About this file

This document contains a Justification and Approval for Other than Full and Open Competition (JOFOC) and a related Special Notice of Intent to Sole Source Award. The JOFOC requests a sole source contract with Quantaero to provide continued technical support to maintain and upgrade the U.S. Fish and Wildlife Service Division of Migratory Bird Management's direct georeferencing aerial remote sensing systems, associated sensor and ground-based data management systems, and machine learning training data and model development support. Quantaero customized the aerial remote sensing system through proprietary software integration and owns the Aware software used to control customized camera systems. The term of service is from October 1, 2023 through September 30, 2024. The Special Notice allows interested parties to submit capability statements by August 15, 2023 to the contracting officer to argue competitive provision would be advantageous, but no costs will be reimbursed for responding.

Text3: Maintain and upgrade the Division of Migratory Bird Management's direct georeferencing aerial remote sensing systems and associated sensor and ground-based data management systems as well as to continue to provide machine learning training data and model development support.
Text4: Quantaero has customized a direct georeferencing aerial remote sensing system through theintegration of hardware and software solutions that is uniquely suited for the USFWS' natural resource applications. Quantaero maintains proprietary ownership of the Aware® software solution used to control the USFWS's customized camera systems including the SEABirD sensor arrays. Quantaero has subsequently developed the proprietary Expeditionary Intelligence Systems (ground data management systems) to support operational field data collection and processing workflows using USFWS' proprietary sensor systems and controllers within the Aware® software environment. Because of their in-depth knowledge of the present USFWS-owned direct georeferencing systems, and integration of associated sensors within the proprietary Aware® development environment, and previous successful development and deployment of the EIS systems, Quantaero is uniquely qualified to provide annual maintenance, technical support, and training and to develop and integrate machine learning training data and models that are compatible with Aware® and data processing hardware on-board USFWS aircraft. The term of service will be from October 1, 2023 through September 30, 2024.
Text5: The ability to conduct this requirement is unique to this entity. No other entities have proprietary access to the Aware® software solution used to control the USFWS's customized camera systems or to proprietary EIS systems previously developed for and supplied to the USFWS. A Notice of Intent will be posted on FedBizOpps for fifteen days to give interested vendors an opportunity to respond.
Text6: The contracting officer determines that the anticipated price/cost will be fair and reasonable based on prior acquisition history of previous similar purchases IAW FAR 15.404-1(b)(2) (ii).
Text7: Because of the proprietary nature of the Aware® software solution used to control the USFWS's customized camera systems and to integrate all components of the in-flight processing systems and EISs (ground data management systems) there is nothing that can be done to reduce barriers to competition in this instance. The USFWS operates 3 fully integrated direct georeferencing systems which can each support 4 different sensor configurations. The proprietary Aware® software solution developed by Quantaero is critical to direct georeferencing system and sensor systems integration as well as in ground data management and subsequent data analysis.
Text8: Because of the proprietary nature of the Aware® software solution used to control the USFWS's customized camera systems and to integrate all components of the in-flight processing systems and EISs (ground data management systems) using a different contractor would require complete re-engineering of the aerial remote sensing systems operated by the USFWS Division of Migratory Bird Management. Based on previous hardware acquisition and hardware/software integration contracts with Quantaero this would cost over 2 million dollars and there would be no guarantee that similar functionality would be provided. Any change in functionality of these systems would have downstream effects on the data generated and the now well developed processes for data management and data analysis.

Text10: Because of the proprietary nature of the Aware® software solution used to control the USFWS's customized camera systems and to integrate all components of the in-flight processing systems and EISs (ground data management systems) there is nothing that can be done to reduce barriers to competition in this instance.
Text2: Sole source contract requested for Quantaero for annual technical support to maintain and augment aerial remote sensing hardware and software developed for the USFWS/Division of Migratory Bird Management. The term of service will be from October 1, 2023 through September 30, 2024.
