agreed that said log of test borings does not constitute a part of the Contract, represents only the opinion of OC SAN or the ENGINEER as to the character of the materials encountered by them in the test borings, it is included in the Plans or other documents only for the convenience to Bidders, and its use is subject to all of the conditions and limitations set forth in this section.
The availability or use of information described in this Section is not to be construed in any way as a waiver of the provisions of the first paragraph in this Section, and a Bidder shall make such independent investigations and examinations as necessary to be aware of and satisfied itself as to the conditions to be encountered in the performance of the Work.
No information derived from such inspection of records of investigations or compilation thereof made by OC SAN or the ENGINEER will in any way relieve the Bidder from any risk or from properly fulfilling the terms of the Contract, nor entitle the CONTRACTOR to any additional compensation. The Bidder shall make no Claim against OC SAN or its ENGINEER based upon ignorance or misunderstanding of the condition of the worksite or of the Contract provisions.
IB-3 INTERPRETATION OF IFB DOCUMENTS
If any person planning to submit a Bid is in doubt as to the meaning of any part of the IFB Documents, or finds errors or omissions, the Bidder shall request in writing, an interpretation or correction thereof. Such requests may be submitted in accordance with the instructions included in the Notice Inviting Bids. The requesting party shall be responsible for its prompt delivery. Interpretations and/or corrections of the IFB Documents may be made by a duly issued addendum. A copy of each such addendum will be available through the methods identified in the Notice Inviting Bids under Plans and Specifications. OC SAN will not be responsible for any other explanations or interpretations of the IFB Documents. It is the duty of the Bidder to promptly notify OC SAN in writing of any error or omission in the IFB Documents. Until receipt of any instruction or addendum from OC SAN, any work done by the Bidder after the Bidder becomes aware that an error or omission in the IFB Documents exists, or otherwise fails to immediately notify OC SAN of patent errors or omissions will be at its sole risk, and the CONTRACTOR shall bear all costs arising therefrom.
To ensure that responses are provided to all Planholders, inquiries shall be received at least ten (10) Business Days prior to the Bid due date, unless otherwise noted in the Notice Inviting Bids. Where such interpretation or clarification requires a change in the IFB Documents, OC SAN will issue an addendum.
OC SAN shall not be bound by, and the Planholder shall not rely on for any purpose, any oral interpretation or oral clarification of the IFB Documents.
IB-4 ADDENDA
OC SAN reserves the right to revise the IFB Documents prior to the date and time specified for the submittal of Bids. Such revisions, if any, will be made by addenda to the IFB Documents.
Addenda issued before the time in which to submit Bids expires shall be included in the Bid and shall be made a part of the Contract.
Bidders shall acknowledge receipt of all addenda to the IFB Documents in the Bid Submittal Forms. Failure to acknowledge receipt of all addenda may render the Bid Non- Responsive.
IB-5 CANCELLATION OF SOLICITATION

Failure to complete the Schedule of Prices may cause the Bid to be incomplete and rejected as Non-Responsive.
OC SAN is not obligated to pay for any costs incurred in the preparation and submission of Bids, including, but not limited to, printing costs.
IB-7 MODIFIED AND ALTERNATIVE BIDS
Bids must not deviate from what is requested in the IFB Documents.

IB-13 BID EVALUATION PROCESS
General
The Bid evaluation period shall close upon OC SAN’s completion of its review and evaluation of the Bids. OC SAN will give Bidders notice at the completion of Bid evaluation.
During the Bid evaluation period, OC SAN shall determine if Bids are Responsive and Bidders are Responsible. Bids submitted in strict accordance with the IFB Documents will be deemed Responsive. A Responsible Bidder has the apparent ability to meet and successfully complete the requirements of the Contract Documents. Responsibility determination includes, but is not limited to, consideration of a Bidder’s trustworthiness, the quality of past performance, financial ability, and the fitness and capacity to do the proposed Work in a satisfactory manner. Bidder may be required to present further evidence that it has successfully performed similar work of comparable magnitude or provide other proof satisfactory to OC SAN that it is competent to successfully perform the Work. In addition to contacting the references provided by the Bidder, OC SAN may, and retains its right to contact other project owners and such other entities for which Bidder has performed or is performing work. Determination of the Bidder’s responsibility will be judged based on all of the aforementioned criteria as established by information and documentation provided by the Bidder in response to instructions and specific questions in the IFB Documents, including but not limited to the Bid Submittal Forms. If the Bidder is a Joint Venture, Bidder shall be required to submit information pertaining to its joint venture partners, as specified in the Bid Submittal Forms.
Safety
All Safety evaluations will be performed utilizing data that is current at the date and time specified for the submittal of Bids.
For purpose of evaluating the Safety record of the Bidder, if the Bidder has any Serious, Willful, Repeat, Serious and Willful or Failure to Abate citations pursuant to Part 1 of Division 5 of the Labor Code and has not taken appropriate corrective action to abate further such violations; or if the Bidder has an accident frequency factor between 1.01 and 1.25 and has not taken appropriate corrective action to reduce its accident frequency experience; or if the Bidder has a workers’ compensation experience modification rate issued and published by the Workers’ Compensation Insurance Rating Bureau of California (WCIRB) greater than 1.25 when the accident frequency factor is between 1.01 and 1.25; or if the Bidder does not have injury prevention programs instituted to the extent required by Section
3201.5 or 6401.7 of the Labor Code, the Bidder may be deemed Not Responsible and its Bid rejected.
OC SAN may require the Bidder to submit evidence of such corrective actions as described above and as specified in the SAFETY DECLARATION OF CONTRACTOR located in the Bid Submittal Forms.
If the Bidder has an accident frequency factor above 1.25 or a workers’ compensation experience modification rate issued and published by the Workers’ Compensation Insurance Rating Bureau of California (WCIRB) above 1.25, the Bid shall be deemed Non-Responsive and the Bid rejected.
Failure by the two (2) apparent low Bidders to submit the completed and signed CAL/OSHA 300/300A Logs and Summaries within three (3) Business Days after the date specified for the submittal of Bids, or provide the reason(s) for exemption, as required, may result in their Bids being rejected as Non-Responsive.
Should the two (2) apparent low Bidders fail to meet OC SAN’s requirements, the next apparent low Bidder(s) shall be notified to submit the said documentation within the three (3) Business Day time frame for OC SAN review.
Accident Frequency Factor
OC SAN will evaluate the Bidder’s accident frequency factors for each calendar year submitted on the CAL/OSHA 300/300A Logs and Summaries and its three (3) year average using the Accident Frequency Factor tables shown below.
Prior to completing Part 5 BID SUBMITTAL FORMS, BF-6 SAFETY DECLARATION OF CONTRACTOR (Safety Declaration) located in the Bid Submittal Forms, the Bidder shall calculate its accident frequency factors for each calendar year listed and its three (3) year average using the Accident Frequency Factor tables below. The results of those calculations should be used to respond to the Accident Frequency question on the Declaration.
a. Accident Frequency Factor Worksheet
i. Using the OSHA 300A (Summary of Work-Related Injuries and Illnesses) Form, populate the below table to calculate the average number of hours worked for the most recent three complete calendar years.
Calendar Year # Hours Worked 20 _ _ (A) 20 _ _ (B) 20 _ _ (C)
Average Hours Worked (A+B+C) / 3 = D
(D)
a) If the average of the hours worked (D) is equal to or less than 200,000 hours, complete Calculation A in Subsection 2 below. Completion of Subsection 3 below will not be required if hours worked is equal to or less than 200,000 hours.
b) If the average of the hours worked (D) is greater than 200,000 hours, complete Calculation B in Subsection 3 below. Completion of Subsection 2 below will not be required if hours worked is greater than 200,000 hours.
ii. Calculation A – Average Number of Recordables When Average Worked Hours Less Than 200,000 Hours
Using the OSHA 300 and 300A Forms and the table below, determine the number of OSHA recordables for the past three years and calculate the three year recordable case average cases.
a) The number of nonfatal injuries and illnesses is determined for each year by:
1. Counting the number of OSHA recordable cases for the year listed on the OSHA Form 300 (log) or,
2. Using the 300A (summary), adding the number of recordable cases entered in Column H + Column I + Column J to obtain the total injuries and illnesses.
b) Using the formula provided below, calculate the 3-year average of OSHA recordable cases.
Calendar Year # OSHA Recordable Injuries/Illnesses
20 _ _ (E)
20 _ _ (F)
20 _ _ (G)
Average Recordable Cases (E+F+G) / 3 = H
(H)
c) The Bidder’s industry NAICS code is looked up in the California Department of Industrial Relations (DIR) Nonfatal Occupational Injuries and Illnesses in California, Summary Tables at https://www.dir.ca.gov/OPRL/nonfatal.htm. The DIR data has an approximate one (1) year publishing delay. If the current year is unavailable, use the most recent available published data from the DIR site. For example, 2022 DIR data will be used for projects being bid in the 2024 calendar year, unless the 2023 DIR data is published at the time of bid.
d) The Accident Frequency Factor is calculated by dividing the 3-year average recordable cases (H) by the most recently published DIR Industry Average (or national BLS data if DIR data is not available) for the Bidder’s industry NAICS code.
https://www.dir.ca.gov/OPRL/nonfatal.htm
Formula: Bidder’s Average # Recordables = Accident Frequency Factor (AFF)
DIR Industry Average
Bidder’s 3 Year Average Number or Recordables (H)
DIR Industry Average, Based on Bidder’s NAICS Code (I)
Accident Frequency Factor (H/I) = J (J)
iii. Calculation B – Total Case Incident Rate Calculation When Average Worked Hours Greater than 200,000 Hours
Using the OSHA 300 and 300A Forms and the table below, the Total Case Incident Rate (TCIR) is calculated for the past three (3) completed calendar years in the table below.
a) The number of nonfatal injuries and illnesses is determined for each year by:
1. Counting the number of OSHA recordable cases for the year listed on the OSHA Form 300 (log) or,
2. Using the 300A (summary), adding the number of recordable cases entered in Column H + Column I + Column J to obtain the total injuries and illnesses.
b) The number of employee hours worked is located on the OSHA 300A Summary.
c) Using the formula provided below, the TCIR three (3) year average is calculated:
Bidder’s TCIR: # OSHA Case Injuries/Illnesses x 200,000 Employee Hours Worked
Calendar Year
# OSHA
Recordable
Injuries/Illnesses x 200,000
Employee Hours Worked Bidder’s TCIR
20 _ _ x 200,000 (A) (K)
20 _ _ x 200,000 (B) (L)
20 _ _ x 200,000 (C) (M)
TCIR 3-YR Average (K+L+M) / 3 = N (N)
d) The Bidder’s industry NAICS code is looked up in the California Department of Industrial Relations (DIR) Nonfatal Occupational Injuries and Illnesses in California, Summary Tables at https://www.dir.ca.gov/OPRL/nonfatal.htm. The DIR data has an approximate one (1) year publishing delay. If the current year is unavailable, use the most recent available published data from the DIR site. For example, 2022 DIR data will be used for projects being bid in the 2024 calendar year, unless the 2023 DIR data is published at the time of bid.
e) The Accident Frequency Factor is calculated by dividing the TCIR from the above table (N) by the most recently published DIR (or national BLS data if DIR data is not available) data for the Bidder’s industry NAICS code.
Formula: Bidder’s TCIR Average = Accident Frequency Factor DIR Industry Average
Bidder’s TCIR 3 Year Average (N)
DIR Industry Average, Based on Bidder’s NAICS Code**
(O)
Accident Frequency Factor (N/O) = P (P)
f) The ** DIR data has an approximate one (1) year publishing delay. If the current year is unavailable, use the most recent available published data from the DIR site. For example, 2022 DIR data will be used for projects being bid in the 2024 calendar year, unless the 2023 DIR data is published at the time of bid. Instructions for how to calculate the accident frequency factor are provided in BF-6 SAFETY
DECLARATION OF CONTRACTOR.
Subcontractors Safety Evaluation

SUBCONTRACTORS and all other Subcontractors of all tiers who will commence Work within the first ninety (90) days after Award of Contract, the required documentation shall be submitted to OC SAN within three (3) Business Days after the date specified for the submittal of Bids.
ii. For Subcontractors of all tiers who will commence Work at the Project site after the initial ninety (90) days after Award of Contract, the required documentation shall be submitted to OC SAN not less than 30 days prior to the commencement of Work at the Project site, or such other date as may be specified by OC SAN.
iii. OC SAN will perform the safety evaluation of the successful Bidder’s
Subcontractor(s) pursuant to the criteria specified for Bidders in this section.
The successful Bidder shall substitute all Subcontractor(s) who fail the safety evaluation with Subcontractor(s) who do meet the minimum safety requirements for the prices as submitted in the Schedule of Prices and at no additional cost to OC SAN.
At the completion of the Project, OC SAN may conduct a CONTRACTOR performance evaluation which may be used in future assessments of determining Bidder responsibility for future contract awards with OC SAN. The written evaluation may be subject to public review and copying pursuant to the California Public Records Act.
IB-14 DISCREPANCIES IN BID ITEMS
The Bidder shall furnish a price for each individual Bid item, unless otherwise stated in the Schedule of Prices. Failure to do so may render the Bid(s) incomplete and Non- Responsive and may cause its rejection.
