About this file

This document summarizes a justification for other than full and open competition for a federal contract award. The Drug Enforcement Administration intends to award a sole source contract to Johnson Controls Federal Systems for additional security equipment and services to integrate with existing and newly installed surveillance systems at the DEA Headquarters building. The contract value is estimated at over $500,000 and will have a period of performance through July 30, 2021. Limited competition is being justified due to Johnson Controls' role in installing and maintaining the current security systems under warranty, which would be voided if installed by another contractor. Interested vendors have until June 29, 2020 to submit capability statements for consideration, however the award is anticipated to remain noncompetitive.

Revised 2/26/2019 2

The rationale for limited source justification and approval is based is because Johnson Control Federal Systems (JCI) is currently installing all systems at the DEA Headquarters building under the DEA renovation project. Futhermore the new systems will integrate directly with exisiting security systems which are maintained under a current maintenance agreement with JCI. The newly installed security systems are currently under a warranty with JCI. If a thrid party were to install any equipment as part of the security systems at DEA Headquarters it would void all systems warranties with JCI and maintenance for the effected systems and devices. To maintain a consistent level of service and the keep the security equipment covered, JCI must perform the work.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

N/A

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officers has dertermined the prices offered on this contract represent the best value to the Government.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Market research indicates the use of a third-party installer will void all warranties on new systems being installed under the renovation project and the exisiting security devices covered by the maintenance contract at DEA Headquarters.

9. Any other facts supporting the use of other than full and open competition, such as:

i. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.

The systems includes advanced artificial intelligence for captured and live video feeds. The software includes license plate recognition, face recognition, social distancing alerts, mask off alerts, contract tracing, heat maps for foot traffic and many other advanced surveillance research features.

ii. When 41 U.S.C. 3304(a)(1) is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.

The market research and IGE indicate the cost would be in excess of $500,000.00 dollars. Estimate was derived by the cost of the newly installed and existing security devices which are under warranty and the security devices currently covered by the current maintenance contract.

iii. When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.

Revised 2/26/2019 3

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The Office of Security Programs at DEA makes an ongoing effort to review product literature and other contracts, interview vendors and discuss security issues with industry experts in order to indentify and procure those security services and supplies that offer the best value to the Government.
