About this file
This is Addendum One to an Invitation for Bid (IFB 1CA07982) issued by the California Department of Forestry and Fire Protection for hazardous waste removal and disposal services. The addendum addresses questions and clarifications regarding the scope of work, which includes removal and disposal of non-RCRA waste liquids (waste oil, hydraulic fluids, transmission fluids), waste anti-freeze/coolant, waste solvents, used metal oil and waste fuel filters, used paper filters, miscellaneous hazardous waste, oily absorbents, paint, wash rack pumping services, empty drum disposal, and drum replacements. The contract term is three years with no renewal options mentioned. The incumbent contractor is Safety-Kleen Systems, Inc., operating under agreement number 1CA06815, with an estimated three-year cost of $12,454.65 based on the rate sheet provided.
Key pricing and contractual terms include that all unit rates submitted by bidders must remain fixed for the entire three-year agreement period with no adjustments permitted for Consumer Price Index, Producer Price Index, fuel surcharges, or regulatory fees. All submitted unit rates must be all-inclusive, incorporating labor, mobilization, transportation, mileage, fuel, equipment, travel, and disposal costs with no separate charges permitted. Billing for tank-based services is calculated on full tank capacity regardless of actual volume present. Contractors must maintain current hazardous waste transporter identification from the California Department of Toxic Substances Control, hazardous materials certificates from the U.S. Department of Transportation, hazardous materials transportation licenses from the California Highway Patrol, motor carrier permits from the California Department of Motor Vehicles, and EPA identification numbers. No prevailing wage requirements apply to this agreement. Any subcontractors, including independently operated laboratories, transportation providers, recycling facilities, and treatment or disposal facilities, must be identified and disclosed in the bid submission.

Questions and Answers
Question #1
For the Non-RCRA Waste Liquid (Waste Oil, Hydraulic, Transmission Fluids) line items, please confirm whether the listed tank size represents a single tank in which these fluids are commingled, or if they are stored in separate containers. If they are stored separately, please provide the number and size of the tanks at each location.
Answer #1
Waste oil, hydraulic fluid, and transmission fluid are stored in the same container. The tank quantities and sizes for each location are already identified in the Rate Sheet.
Question #2
For waste streams where the Unit of Measure is determined by tank capacity (e.g., 120-gallon, 240-gallon, 285-gallon, or 480-gallon tanks), please clarify the pricing structure. Should the Unit Price reflect the all-inclusive cost to pump and dispose of the full tank capacity regardless of the volume present, or will billing be based on the actual gallons removed?
Answer #2
The Unit Price should reflect the all-inclusive cost to pump, transport, and dispose of the waste based on the full tank capacity listed in the Rate Sheet, regardless of the actual volume present at the time of service.
Question #3
Confirm whether the “Estimated Quantity of Services Annually” represents the expected number of individual collections per year at each location. For example, does a quantity of 15 for a 480-gallon tank indicate approximately 15 pump-outs annually?
Answer #3
Yes.
Question #4
Confirm that prevailing-wage requirements do not apply to services performed under this agreement and that bidders and subcontractors will not be required to register with the Department of Industrial Relations or submit certified payroll.
Answer #4
No prevailing wages requirements.
Question #5
May the Contractor use any appropriately licensed and permitted treatment, recycling, or disposal facility that complies with applicable federal, state, and local requirements? Please identify any required or prohibited facilities, geographic restrictions, or limitations on transporting waste outside California or the United States.
Answer #5
Yes. The Contractor may use an appropriately licensed and permitted treatment, recycling, or disposal facility that complies with all applicable federal, state, and local requirements. The Prime Bidder and subcontractor(s), if applicable, must maintain all required licenses, permits, registrations, and identification numbers, including:
1. A valid and current Hazardous Waste Transporter Identification Number and Registration Certificate issued by the California Department of Toxic Substances Control (DTSC).
2. A valid and current Hazardous Materials Certificate of Registration issued by the United States Department of Transportation (USDOT).
3. A valid and current Hazardous Materials Transportation License issued by the California Highway Patrol
(CHP).
4. A valid and current Motor Carrier Permit (MCP) issued by the California Department of Motor Vehicles
(DMV).
5. A valid and current Environmental Protection Agency (EPA) Identification Number.
Question #6
Confirm that all submitted unit rates will remain fixed for the entire three (3) year agreement term and that no Consumer Price Index (CPI), Producer Price Index (PPI), fuel, disposal-cost, prevailing-wage, regulatory-fee, or other documented rate adjustments will be permitted after the first year.
Answer #6
Yes. All submitted unit rates shall remain the same for the entire three (3) year agreement term.
Question #7
The IFB permits subcontracting when subcontractors are disclosed on the Bidder Declaration. Please clarify whether independently operated laboratories, transportation providers, recycling facilities, and treatment or disposal facilities are considered subcontractors that must be identified in the bid.?
Answer #7
Yes, they shall be identified and provided in Attachment 5 and Attachment 10.
Question #8
Confirm that each submitted unit rate must include all labor, mobilization, transportation, mileage, fuel, equipment, and travel costs associated with servicing the applicable location and transporting the waste to the selected treatment, recycling, or disposal facility, and that no separate mobilization or transportation charges may be invoiced.
Answer #8
Yes. All submitted unit rates shall be all-inclusive and must include all labor, mobilization, transportation, mileage, fuel, equipment, travel, and disposal costs associated with the applicable service. No separate or additional charges outside of the rates identified in the contract will be paid.
Question #9
Identify the incumbent contractor and the current or most recent agreement number. Please also provide, or indicate how bidders may obtain, the incumbent contractor’s pricing schedule.
Answer #9
