About this file

This document is a Justification for Other Than Full and Open Competition for a sole source procurement under the simplified acquisition threshold of $250,000.

The Centers for Disease Control and Prevention (CDC) intends to award a sole source firm fixed price purchase order to RWLS LLC (Renegade Services) for 40-Arm Caliper Logging services. Renegade Services is the only vendor with the required knowledge, experience, and access rights to the project location to perform the work. The anticipated period of performance is May 28, 2024 to May 27, 2025. The justification cites FAR 13.106-1(b)(1) which allows for sole source awards under the simplified acquisition threshold when only one source is reasonably available. The key factors are Renegade Services' proximity to the site, their prior experience working with the CDC and the coal/gas industries in the local area, and their specialized training to work on the site while complying with the cooperating company's policies and regulations. The CDC conducted market research but did not identify any other vendors with the necessary qualifications and site access to meet the requirement.

JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)

UNDER $250,000

Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

b. Estimated Procurement Amount:

If yes, provide schedule number: N/A D. Justification:

Rev. 5/14/19

1. The justification for this non-competitive action is:

In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

Urgency

Exclusive licensing agreements/Proprietary data

Brand name required

Industrial mobilization

Other (e.g., compatibility, space issues, continuity, compatibility, unique and highly specialized capabilities/product features etc.)

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

Renegade Services is located within one hour from the project site, can be mobilized quickly and efficiently to perform the logging operations, had been contracted by the coal and gas industries as well as CDC/NIOSH/PMRD to perform similar tasks in 2021, 2022, and 2023 ( ), and has a track record of providing satisfactory services. This company is trained specifically to work on property owned by the cooperating corporation to comply with their rules and regulations and company policies that are established. Renegade Services is familiar with local regulations governing highway usages and dealing with local codes and township requirements for this area. Renegade Services is also familiar with environmental permit requirements for this area and the typical geological strata requiring them to make adequate adjustments in their logging procedures. Renegade has been trained to look for mining-induced deformations, while is interested only in casing corrosion, which is the typical concern of the oil and gas industry. is not interested in a small federal government technical research project.

b. What other products/services were considered and why did they not meet the need?

Other logging companies do not have many years of experience in the local area and have not been involved with local coal and gas production operations as well as CDC/NIOSH/PMRD. Working on mine site property requires specialized training that other companies have not been exposed to. This training and experience take multiple years to become educated to perform this work in compliance with local, state, federal regulations, and the cooperating company policies and standards.

3. Program Office efforts to seek potential offerors:

Market research revealed that other logging companies were specialized in oil well logging and their focus was primarily casing corrosion. The primary focus of this NIOSH/PMRD/MSSB logging effort is longwall-induced casing deformation and Renegade Services has been specifically educated and has worked with NIOSH researchers over the past 5 years.
