About this file
This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for a firm fixed-price design-build contract to repair the Long Pond tide gate structure at the Humboldt Bay National Wildlife Refuge.
The justification cites unusual and compelling urgency as the basis for the sole-source procurement to WCE-McMillen JV, LLC. The tide gate structure has experienced seepage and water intrusion that could lead to failure of the levee, resulting in significant damage to refuge infrastructure, public trails, and a major highway. The repair is estimated at $2 million and must be completed by November 15th before the winter storm season. WCE-McMillen was selected due to their recent experience with similar tide gate and levee repair projects for the U.S. Fish and Wildlife Service. No additional market research was conducted given the urgency of the requirement. The contracting officer has determined the anticipated price will be fair and reasonable based on comparison to previous project costs.

| Text3: This is an unplanned urgent/emergency repair. IMD has been working with R8 on an ongoing issue with the Long Pond tide gate at Humboldt Bay NWR. Earlier this year seepage through the levee structure near the tide gate was observed. Maintenance crews, in coordination with IMD and the station, attempted repairs as soon as weather allowed. The repair effort was fairly extensive and showed that the water was possibly coming from beneath the structure. Every effort was made to repair the levee, but the water seepage through the structure persists. The only alternative to prevent failure is a full replacement of the tide gate structure and surrounding levee repair. Replacement is estimated at $2M. Repairs must be completed NLT 15 Nov to meet the weather window for construction. After Nov there is a risk of being unable to perform construction work on the levee due to king tides and conditions too wet for heavy equipment work. Failure of the structure would result in flooding damages to other FWS infrastructure (HQ building, etc.), public trails, a major highway (CA 101) and extensive freshwater habitat. |
| Text4: The need for an expedient, experienced design build team exists to meet the performance requirements of this request (See 4. above). |
WCE-McMillen is an experienced design build contractor that has the capacity to do this kind of work. They have completed work of same scope and magnitude in the last three years at the Don Edwards San Francisco Bay NWR. They are currently doing work at San Joaquin NWR. They have the expertise in levee and tide gate structure design and construction as well as permitting with the US Army Corps of Engineers.
This is going to be a fast tracked project in order to get the work completed before the next wave of storms and king tides hit the area. WCE-McMillen has a good past performance history with FWS, they can utilize design information from similar projects and have US Army Corps of Engineering connections that will be beneficial in getting the work accomplished in the time frame needed.
| Text5: None due to the unusual and compelling urgency of this repair. | |
| Text6: The contracting officer determines that the anticipated price/cost will be fair and reasonable based on comparison of proposed prices with prices obtained through market research for the same or similar items (previous tide gate structure and levee repair projects completed recently at Don Edwards/San Francisco Bay NWR.) These historical costs will be updated to reflect inflation and other construction industry cost trends as well as the expedited nature of this contract action. Refer to FAR price analysis techniques at FAR 15.404-1(b)(2)(vi). | |
| Text7: Past performance on similar size and scope projects was utilized to select a contractor that provides the government with a high probability of a successful outcome. Contact was made on June 25, 2024 with WCE-McMillen to ascertain their availability to perform the work in the time frame sought if the contract was sourced to them. All indications suggest they would be able to successfully accomplish the work. No additional market research was conducted. | |
| Text8: This is an emergent project due to unusual and compelling urgency due to signs of water coming through the water structure that could lead to further erosion and failure of the levee. Failure of the structure would result in flooding damages to other FWS infrastructure (HQ building, etc.), public trails, a major highway (CA 101) and extensive freshwater habitat. | |
| Text9: WCE-McMillen JV, LLC | |
| Text10: Not applicable due to unusual and compelling urgency as the basis for restricting competition. There is no known barrier to competition other than the interest in sole sourcing to expedite the start of this repair project quickly. | |
| Text2: Approval is being requested for new firm fixed price design build contract to repair the Long Pond tide gate structure at Humboldt NWR. The scope of this project will need to include all design, permitting, and construction activities. We are replacing the structure in-kind and anticipate design to be straight forward. We will want the contractor to proceed with construction once we have minimal design documents developed. Anticipated contract value is $2M. | |
