JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2500 for Construction/Services AND UP

TO $150,000

(See FAR 13.106-1)

Date: March 8, 2018

PR Number: 0040381067

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Park Service at Channel Islands National Park (CHIS) has a 28 year old Alaska Crane Model 10-40T (Serial No: 644) at Park headquarters in Ventura, CA. On February 6, 2018, the crane developed a significant hydraulic leak and has been determined not fit for use due to the potential for oil to enter the waters of the harbor and the possibility of failure during use. The crane will need to be disassembled in order to properly assess the damage and make necessary repairs.

The anticipated cost is $28,000.

2. Sole Source Justification rationale (Check one and explain below):

☐ Only one responsible source.

☒ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

☐ Other _____________________________________________________

Explain:

The headquarters crane is the sole method for loading and unloading cargo and equipment onto park vessels. Due to the remote and unique nature of CHIS we rely heavily on boats to transport cargo and supplies to and from the islands. The crane is currently not operable due to a hydraulic cylinder failure and all cargo must be hand loaded onto the boats. This creates a potentially unsafe work environment for employees and completely eliminates the ability to move heavy cargo. The park is currently not able to haul cargo such as fuel/propane/dumpsters to and from the islands which inhibits day to day operations on the islands. The ability to quickly make the crane repair is essential to carrying out the park mission in a safe and efficient manner.

Impacts to government operations-

The NPS provides boat transportation to the Channel Islands twice weekly. This is to transport supplies and materials to and from the islands in order to support day-to-day park operations.

Weekly transportation also includes the transport of employees, contractors and volunteers/cooperators.

The crane at HQ is the ONLY means for loading and unloading heavy/bulky equipment and supplies on/off the boat.

Hand loading supplies is limited by weight and is inherently more dangerous for our employees as it requires going up/down stairs and stepping across a gap onto a moving boat.

The follow list of items are routinely handled by the crane and are currently not able to go out or come back from the islands:

(See FAR 13.106-1) o Dumpsters-there are currently full dumpsters on SRI waiting to be removed from the island. Full dumpsters left on island for extended periods of time become a nuisance and potential problem for attracting the island fox.

o Propane tanks used for heating o Water totes to Anacapa Island (the water tanks on AI are extremely low and in need of resupply) o Fuel totes to Santa Rosa Island

Additional negative impacts include-

Inability to move supplies for a contract currently underway on Santa Rosa Island. The NPS is currently providing transportation on Tuesdays for the contract employees; however, we are now no longer able to move supplies and materials for them potentially affecting the project timeline.

The park is engaged with a partnership on a project on Santa Cruz Island with the Santa Barbara County Office of Emergency Services. The park is responsible for transporting supplies and materials for this project. The project is currently on hold until the crane is operational and supplies can be delivered.

Inability to haul project supplies for Resource Management projects on Santa Cruz and Santa Rosa islands.

Inability to crane heavy dive gear onto the boat for Channel Islands Live Dive Programs. The result is extra time and increased risk of injury by having employees hand carry heavy and bulky dive gear onto the boat.

The Park has lost the ability to respond to emergency requests for large supplies to the island due to natural disasters (floods/fires) or failure of utility systems, etc. The probability is low of this happening but the severity could be very high in the event of an incident.

California State University Channel Islands used the park boat to haul supplies out to their field station on Santa Cruz Island. They are currently gearing up for the spring season and cannot supply the Field Station until the crane is operational.

It is estimated that the crane repairs could take up to two weeks to complete. This combined with the time needed to secure a competitive contact could result in an additional 4 weeks of down-time for the crane. While the park staff has done an admirable job of adjusting to the lack of a crane it is not sustainable and we are now entering the spring break season when there is more demand for park resources to be delivered by boat (and therefore crane).

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Market Research was performed and is attached. Results of the market research support the recommendation of a sole source acquisition due to the urgent need to make the crane repairs to resume normal park operations and duties in a safe and efficient manner. A preliminary estimate was received from local vendor Ventura Hydraulic Machine Service as a result of an inspection which confirmed the repairs would be over the micro-purchase threshold.
