About this file

This document is a Limited Source/Brand Name Justification under FAR 13.106-1(b)(1) for simplified acquisitions. It describes a requirement for the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) to modify, inspect, and repair up to three (3) MD 530 helicopters currently located at Thoroughbred Aviation Maintenance in Lexington, KY. The justification cites the exorbitant cost and impracticality of having the work performed by a vendor other than Thoroughbred Aviation due to the helicopters' current condition and location. The estimated price for the one-time purchase order is $100,000 with a period of performance from September 5, 2024 to December 31, 2024. APHIS intends to award a firm fixed-price contract to Thoroughbred Aviation Maintenance as the sole source. Responses from other responsible sources will be considered, but the government reserves the right to make a non-competitive award.

United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions Control No. (if applicable) SS1138862

1. Identification of the agency and the contracting activity.

USDA/APHIS/Wildlife Services – Eastern Region Aviation Program Helicopter maintenance for (3) MD 530 helicopters

2. Description of supply or service required to meet the agency’s needs.

Modification and service of (up to 3) MD 530 helicopters to include moving primary flight controls to the right side of the aircraft, installation of flight following units, comm and TDFM radios, VHF antenna, iPad/GPS/firearm mounts, USB outlets, dual control covers, assembly of consumables kit, airframe 100-hour inspection, engine 150-hour inspection, and compliance with instructions for continued airworthiness, airworthiness directives, and service bulletins.

3. The rationale or circumstances for limiting competition.

The subject aircraft are currently located in Lexington, KY at Thoroughbred Aviation and are not presently in a flyable condition. To award this work to a vendor other than Thoroughbred Aviation would result in an exorbitant cost due to the condition of the aircraft and the inability for another vendor to perform work at the current location. Added cost would be incurred as the aircraft would have to be lifted and trailered off-site prior to performing the required service.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

A contract was recently awarded for transport of 5 newly acquired aircraft. The vendor that was awarded the contract transported the aircraft in a similar manner that the subject aircraft of this contract would be transported at a rate of $4000 per aircraft. Through the process of inquiring for a longer term maintenance contract, we have found Thoroughbred to be less than or comparable to several others in labor rates and service pricing. By awarding this contract to Thoroughbred, we are estimating at least $12,000 in cost savings to the government.

5. Estimated price, including all options, if applicable.

Period of Performance: September 5, 2024 - December 31, 2024

$100,000.00

6. Recommended source(s).
