Questions: Answers:

The RFI solution must be hosted as a Software as a Service within the U.S. exclusively by U.S.

Personnel. Does the solution need to pre-exist in some form before the contract is awarded?

The RFI is seeking information about currently built and matured solutions. See page 3 paragraph 1 under Introduction and Context.

Can the solution be comprised of several pre-existing components, for example different computer vision algorithms, and then architected to meet the specific requirements for the RFI?

As long as the solution is currently built and is a mature solution as set forth in the RFI, and the architecture is able to meet FedRAMP and ATO requirements for use.

If the SaaS application is built according to USPTO’s specific design patent needs using pre-existing components owned by the vendor, would there be an objection for vendor to own the IP on the resulting solution?

USPTO will retain ownership of the data that is funneled through the software. If government funds were not used to produce any part of the software, then the IP will remain with the vendor.

If the solution is built for USPTO and is hosted on a FEDRAMP cloud solution, would this meet USPTO’s requirements? Or would it need to be certified FIPS 199 compliant as part of the build?

The solution and the environment will both need to be FedRAMP certified and ATO approved.
