About this file

This is a Solicitation Addendum #1 issued by the North Carolina Department of Agriculture and Consumer Services in response to vendor questions regarding RFP 10-RFP-2189114180-YB for fireworks display services at the NC State Fair. The addendum clarifies key requirements for the fireworks display, which is scheduled for 11 consecutive evenings during the State Fair from October 15-25, 2026, with shows beginning at 9:45 PM nightly. The State addresses four primary vendor questions concerning platform modifications and launch requirements. Notably, the State confirms that all fireworks must be launched from the owner-provided floating platform in the fairgrounds pond, which is classified as Waters of the US and therefore cannot be converted to a fixed platform structure. The State permits contractors to install additional temporary dock or platform sections solely for working space, provided they are not permanently affixed to the floating platform and do not cause damage. Contractors bear all costs and liability for any temporary additions. The addendum reaffirms that show design is at the vendor's discretion and may utilize smaller 30mm cake-style fireworks supplemented with other effects to accommodate the floating platform constraints. All other solicitation terms and conditions remain unchanged, with the proposal opening date and time remaining July 23, 2026 at 2:00 PM ET.

The addendum does not introduce new pricing modifications; the contract pricing remains fixed at $11,000 per nightly show for 11 shows as specified in the original RFP. The State maintains all original requirements regarding vendor qualifications, compliance with NFPA standards, E-Verify requirements, North Carolina Secretary of State registration, financial stability demonstration, and submission of customer references. No set-asides, incumbent preferences, or funding source modifications are referenced in this addendum. The clarifications provided in this addendum are intended to address vendor concerns regarding logistical and environmental constraints while ensuring compliance with federal wetland regulations and fairground operational requirements.

SOLCITATION ADDENDUM

1. The following are questions received about the Solicitation and the State’s response to those questions:

Question # Vendor Question State’s Response

1 Would the State permit the existing floating dock to be secured with spud poles so that it would be considered a non-floating platform for the fireworks display? If not, would the State allow temporary posts or footings to be installed to create a separate non-floating launch platform adjacent to the existing dock?

Due to the fact that this body of water is listed in Waters of the US, there would not be sufficient time to install a fixed platform in the lake before the 2026 NC State Fair. All shots will be fired from the owner provided floating platform.

2 Would the State allow the contractor to install additional temporary dock or platform sections adjacent to the existing dock to provide additional working space, provided no fireworks are launched from those added sections

As long as they are not permanently affixed to the owner provided floating platform or create damage to the structure, yes.

Contractor is responsible for costs and liability of additional temporary dock or platform sections.

3 If additional temporary platform sections are permitted solely for working space, with all fireworks being launched from the compliant non-floating launch platform, would this arrangement be acceptable under the solicitation requirements?

Yes. Again, this is a floating launch platform in the pond provided by the NC State Fair.

4 If the launch platform must remain a floating platform and no modifications or expansion are permitted, would the State consider a display designed primarily with smaller 30 mm cake-style fireworks, supplemented as appropriate with other effects, to be an acceptable approach for meeting the performance expectations?

The show design is up to the potential vendor.
