5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Penlink software is the tool of choice that supports DEA investigations. It is integrated with all of systems that support wire rooms as well. DEA has architectures and infrastructures built using the Penlink software. Penlink has highly optimized their software suite to support the DEA mission. It is integrated with many other investigative tools as well. Changing to another product line is would necessitate changes throughout our investigative process. The duplication of costs to integrate a new brand of software into the DEA processes is not anticipated to be recovered by increased competition or by introducing a different brand of software.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer, prior to award, shall determine the anticipated cost is fair and reasonable and will document the rational in the file.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

9. Any other facts supporting the use of other than full and open competition, such as:

i. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.

Penlink software is an embedded piece of DEA's investigative process. PLX has been optimized to support the DEA mission requirements. DEA built an infrastructure to support the DEA investigative mission and PLX is the software used to glean intelligence from the millions of toll and subscriber records received.

Changing to another product at this time would be disruptive and cost prohibitive.

ii. When 41 U.S.C. 3304(a)(1) is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.

iii. When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
