About this file

This document is a Justification for Other than Full and Open Competition (JOFOC) for a sole source contract award to Axon Enterprise, Inc. The U.S. Fish and Wildlife Service Division of Refuge Law Enforcement proposes to enter into a five-year fixed price contract with Axon for their Officer Safety Plan 7+ solution. This will provide approximately 250 officers with conducted energy weapons, Axon Body 3 cameras, Axon Evidence digital evidence management software and storage licensed for defined user roles and footage management, Axon Signal Sidearm, training, and warranties. The solution must meet FedRAMP, FBI CJIS, and DOI/FWS security standards for a cloud-based evidence storage system. Axon is the only company that offers an integrated solution with these components and certifications. The contract is estimated to save over $2.7 million compared to current regional expenditures over its five-year period.

Text3: DRLE intends to procure a CJIS/FedRamp certified, cloud based digital evidence management and storage solution for all body worn camera video footage, and associated meta-data, for every Federal Wildlife Officer Service-wide. The contract includes TASER 7 conducted energy weapons (to include holsters, cartridges, docking stations, batteries, training supplies, etc.), Axon Body 3 cameras, Axon Evidence (Evidence.com with licenses and storage with defined user roles and footage management systems), Axon Signal Sidearm, system training, and warranties for a period not to exceed five (5) years for approximately 250 officers. This solution shall be utilized nationally by all DRLE law enforcement personnel.
Text4: Axon Enterprise, Inc. is the only company that offers the Officer Safety Plan 7+, which includes Conducted Energy Weapons (CEW), Body Worn Cameras (BWC), and a Digital Evidence Management System (DEMS) for law enforcement Agencies.

The "Taser" is the only product approved by the Office of Law Enforcement and Security (OLES) for use within DOI law enforcement programs (see DOI, OLES policy 446 DM 22). Axon Enterprise, Inc. is the only company who manufactures a CEW under the product name "Taser." The Taser 7 model is manufactured and available for purchase solely through Axon Enterprise, Inc. (see attached Sole Source CEW ENG document).

Axon Enterprise, Inc. digital evidence management and storage is the sole solution meeting FedRamp, Federal Bureau of Investigation (FBI) Criminal Justice Information Systems (CJIS), and DOI and FWS IT-related security standards.

Axon Enterprise, Inc. is the only company who provides a cloud based digital evidence management and storage solution which is FedRAMP approved and certified for use by Federal Agencies (https://www.fedramp.gov). The Federal Risk and Authorization Management Program (FedRAMP) is a government-wide program that provides a standardized approach to security assessment, authorization, and continuous monitoring for cloud products and services. FedRAMP is mandatory for Federal Agency cloud deployments and service models at the low, moderate, and high-risk impact levels.

Axon Enterprise, Inc. was awarded a Sole Source contract by the U.S. Department of Agriculture, U.S. Forest Service in 2019 for substantially the same services and products. The U.S. Forest Service stated in their acquisition, “Axon Enterprise-branded body-worn cameras are the sole solution meeting FedRamp, CJIS, and FS CIO IT-related security standards.”

Axon Enterprise, Inc. was awarded a Sole Source contract by the U.S. Department of Justice, Executive Office for United States Attorneys for substantially the same services. DRLE routinely must share body camera footage with U.S. Attorneys for every criminal prosecution. The U.S Department of Justice stated in their acquisition, “FAR 8.405-6(b) - The items are peculiar to one manufacturer. The particular brand name, product, or feature is essential to the Government's requirements. Market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs. Numerous US Attorney Offices (USAOs) work with law enforcement entities that store video from body cams, dash cams, and interview room cams in Evidence.com. USAOs do not have the bandwidth, storage, and tools to download, store, manage, review, and redact the volume of video involved in USAO cases. USAO require access to Evidence.com in order to meet their mission requirements. Market research was conducted and indicates that purchasing USAO users accounts to Evidence.com is the only viable means of meeting mission requirements.”

Evidence.com is Axon’s “Software as a Service” solution.

Text5: The Bureau of Land Management (BLM) Office of Law Enforcement & Security and the National Park Service initiated a competitive solicitation effort in February 2020 in hopes of identifying and soliciting vendors capable of meeting the requirements for a Enterprise Digital Evidence Management System (DEMS) (Solicitation #: NPS IDIQ / SOL 140P3020R0002). A Technical Evaluation Panel, comprised of members from DOI Bureaus, reviewed all the submissions and determined only 1 vendor (Axon Enterprise, Inc.) could meet the technical needs of the DOI. This was based on multiple criteria, including, but not limited to, FedRAMP authorization and certification.
Text6: The price is fair and reasonable based on market research, including pricing information obtained from other agencies for similar products and services. DRLE has been using products and services provided by Axon Enterprise, Inc. for more than 10 years. DRLE has found through market research and use of alternative products that Axon products and services are superior and provide exceptional value for cost. A cost comparison was conducted looking at costs currently expended by each FWS DRLE region annually on body camera, digital evidence management and conducted electrical weapon products to include anticipated costs of product replacement and mandating each region meet FedRamp, DOI, and other statutory or policy requirements. This effort to combine services and products into one programmatic solution represents a substantial cost savings (approximately 2.7 million dollars over five years) to the FWS over the life of this contract.
Text7: Market research was conducted by DRLE staff both at Headquarters and in each of the 8 regions. It included internet searches, holding interagency meetings, attending law enforcement equipment expositions, and reading industry-standard literature, independent articles and studies. The research conducted included multiple companies who make Body Worn Cameras and Digital Evidence Management Solutions for law enforcement Use. Research including conversations with representatives from the companies and online demonstrations has been conducted on the following companies and solutions: Axon Enterprise, Inc., WatchGuard Video, Martel Digital Electronics, VieVu, Digital Ally, Wolfcom, L-3 Mobile Vision. In addition, regions have conducted field tests of the body worn cameras and associated storage systems from each of the above vendors. After technical evaluation, it was determined only one Axon could meet the government / DOI requirements for FedRamp, FBI Criminal Justice Information Systems (CJIS), DOI and FWS IT-related security standards.

Axon Enterprise, Inc. is also the only company who manufactures a Conducted Energy Weapon (CEW) under the product name “Taser.” This product is currently in use by DRLE Law Enforcement and no alternatives exist.

Text8: The President released Executive Order 14074 "Advancing Effective, Accountable Policing and Criminal Justice Practices To Enhance Public Trust and Public Safety", in May 2022. The new EO mandates that all federal law enforcement agencies wear and utilize body worn cameras. In addition, it mandates that the agencies develop policies that allow for the expedited public release of BWC video footage following a serious incident. In October, 2022 DOI released Departmental Manuel 446 Chapter 41 which states "Video footage must be uploaded to the designated storage platform; footage shall not solely be stored locally on computers, phones, or personal devices." The only company currently meets the requirements of the E.O., DOI Department Manuel, and is FedRamp certified is Axon Enterprise.

DRLE has been using body cameras for many years. However, currently there is no hardware standardization which leads to technology, training, and operational challenges. DRLE does not currently have a cloud evidence storage solution nor do we have the ability to create and maintain one with available agency resources. Digital evidence is being stored in a variety of methods such as hard drives, Digital Video Discs (DVD’s), USB Flash Drives, local servers, etc. In some cases, digital evidence is not being downloaded or retained at all in violation of federal mandates.

In addition, DRLE is already using certain products and services provided by Axon Enterprise which have been obtained through separate contracting efforts at considerable increased expense as compared to this contract proposal. DRLE stands to save considerable funds by acquiring a Service-wide digital evidence management system from a business who we are already working with. This new effort incorporates services and products into a full-service package which will reduce cost while adding required services and benefits.

Text9: Axon Enterprise, Inc.
Text10: The ability of the agency to consider alternatives to the proposed vendor is contingent on an increase in the number of companies in the marketplace meeting the needs of federal law enforcement agency's statutory and policy requirements. Specifically, a cloud based digital evidence management system meeting the Federal government's "FedRamp Authorized" certification at the Moderate or High impact level.
Text2: The Division of Refuge Law Enforcement (DRLE) proposes to enter into a sole source, fixed-price contract with Axon Enterprise Incorporated, using the simplified procedures for certain commercial items under Federal Acquisition Regulation (FAR) Part 13.5. Purchase of technical services, cloud based digital evidence software and digital evidence storage solution (Software as a Service – SaaS) as well as other law enforcement products and equipment, primarily conducted energy weapons. This contract is for Axon's "Officer Safety Plan 7+" with an initial base year and four subsequent option years (60 months).
