References: (a) National Defense Authorization Act, 02 September 2021, Procedures for the

Operation and Procurement of Unmanned Aircraft Systems to Implement

(b) National Defense Authorization Act, 08 September 2021, Deputy Secretary of

Defense Memorandum on Guidance for Procedures for the Operation and Procurement of UAS to Implement

(c) Exception to Policy Requirement for Blue Small Unmanned Aircraft System Memorandum, 13 October 2022

(d) Rescinding Enclosure (2) of the Section 848 Implementation Guidance, 28 July

1. The systems listed are identified on the Defense Innovation Unit (DIU) Blue cleared UAS list. Use of these systems do not require an Exemption to Policy (ETP) as described in reference (a) if used in accordance with the Authorization to Operate (ATO) issued by the DIU. An ETP for these systems will still be required if used in combat and non-combat (i.e., foreign humanitarian assistance and disaster relief) operations. These systems have gone through the DIU approval process to ensure they do not possess critical cyber vulnerabilities that would require the oversight outlined in references (b) and (c). See attachment.

2. Systems that are not on this list require an ETP. If the use of these systems is an enduring requirement, an ATO should be acquired using the Fast-Track ATO process through SAF/CNZR or a reciprocity agreement between services.

3. This memo supersedes the 31 January 2023 USAF sUAS Procurement and Operations List.
