BRAND NAME JUSTIFICATION DOCUMENT

FEDERAL ACQUISITION REGULATION (FAR) 13.106-1(b)(1)(ii)

(1) Identification of the agency and the contracting activity.

Requiring Activity:

Defense Counterintelligence and Security Agency (DCSA) Program Executive Office (PEO) – Background Investigations (BI) Enterprise System PMO 601 10th Street Ft Meade Maryland, MD 20755

(2) Nature and/or description of the action being approved.

DCSA at Fort Meade plans to issue an order on the open market using FAR Part 13 procedures for thirty-two (32) ActivePDF toolkit and Webgrabber toolkit software licenses and maintenance support. The award will be a firm fixed price contract for one year (twelve months) period of performance from the date of award. The total estimated value is $XX,XXX.XX which is below the simplified acquisition threshold. Defense Working Capital Funds will be used to fund the order.

(3) A description of the supplies or services required to meet the agency’s needs.

(4) Identification of authority and demonstration of contractor’s unique qualifications.

(a) Authority:

This procurement is restricted to an item peculiar to one manufacturer in accordance with FAR 13.106- 1(b)(1)(ii). This justification is prepared in accordance with FAR 13.106-1(b)(1)(ii).

(b) Description of the Justification:

DCSA has a requirement for ActivePDF software license and maintenance support, which requires the purchase of the ActivePDF software license and maintenance support on a limited source basis from the manufacturer ActivePDF or an authorized reseller.

ActivePDF Toolkit and WebGrabber are the key component tools that provide functionality to convert images from Tag Image File Format (TIFF) format to Portable Document File (PDF) file. In the Office of Personnel Management (OPM), Personnel Investigations Processing System, Imaging System (OPIS) eDelivery process, the OPIS applications utilize these ActivePDF tools to prepare delivery packages.

Specifically, eDelivery and Electronic File Release (eFR) packaging services are using ActivePDF Toolkit to convert TIF image to PDF file and the converted images are delivered to all the agencies.

DCSA is unable to use any other software at this time because other vendor's software hasn't been thoroughly tested, vetted, and integrated to work with OPIS eDelivery applications. Changing out the software at this point would require significant coding changes which would disrupt the eDelivery services we provide to our customers. ActivePDF is utilized during the creation of the finalized case package. Agencies receive a PDF file with all of the case artifacts. These cases must be adjudicated and a response returned to DCSA within 30 days, in accordance with the Federal Investigative Standards.

Removing this product would create unacceptable delays in the case processing process, resulting in failure in meeting the Federal Investigative Standards.

The renewals of the ActivePDF maintenance and support is vital in order to provide support for continued functionality of the ActivePDF software and OPIS. Attempting to replace ActivePDF within OPIS would be cost prohibitive and cause major interruptions in eDelivery. ActivePDF is the sole manufacturer of the Active PDF licenses and owns all proprietary rights to it. No other vendor produces ActivePDF licenses or software.

(5) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will make a fair and reasonable cost or price determination by utilizing one or more of the procedures found in FAR 15.404-1.

(6) A description of the market research conducted among schedule holders.

Market research was conducted by contacting ActivePDF to determine what distributors provide Active PDF licenses to the federal Government. ActivePDF identified Redhawk IT Solutions and Essnova Solutions. Therefore this acquisition will be solicited on the open market using FAR Part 13 procedures.

As such, this acquisition will be a total small business set-aside under NAICS 511210.

(7) Any other facts supporting the justification.

No other facts support this document.

(8) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

PEO-BI regularly conducts market research, as well as partners and collaborates with other United States Government agencies to identify any additional products that may have the necessary capabilities to meet DCSA’s minimum requirements. No other products have been identified which meet PEO-BI’s minimum requirements. PEO-BI will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions to be competed.
