About this file
The document is an addendum to an Invitation for Bid (IFB) issued by the Department of State Hospitals - Metropolitan (DSH-M) for Commissary Services. The IFB seeks a qualified company to provide commissary services to DSH-M patients pursuant to state statutes. The addendum clarifies and updates various aspects of the original IFB, including revisions to the Proposal Submission Checklist, Bidder's Rate Sheet, and questions and answers related to the current population, restrictions, ordering processes, and delivery requirements. The contract term is from October 11, 2024 to October 10, 2027, with no renewal options.
The addendum provides details on the current commissary menu and pricing, including allowances for substitute items. It also clarifies requirements around the business license, seller's permit, and insurance. Commissary sales for the past 12 months were approximately $235,000, with no separate sales data available for the Southern California Youth Correction Reception Center. Patients currently order through a bubble sheet scanning process, and the vendor delivers commissary items directly to the units once a week without an onsite commissary operation.

Addendum #1 & Version #2; #24-20022-000
Version #2: Questions and Answers #1
The following questions have been submitted for clarification:
Q1 What is the total current patient population? What is the expected patient population after 12/31/24?
A1 The current population is 821. The expected population after 12/31/24 could be as much as 1,000 but not guaranteed.
Q2 Are there any restrictions in place that would prevent any part of this population from ordering Commissary? If yes, please describe the circumstances and number of patients this would impact.
A2 Yes, there are population restrictions regarding choking and contraband considerations. Nuts and Peanut Butter are NOT allowed for Skilled Nursing Facility (SNF) patients due to chewing and choking risk. Peanut Butter IS allowed for non-SNF patients. We have two different menus for these reasons.
The SNF population applies to about 60 patients. We currently have two menus (SNF and Non-SNF) that were approved by the RD (Registered Dieticians) and RT (Rehabilitation Therapy) group to meet the varying hospital population needs. Contraband items would include anything on our state contraband list.
Q3 If awarded, is there any flexibility from award date to start date in going live with the Commissary program? Oftentimes, contract negotiations and equipment procurement can take a minimum of several weeks to complete.
A3 We do not expect any delays; the anticipated start date is 10/11/24.
Q4 Could you please provide a copy of the current vendor's Commissary menu and pricing?
A4 Please see attached documents ‘DSH-M Menu’ and ‘DSH-M SNF Menu’ for menus as of 6/26/24.
Q5 Would it be acceptable to provide Commissary menu pricing for similar or substitute items when pricing the Commissary menu request contained on pages 28-34? While most Commissary companies carry many of the same items and many similar items; requiring a match of all exact items gives an unfair advantage to the current Commissary provider.
A5 Yes, we will accept substitute items that are similar in nature but not an alternate sheet. Please see “Addendum 1_Attachment 5” for updated cost sheet for submittal.
Q6 Please provide the commissionable Commissary sales totals for all patients for the past 12 months.
A6 The sales for the past 12 months are about $235,000.
Q7 Please provide the Care Pack* sales total for all patients for the past 12 months. *Prepackaged gift bags in additional to a la carte commissary
A7 MSH does not offer these types of sales via the commissary program.
Q8 Page 2 of the RFP mentions the temporary location of the Southern California Youth Correction Reception Center lease expiring as of 12/31/24. Will those residents no longer be a part of the current Commissary program?
A8 California Department of Corrections and Rehabilitation - Southern Youth Correctional Reception Center & Clinics (CDCR - SYCRCC) may no longer be part of the commissary program; however, some patients may remain under MSH care.
Q9 Please provide commissionable Commissary sales and Care Pack totals for the Southern California Youth Correction Reception Center residents for the past 12 months.
A9 We do not keep track of this data separately and therefore it is not readily available. The sales number provided in Question#6 includes both the MSH and the CDCR - SYCRCC facility.
Q10 Please confirm that all resident Commissary orders will limited to the 11401 S. Bloomfield facility after 12/31/24.
A10 DSH-Metropolitan is unable to confirm that the 11401 S. Bloomfield facility will be the sole location after 12/31/24. The lease for the 2nd location may be renewed.
Q11 Please provide the current vendor’s commission rates for both regular Commissary and online Care Pack sales.
A11 The vendor was not obligated to disclose.
Q12 Does the current vendor operate its current Commissary program on-site? Or are Commissary orders shipped in from an area warehouse to be delivered to residents by vendor delivery clerks?
A12 There is no on-site Commissary program except for the delivery of commissary items. The current vendor delivers once a week directly to the units, no warehouse is utilized.
Q13 What is the size of the space that will be dedicated to Commissary service going forward at the facility?
A13 There is no space; there is no commissary operations onsite
Q14 Is there a dock area that can receive it product at the facility? Is there a lift gate on the dock?
A14 The current vendor delivers once a week directly to the units, there is no lift gate available for use on any dock area. Should the contractor need to use a delivery truck with lift gate requiring a dock for delivery, the bidders are advised that the loading docks available with the penal code compound (CTW & CTE Buildings), the clearance is less than twelve (12) feet tall & nine (9) feet wide for driving a truck in for unloading.
Please see below a picture of the loading entrance:
Q15 How many on-site vendor employees currently help manage the Commissary program? Approximately how many hours per week do they each work?
A15 None, vendor employees are on site only for Saturday deliveries, 8A-2P.
Q16 Do the facilities have own any of the following, or is all current delivery equipment the property of the curretn Commissary vendor: shelving, racking, flatbeds, dollies, delivery bins, etc.
A16 Not applicable; there is no commissary operations onsite.
Q17 Is the sole means of patient Commissary ordering via bubble sheets, or do patients order any other way?
A17 Yes, the only method for patients to order commissary is by use of a bubble sheet method. However, family members also have access to order menu items via the online portal, Access Securepak.
Q18 How many Commissary orders on average are currently submitted each week? How many of those average weekly orders are from the Southern California Youth Correction Reception Center residents?
A18 About 250 orders each week. For SYCRCC facility, about 10 orders per week.
Q19 How are Commissary orders processed - manual entry or by bubble sheet scan machine?
A19 Bubble sheets are used so bubble sheet scan machine is utilized to process orders.
Q20 Are deposit services part of the Commissary RFP?
A20 No.
Q21 If yes, are either of deposit machines or online deposit services provided by a vendor?
A21 N/A
Q22 If no, how do patients add money to their trust fund accounts?
A22 Money is added to patient Trust accounts in the following ways:
Family, public guardians and others mail checks or money orders to the Trust Office.
Family and others come to the Trust Office in person and deposit cash, checks or money orders.
Some patients work and earn pay for time worked.
Family and others can deposit money using online, mobile app, or phone service (this is expected to go live by 9/30/24)
Q23 Are any JMS/OMS (Jail Management System/Operational Management System) program systems utilized? If yes, what vendor provides them and are the interfaced with a patient trust account?
A23 Yes, the OMS platform, Fusion is utilized. Currently, Keefe provides this system, which is interfaced with the patient trust account.
Q24 I see phone cards are part of Commissary service - who is the phone service provider?
A24 The phone cards that are currently in use are generic cards that are provided/ordered from our current commissary vendor. Family members also can purchase generic phone cards from local convenience stores and drop them off for patients but again, these are generic cards, there is no phone service provider associated with the cards.
Q25 Will SFTP (Secure File Transfer Protocol) be available to transfer patient balances between the commissary provider and the trust account software?
A25 Yes.
Q26 Will SFTP (Secure File Transfer Protocol) provide sufficient security on patient data files, or will a VPN still be required?
A26 A VPN will be required.
Q27 I have a question regarding the language in the required reference letter section on page 25-80, it states: “IF the Proposer has provided services to the DSH during this timeframe, one of the references MUST be from a DSH Contract Manager.” Please confirm that as the current provider for Metro State Hospital, we must provide a reference letter from the DSH Contract Manger from this facility.
A27 Correct, since your current term of service falls within this timeframe, we would require MSH as one of your references.
Q28 On page 3-80, the document states: “a. Establishes policies and procedures which enhance the food service operation and ensures compliance with applicable laws and regulations.”
Please confirm that the mention of food service was in error and that food services is NOT a part of this solicitation
A28 Correct, ‘food services’ is meant to mean commissary services; food services are not a part of this solicitation, you can disregard the reference.
Q29 On page 3-80, the document states: “Contractor shall work closely with DSH-M Contract Manager, or designee, and Nutrition Services staff to assess current and future food related needs to incorporate the facilities Healthy Nutrition Guidelines, planning and implementing strategies to meet those needs within the first twelve (12) months of service.” Please further explain/elaborate on this.
A29 Refer to question and answer #2 above.
Q30 The bid states a term date from October 11, 2024 until October 10, 2027. Will this contract have any options for renewals? If so, please provide further details.
A30 Prior to the term expiring, there will be another bid process for the renewal of the services. There will be no option to amend the existing agreement.
Q31 On page 11-80, the document states: “Proposers must submit a resume of qualifications showing that the company has at least five (5) years’ experience in food service management and time in industry providing related commissary services in at least ten (10) secure facilities.”
The section mentions food service, please confirm that this is in error and that only commissary services is be requested.
A31 Yes, we are looking for commissary services experience.
Q31 In section B in the Proposal Scoring on page 14: “Proposer has submitted a resume of qualifications showing that the company has at least five (5) years’ experience in food service management and time in industry providing related commissary services in at least ten (10) secure facilities.” Please confirm the food service requirement is in error and that this solicitation is strictly for commissary services only.
A31 See question 31
Q32 Page 4-80 speaks heavily on generative AI. Please confirm that this is NOT a requirement and that the hospital is asking for the vendor to confirm that there are no risk associated with Generative AI as part of their technical proposal.
A32 Yes, the hospital is asking for confirmation which will be confirmed via Exhibit 10 on page 41. There is a link to the form that must be completed as part of the bid submission.
Q33 Page 75 Exhibit C is mentioned, but there is not an Exhibit C provided with the RFP.
Can you please clarify where Exhibit C can be found?
A33 The exhibits are provided as a sample of what the final agreement would look like for the winning bidder. In Attachment 15, page 42, the Sample Agreement, STD 213, under section 4., you will see the list of Exhibits that will be included in the final agreement. Exhibit C is on the list with an asterisk, which refers to this statement:
Exhibit C is viewable at the link noted above. Here is the link for your reference: GTC April 2017 FINAL.pdf
Q34 Page 6 states “The Proposer shall further certify that they understand the insurance requirements in Attachment 14, “Sample Agreement, Exhibit F, Insurance Requirements, and if awarded an agreement, shall provide the DSH with all required insurance documents as may be applicable, in a timely manner.”
Per the RFP, the Sample Agreement is listed as Attachment 15 and only required to be completed by the awarded vendor.
Exhibit G in the RFP are the Insurance Requirements, is the above a typo and listed as Exhibit F?
A34 Yes, the sample agreement is just listed to show what form the awarded vendor will be receiving and signing. Attachment 15 should not be included in your bid submission.
Yes, this is a typo, and it should have stated: “The Proposer shall further certify that they understand the insurance requirements in “Attachment 15, Sample Agreement, Exhibit G, Insurance Requirements…”
Q35 Page 10, Item 7 Technical Proposal Content, lists the requirement below. For the job description, are you looking for the company’s official job description or a narrative explanation of the specific duties and performed for DSH-Metropolitan?
a. Proposer must submit a list of all Key Personnel who will be working on the proposed project. This section shall describe Proposer’s projected staffing plan including:
i. Title, role, and job description of all Key Personnel (including sub-contractors and consultants).
A35 A combination of both would be ideal to align with/clarify your organizational chart.
Q36 Regarding the completion of the menu section starting in Section A on page 28-80:
a. How should we list an item description if it’s different than what is listed?
b. If a vendor does not have the listed item available, do we leave the price blank or notate it another way?
c. Will differences in items offered from vendor to vendor, including those items that cannot be offered, be taken into consideration when calculating the total cost proposal. If so, how will this be done to ensure an accurate comparison?
A36-a. Please refer to Addendum #1, Attachment 5 ‘Proposer’s Rate Sheet’. Rate sheets have been revised to include a column to list any item that is different from what is on the original Attachment 5 ‘Proposer’s Rate Sheet’. While the brand may be different than is what on the rate sheet, any noted item sizes must be comparable to the original item listed.
A36-b. Per page 27, Attachment 5 ‘Proposer’s Rate Sheet’, A.5. “Rates are required for all items listed.
Failure to provide the required rates shall be cause for rejection of a submitted bid.” If you have a comparable item, please add it to the revised rate sheet noted above.
A36-c. Per page 27, Attachment 5 ‘Proposer’s Rate Sheet’, Item 2:
The final menu will be mutually decided upon between the awarded Contractor and the DSH-M Contract Manager, or designee. Similar or like items may be substituted with prior approval of the DSH Contract Manager, or designee. Any deletions of items will be at the discretion of the DSH Contract Manager, or designee.
Q37 Will Docusign digital signatures be accepted on all forms?
A37 While digital signatures are acceptable; per the bid package instructions (page 8), only physical submissions will be accepted.
Q38 Per the RFP, the hospital is requesting a seller's permit and business license on the score sheet:
However on Attachment 3 - it states the business license may be not applicable.
Is the business license required or will the vendor's selling permit cover the requirements?
A38 DSH-M is looking for the vendor’s current city business license as well as the Sellers Permit.
