4. Authority Cited:
10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, Unusual and compelling urgency.
5. Reason for Authority Cited:
Background: An urgent and ongoing need exists to for BLS and ACLS certified clinical providers within the VHA to provide care to patients Nationwide. Without this training, and the capability it delivers, there will be a clinical provider capability gap that will impact the provision of care to Veteran patients and Veteran Access within the VHA. The VHA has an established certification requirement for all clinically active staff where they shall maintain BLS certification and a sub set of these staff are required to also be ACLS certified. The REdI program office is responsible for providing the required certification training.
Since 2012, the REdI program has embarked on a continuous training project to reduce the Instructors’ and Clinicians’ time away from providing care to Veteran patients by completing the required certification using multiple delivery methods; an online virtual patient environment training program and computerized manikin skills testing and the traditional live, face to face training sessions. Currently only AHA training materials are fully compliant with the certification requirements of the VHA. If the REdI program is unable to acquire sufficient additional training materials clinical providers nationwide will be unable to complete the required certification training within the next 90 days. Clinical providers without the required certification are stood-down and restricted from providing care to Veteran patients. The impact will result in cancellation of clinical appointments, procedures and other direct inpatient care, directly and negatively impacting thousands of Veterans’ access to care.
Justification: The VHA and REdI program is in constant need for the ACLS and BLS training to ensure their clinical providers are adequately certified. PdM MedSim and ACC-Orlando have been supporting the REdI program since 2013. In that time a number VHA clinical providers have opted for the online and computerized manikin certification over the live training sessions. However, there is still a critical need for the live training sessions until all VAMCs have the online and computerized manikin certification capability. This has made it difficult for the VHA and PdM MedSim to keep up with the demand for current and adequate live training sessions and their required AHA training materials.
ACC-Orlando had issued a combined synopsis/solicitation to FedBizOpps on 12 September 2016 as a small business set-aside. The combined synopsis/solicitation was posted for 7 days with responses due 1200 Eastern Time 19 September 2016. This action was protested by Pacific Medical Training to the Government Accountability Office
(GAO) on 13 September 2016, citing overly restrictive requirements. This modification acts as a bridge from the most recent contract, W900KK-16-C-0044, to the next effort pending the outcome of the GAO’s ruling. The training materials to be procured by this modification will allow the VHA to certify medical personnel in life-saving procedures and operate at their required staffing levels through the protest and adjudication periods.
Impact: Failure to provide certified BLS and ACLS clinical providers in a timely and continuous manner will result in the cancellation of outpatient medical appointments and will result in an interruption to Veteran inpatient and outpatient care nationwide negatively impacting up to 8.9 million Veterans’ access to care. If clinical providers are unable to practice it could hinder the VHA’s ability to respond to routine and emergency situations that could lead to the loss of life. VAMCs Nationwide vary in size, in some cases the cancellation of appointments and surgeries for providers could leave Veterans without their required care for weeks or months, thus putting their healthcare needs in jeopardy. Specifically, the VHA will fail to meet the requirement to provide care to Veterans and will negatively impact the number one VHA priority; Improving Veterans’ Access to care.
6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(2), this action will not be synopsized. Based on the information in paragraph 5 above, competition for this action is not feasible.
a. Effective Competition: Because this is a sole source action with unusual and compelling urgency, effective competition is not applicable.
b. Subcontracting Competition: N/A
7. Actions to Increase Competition: The initial action was posted to FedBizOpps as a competitive, small business set-aside, combined synopsis/solicitation. This is the same strategy used by the Government on previous acquisitions for AHA training materials, and received adequate competition each time. The Government anticipated and received competition on the protested combined synopsis/solicitation. The Government will consider a future multi-year contract vehicle open to industry partners in fiscal years 2017-2018 for BLS and ACLS training materials. Additional market research will be performed for all future requirements to identify all potential sources.
8. Market Research: The market research performed by the PdM MedSim engineer found that there are several small businesses that could provide the required training materials in the required delivery period. The AHA training materials are available as commercial-of-the-shelf products. In addition, the company Pacific Medical Training provided a capabilities and curriculum report to the REdI Advisory Board in early 2016 as a part of a protest to live BLS AHA training courses at the Ann Arbor, MI VAMC. In a response dated 6 September 2016, the REdI Advisory Board rejected Pacific Medical Training’s capabilities statement and curriculum as it was determined to be insufficient for the BLS training. The Government has found no evidence that BLS/ACLS training materials other than those published by the AHA are capable of providing adequate live training for both ACLS and BLS training and certifications. As stated above, ACC- Orlando advertised its combined synopsis/solicitation for this requirement and has never received a capabilities statement expressing a company’s ability to meet the
Government’s requirements using products other than those published by the AHA.
9. Interested Sources: ACC-Orlando has received seven timely responses to the combined synopsis/solicitation, W900KK-16-T-0027, posted to FedBizOpps. The interested companies are; Channing Bete, Public Health Solution, LLC, The Janz Corporation, Beacon Point Associates, LLC, Advanced Educational Products Inc., BMK Ventures Inc., and WorldPoint. Pacific Medical Training has protested the Government’s combined synopsis/solicitation, yet failed to provide a proposal or a capabilities statement in response to the posting to demonstrate their firm could satisfy the requirement. The information provided to the REdI Advisory Board for a previous protest has been determined to not meet the Government’s requirements.
10. Other Facts:
a. Procurement History:
(1) The Government has awarded several contracts; W900KK-16-C-0021, W900KK- 16-C-0044, and W900KK-16-C-0046, to multiple vendors for the BLS and ACLS training materials as small business set-aside competitions through FedBizOpps. The Government has received adequate competition in all of the contract awards listed above.
