About this file

This Addendum No. 1 to RFP UCO 1015 issued by the City University of New York provides clarifications, responses to vendor questions, and modifications to the original plagiarism detection solution solicitation. The RFP seeks a comprehensive plagiarism detection and academic integrity platform serving CUNY's 26 campuses and approximately 230,000 students. Written questions were due July 7, 2026 at 1:00 PM Eastern Standard Time and July 16, 2026 at 1:00 PM Eastern Standard Time (extended to July 30, 2026 per this addendum). The original proposal submission deadline of July 29, 2026 at 2:00 PM Eastern Standard Time has been extended to August 19, 2026 at 2:00 PM Eastern Standard Time. No pre-proposal conference will be held, contrary to the original RFP statement. The initial contract term is three years commencing upon Attorney General and New York State Comptroller approval, with optional renewal for up to two additional years. Implementation is scheduled to begin in January 2027, with pilot go-live in Q2 2027 and university-wide rollout in Q3/Q4 2027. The solution must integrate with Brightspace by D2L, maintain 99.5% monthly uptime, comply with Section 508, WCAG 2.2 AA, FERPA, and GDPR requirements, and provide SOC 2 Type II or SSAE 18 reporting annually.

The addendum clarifies that authorship verification and stylometric analysis are preferred but not mandatory features, contrary to Attachment A's initial designation. CUNY will not accept ISO/IEC 27001 certification in lieu of the mandatory SOC 2 Type II or SSAE 18 requirement. Vendors unable to meet the 30% MWBE participation goal and 6% SDVOB participation goal may submit a waiver request; the addendum confirms that non-U.S. software vendors may submit waiver requests supported by good-faith outreach if suitable subcontracting opportunities are unavailable. Alternative pricing proposals are permitted only as supplements to the primary bid and will only be considered if the proposer is selected for award. Multiple product solutions may be submitted only as separate proposals with complete Volume I, II, and III sets for each product. The addendum rejects several vendor exceptions, including deletion of the accessibility requirements section and the vendor's proposed service level agreement; however, it accepts modifications to the data return timeline (extending from ten to thirty days), deletion of automobile liability insurance requirements, and modifications to intellectual property and breach liability provisions. All proposals must include the signed addendum, and the University reserves the right to reject responses submitted without all addenda properly executed.

UCO 1015

Responses to Questions

Q1. Estimated Usage / Volume Requirements - Approximately how many documents do you check annually?

A1. CUNY does not maintain a centralized annual count of document submissions for plagiarism review. Vendors should size and price their solutions to support potential systemwide deployment serving approximately 230,000 students across the University. Actual submission volumes may vary by campus and adoption levels.

Q2. External IP Range Size: Can CUNY provide a typical range (e.g., /24, /22) or count of externally routable IPs per organizational unit so vendors can scale tester-day effort accurately?

A2. CUNY expects integration with Brightspace by D2L using industry-standard methods, including support for LTI 1.3 and applicable APIs. The solution should support secure synchronization of course rosters, assignment submissions, and grade information. Vendors should identify any required permissions, configuration requirements, or dependencies necessary to support these functions.

Q3. Attachment A – Functional Requirements (and, if applicable, the section describing preferred features)

- The RFP describes Authorship Verification and Stylometrics as "Preferred but not required," yet Attachment A marks these rows as "Mandatory." Please confirm which status is correct.

A3. Authorship Verification and Stylometric Analysis should be considered preferred but not required features. Vendors are encouraged to describe available capabilities in these areas;

however, these features are not mandatory requirements for proposal responsiveness. .

Q4. SOC Reporting - Would CUNY accept ISO/IEC 27001 certification, penetration testing reports, incident response documentation, and security policies in lieu of SOC 2 Type II/SSAE 18, or is the latter mandatory

A4. The RFP requires annual submission of SOC 2 Type II or SSAE 18 reports. While additional security documentation, such as ISO/IEC 27001 certification, penetration testing reports, incident response documentation, and security policies, is encouraged and may supplement a proposal, such documentation does not replace the SOC 2 Type II/SSAE 18 requirement. .

Q5. Pre-Proposal Conference - The RFP states that the pre-conference meetings are mandatory. Please indicate the date, location, and whether pre-registration is required.

A5. There will not be a pre-conference meeting for this solicitation.

Q6. MWBE/SDVOB - "We respectfully request a full participation waiver from the 30% subcontracting goals in the aggregate for New York State certified Minority-Owned Business Enterprise (""MBE"“) and Women- Owned Business Enterprises (""WBE"", and, together with MBE, ""MWBEs"") and a 6% participation goal

Addendum 1 Page | 3

2091-6229-2998, v. 1 UCO 1015

(based on the current availability of qualified SDVOBs) for New York State certified Service-Disabled Veteran-Owned Businesses(""SDVOB"") on the following basis:

a. Software licensing comprises the substantial majority of the contract value

b. All scoped services are performed internally as a core competency

c. No New York state presence or local subcontracting infrastructure Should the Proposer submit a written waiver request with its proposal, or does CUNY prescribe a specific form or process for requesting such a waiver? If a specific form is required, please identify where it can be obtained."

A6. If a proposer is unable to meet the MWBE participation goals, it may submit a waiver request in accordance with the solicitation requirements

Q7. Required Forms - Can CUNY identify where the Required Forms can be obtained?

A7. Please see Attachment A to Addendum # 1

Q8. Proposal Submission Requirements or Required Forms - Are electronically signed documents accepted, or must all forms include wet signatures and notarizations?

A8. Electronic submission of the response is required; however, wet-signed and notarized originals must later be provided to CUNY Procurement.

Q9. MWBE/SDVOB Participation Requirements - For MWBE/SDVOB goals, may a non-U.S. software vendor submit a waiver request supported by good-faith outreach if suitable subcontracting opportunities are unavailable?

A9. Please see the response to Question #6 above.

Q10. How will the RFP be awarded, multi award or a single award?

A10. Please refer to Section II, page 5 of the RFP. The Section is labeled:

Anticipated Number of Contracts

Q11. Approximately how many documents do you check annually?

A11. See response to #1 above.

Q12. The RFP details a singular subject line labeling protocol for email submissions but does not explicitly address the acceptability of alternative proposals. Will CUNY allow a single Proposer to submit more than one bid or present alternative technical/pricing solutions under separate volumes? If so, how should the electronic files and email subject lines be formatted to distinguish the primary bid from the alternative bid?

Addendum 1 Page | 4

A12. If a vendor wants to submit an alternative pricing method (and this is only for pricing) they must submit it in addition to Part 5 that is currently in the RFP. Proposer will be evaluated on Part

5. If Proposer is being considered for award (i.e. after evaluations are complete) then CUNY may consider the alternative pricing.

Q13. Can Offerors submit proposals for more than one product or solution in response to this solicitation? If so, should each product be submitted as a separate proposal, or may multiple products be included within a single proposal submission?

A13. If a proposer wants to submit more than one product or solution in response to the RFP’s requirements, they must submit a separate proposal (i.e. Volumes I, II and III) for each product being proposed.

Q14. Section 4.7 explicitly encourages Proposers to include "Value-Added" features and innovative capabilities that extend beyond the core platform specifications. Could CUNY please clarify if advanced academic integrity solutions or secondary products that fall outside the core functional scope may be proposed in this section, A14. If such features will be provided to CUNY at no additional cost, then yes.

Q15. While the core software application platform maintains robust accessibility compliance, our supplemental training documentation and user guides do not currently fully meet all Section 508 /

WCAG standards. Will CUNY accept a copy of our current Accessibility Roadmap or Accessibility

Conformance Report (ACR) which aligns with our Voluntary Product Accessibility Template Lite

(VPAT) v2.5 detailing our ongoing compliance initiatives for training assets in lieu of immediate day-one full compliance for all documentation?

A15. No.

Q16. Can Offerors submit proposals for more than one product or solution in response to this solicitation? If so, should each product be submitted as a separate proposal, or may multiple products be included within a single proposal submission?

A16. See response to #13 above.

Q17. Regarding technical evaluation environments: The Respondent does not host a standalone, external vendor sandbox environment. However, we can fully provision and test features within a

CUNY-provided D2L Brightspace staging or sandbox environment. Please note that any data, submissions, or configurations generated within this sandbox testing environment cannot be transferred to CUNY's live, campus-specific production instances post-evaluation. Will CUNY be able to provide a dedicated D2L Brightspace testing environment for this phase?

A17. Yes, we have the Brightspace test environment that can be used.

Q18. To ensure the Respondent allocates adequate technical support and integration resources during the evaluation phase, could CUNY define the anticipated scope of the pilot milestone? Specifically, how

Addendum 1 Page | 5 many CUNY campuses, faculty members, and students are expected to participate in the pilot program?

A18. The pilot implementation is expected to include a limited number of participating CUNY campuses representing a cross-section of institutional sizes and instructional models. The exact number of campuses, faculty, and students has not yet been determined and will be finalized during project planning with the selected Respondent.

Respondents should assume the pilot will be of sufficient scale to validate the integration with the

LMS, and key workflows, as well as support functional, technical, and user acceptance testing before a full systemwide deployment. The selected Respondent should be prepared to provide the technical resources necessary to support planning, implementation, testing, issue resolution, training, and pilot evaluation.

This section will address any exceptions to the terms and conditions outline in the RFP:

Breach by CONTRACTOR or its staff, it shall promptly reimburse all costs to CUNY arising from such

Breach, including but not limited to costs of notification of individuals, establishing and operating call center(s), credit monitoring and/or identity restoration services, time of CUNY personnel responding to

Accepted

4. EXCEPTION TO PART 8: SERVICE LEVEL AGREEMENT

Exception to Part 8: Service Level Agreement

The vendor respectfully requests deletion of CUNY's Service Level Agreement terms set forth in Part 8 in favor of the vendor's Service Level Agreement, to be attached as an exhibit to the Contract.

This Service Level Agreement ("SLA") sets forth the service level and performance objectives of the

Contractor in providing SaaS (the "Services") to CUNY. The Contractor will use reasonable efforts to meet the following service level and performance objectives to support the operation of the facilities, server(s), computer equipment, operating software and connectivity used to provide the Services to

CUNY. The SLA is the process and interactive agreement that regulates activities and guides all parties toward the targeted successful outcome.

(a) Uptime Commitment

The Contractor will use reasonable efforts to ensure the Contractor's Systems are available a minimum of 99.5% of the time (the "Uptime Commitment"). All Uptime Commitment will be measured within the Contractor's System on a monthly basis calculated to include twenty-four (24) hours per day over each month, but excluding from the numerator and denominator in the calculation

Addendum 1 Page | 9 the duration in time of any temporary shutdowns due to scheduled maintenance (which will not exceed in the aggregate sixteen (16) hours per month outside of normal business hours), telecommunications or power disruptions caused by third parties, and any other causes beyond Contractor's reasonable control. The Contractor agrees to notify CUNY promptly of any factor, occurrence, or event coming to its attention that may affect the Contractor's ability to meet the Uptime Commitment, or that is likely to cause any material interruption in the Services.

(b) Exclusive Remedy

The Contractor will use reasonable efforts to correct any material problems in the Services, including any failure to satisfy the Uptime Commitment. In the event that the Contractor fails to satisfy the

Uptime Commitment for a given month, CUNY's sole and exclusive remedy will be to receive a service credit equal to the following percentage of the monthly fees for the Services for the stated uptime:

a. 98% to 99.5%: 10% b. 95% to 97.9%: 25% c. 92% to 94.9%: 40% d. 90% to 91.9%: 60% e. Below

90%: 100%

In no event will the service credit exceed the monthly fees paid by CUNY for the Services. CUNY acknowledges and agrees that if the remedies set forth in this section are applied, any failure of the

Contractor to meet the requirements in this SLA will not constitute a breach of the Agreement.

Gender-Based Violence and the Workplace Certification

New York State Finance Law §139-M requires bidders on competitive state procurements to certify that they have a written policy addressing gender-based violence and the workplace and that such policy meets the following minimum requirements:

● Share Information: Employers must provide information regarding gender-based violence where employees can see and access it, including displaying the NYS Domestic and Sexual Violence Hotline information and a gender-based violence and the workplace poster.

● Refer Employee-Survivors to Services: The policy must require that the employer refer employees who disclose current or past victim status to the NYS Domestic and Sexual Violence Hotline and/or a local service provider. For bidders outside of New York State, referrals should be made to a local provider or statewide hotline. While referrals are required to be provided by the employer, it is not required for the employee to access services.

● Prohibit Retaliation: The policy must clearly state that discrimination or retaliation against employees who identify as victims or survivors of gender-based violence is prohibited.

● Comply with Laws: Ensure your policy follows State law. For employers based in New York State, this means that the policy must follow the SAFE Leave Act, New York State Human Rights Law, and any other relevant laws and regulations.

● Offer Implementation Support: OPDV is able to assist employers in developing and implementing this policy. Employers must provide information to supervisors and human resources, where available, about this technical assistance from OPDV. OPDV can be contacted at workplace@opdv.ny.gov.

By submission of this bid, each bidder and each person signing on behalf of any bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of perjury, that the bidder has and has implemented a written policy addressing gender-based violence and the workplace and has provided such policy to all of its employees, directors and board members. Such policy shall, at a minimum, meet the requirements of subdivision 11 of section five hundred seventy-five of the executive law.
