About this file
This document is a Justification & Approval for Other Than Full and Open Competition under Simplified Acquisitions for the replacement of the glass interior and video display in the elevator at the Washington Monument.
The key details are:
- The elevator has a glass interior and video display that provides commentary to visitors on their way down, and this project will replace the current glass and ensure the system operates properly.
- The work is estimated to cost $XXX,XXX.
- The justification for sole-source procurement is that the elevator is maintained by Delaware Elevator Company, who must be involved due to liability concerns, as other elevator companies will not work on each other's systems.
- Extensive market research was conducted, but no other vendors were found who could manufacture the specialized glass and install it, while also accepting government contracts.
- The National Park Service is the agency procuring the services, and the incumbent contractor is Delaware Elevator Company.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2500 for Construction/Services) AND
UP TO $250,000
(See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The Washington Monument elevator has a glass interior and a video display that provides commentary for those visitors riding the elevator. During programmed intervals on the way down, the elevator stops, and the glass will go clear while the video provides commentary on the plaques and stonework that is in the monument.
This project will replace the current glass inside the elevator, wire it up, and ensure that it operates properly for the presentations provided to visitors throughout the day almost every day of the year.
The work is estimated to cost
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
__X____ Other
Explain: The nature of the elevator industry is based on liability. Elevator companies do not work on elevators maintained or repaired by other elevator companies due to liability. The elevator at the Washington Monument is maintained by Delaware Elevator company and they recently were awarded a repair contract
The need is for Delaware Elevator to be involved in the contract to replace the glass in the elevator at the Washington Monument. Being they were the vendor that has been maintaining and repairing this elevator, they are the ones most familiar with it. Finding another vendor in this industry that will perform the work will be extremely difficult due to liability issues and elevator companies not working over each other.
With that being the case the Park provided the name of Delaware Elevator for the package so that the contractor awarded would reach out to them as they will need to secure the elevator as well as start it back up, ensure proper function and certify it for public use.

The Park performed a good deal of market research trying to find vendors who, one, manufactured the correct type of glass and could make the correct sizes to replace the glass in the Washington elevator; and two, perform the work. What we found were a few businesses that responded they could make the glass;
but in the end only one came out to look and answered that yes, they can manufacturer what was needed.
However, they do not accept government contracts nor sell their products. The company that we found that could make what is needed only sells through their distributors. Those distributors were contacted;
however, they do not install and/or do not have the ability to take a government contract. This led to the fact that we need a general contractor to sub out each piece needed to perform the work. With Delaware Elevator being needed to control the elevator for the work it makes this reasonable to sole source it to them as the general contractor who will gather the materials and labor required to perform the task.
The elevator industry is a small, very specialized industry, and the Park has little knowledge of what is needed when it comes to these machines. We rely on the vendors we deal with to provide the required services when it comes to maintenance, testing, and reporting. Having found that other elevator companies refuse to take up work where they are not doing it all, i.e. repairs to systems, maintenance, testing, and taking on the liability; we have had little in the way of success of getting a new IDIQ contract awarded for the last 4 years.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
The Park performed a good deal of market research trying to find vendors who, one, manufactured the correct type of glass and could make the correct sizes to replace the glass in the Washington elevator; and two, perform the work. What we found were a few businesses that responded they could make the glass;
but in the end only one came out to look and answered that yes, they can manufacturer what was needed.
However, they do not accept government contracts nor sell their products. The company that we found that could make what is needed only sells through their distributors. Those distributors were contacted;
however, they do not install and/or do not have the ability to take a government contract.
We were only able to acquire one quote for the actual materials in the end; from the only company that came out to the site. They however do not sell directly nor perform installations. All of the research revealed that we need a general contractor who will take care of the disparate parts of the work to accomplish the overall desired result.
