About this file

This is a Competition Restriction Justification (CRJ) for a simplified acquisition under FAR 12.102 for commercial products and services valued between the Simplified Acquisition Threshold (SAT) and $15 million.

The Drug Enforcement Administration's Office of Acquisition, on behalf of the Office of Forensic Sciences (SFL10), is seeking to procure five additional Intura H2 1500 hydrogen generators manufactured by Peak Scientific for use with newly purchased GC-MS and GC-FID equipment for evidence analysis to support enforcement cases. The estimated contract value is $137,000, and the requirement is identified as recurring. The justification cites 41 U.S.C. §1901 (simplified acquisition procedures) and GSAR 538.7104-4(b) (items peculiar to one manufacturer) as the authority for restricting competition to brand-name products. The contracting activity determined that the particular brand name and product are essential to the requiring activity's needs, and market research indicates other companies' similar products do not meet or cannot be modified to meet the stated requirements. Three potential sources have been identified: Samyak Solutions SBA (Certified Women-Owned Small Business with GSA Contract GS-07F-052BA), VTech Biomedical (22 Heritage Drive, Hampton, NH 03842-1017), and Peak Scientific Inc (210 Littleton Road, Suite 110, Westford, USA 01886), the Original Equipment Manufacturer. To maximize competition among authorized resellers and the OEM, an RFQ will be posted to SAM.gov. Fair and reasonable pricing will be determined based on adequate pricing competition and pricing from previous same/similar orders. The contracting officer is required to obtain signature approval for actions valued at $900,000 or less.
