JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR Part 2) UP TO SAT (See FAR 13.106-1)

Date: 6/21/2022

PR Number: 40584705

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

This procurement is to replace a 4-ton, 3-phase commercial split HVAC System, including replacing the evaporative coil, condenser, air handler, and heat strips. This is an HVAC unit that serves one of NCPTT’s labs. The IGE for this purchase is [Redacted]

2. Sole Source Justification rationale (Check one and explain below):

Only one responsible source.
XUrgent and compelling circumstances exist. Include critical delivery or performance dates,

and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Other

Explain: We became aware of the failed HVAC system last week while people were trying to work in the lab and outside temperatures went above 100 on multiple days, so it was easty to recognize that the unit was not functioning. These 100 degree days are not typical for June but are more typical for July. When the temperature is that high outside it will leave the room temperature around 90 degrees in the high heat of the day. This is not a reasonable environment for people to work in and it may be deleterious to the experiments being run as well. For these reasons it is not prudent to treat this acquisition as a normal, non-emergency procedures. This acquisition is being solicited for a minimum 18 SEER cooling unit which only refers to the efficiency of the air conditioning system. This is higher than the national minimum standard, but make sense when one considers the dominance of the cooling system and the fact that climate change appears to be making the cooling season longer and more intense than they have been traditionally.

Another consideration is the fact that the Center will use this system for 15-20 years. Considering that length of use it makes sense to buy the most efficient air conditioning system that we can afford.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

_Market Research was done with the contracting officer to find 3 potential quoters. More market research was done to help with the IGE, but due to the emergency need a normal amount of market research hasn’t been done.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
