FAR Part 13.106-1(b) Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S. Army Geospatial Center (AGC) Contracting Office

2. Description of Action: The Systems and Acquisition Support Directorate (SASD) at AGC is requesting a new Firm Fixed Price purchase order for software licensing of new Blue Marble Global Mapper and Global Mapper Light Detection and Ranging (LiDAR) licenses to be installed at the U.S. Army Corps of Engineers (USACE) Central Processing Center, in direct support of Civil Works. This software is a necessary purchase because it allows geospatial professionals to be more efficient in the creation of terrains and 3ds meshes for a variety of projects across USACE. Providing this software for USACE Districts in a centralized location will be more efficient in license usage and eliminate multiple districts placing credit card orders with Blue Marble. The Period of Performance is Date of Award through one year, with two, one-year option periods.

3. Description of Supplies/Services: The USACE has a requirement to purchase Global Mapper software licenses to process raster files. Global Mapper is a premier geospatial software that is primarily used within USACE for working with dense, large raster files such as LiDAR or imagery.

This software is capable of processing raster data at faster speeds than competitors such as Esri’s ArcMap or ArcPro because Esri’s main focus is processing vector files and geodatabases. Global Mapper renders raster files with less data lose (more detail granular details) compared to Esri products. This software allows for the modification and transformation of LiDAR files to multiple different file formats (ie geotiffs) this decreases the time required for data dissemination to other programs.

Total estimated value for the required software is $183,680.00. A list of the items to be purchased are shown in the table below.

# Description Qty 1 Global Mapper v21 Network License (40 seats) – Base Year 1

Global Mapper LiDAR Module v21 Network License addition (30 seats) – Base Year 1

3 Global Mapper v22 Network License (40 seats) – Option Year 1 1

Global Mapper LiDAR Module v22 Network License addition (30 seats) – Option Year 1 1

5 Global Mapper v23 Network License (40 seats) – Option Year 2 1

Global Mapper LiDAR Module v23 Network License addition (30 seats) – Option Year 2 1

4. Authority Cited: FAR 13.106-1(b)(1)(i), Soliciting from a single source

5. Reason for Authority Cited: FAR 13.106-1(b)(1)(i) -- Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

Blue Marble is the only source for Global Mapper.

6. Efforts to Obtain Competition: The Contracting Officer shall publish a combined synopsis/solicitation as required by FAR 5.201(b)(1)(i) and any quotes received shall be considered. Blue Marble Geographics is the sole manufacturer and supplier of Global Mapper software. The company does not allow any other vendors to resell its products.

There are no subcontracting opportunities that exist for this requirement, as Blue Marble Geographics does not authorize any other vendors to sell its products.

7. Actions to Increase Competition: In accordance with FAR 5.201(b)(1)(i) and FAR

12.603 for commercial items, AGC is posting a combined synopsis/solicitation to beta.sam.gov and will state in this posting that interested vendors may submit their capabilities and qualifications to perform the requirement in writing to the Contracting Officer. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the Government.

8. Market Research: In accordance with Army Federal Acquisition Regulation Supplement (AFARS) 5139.101, the Army’s Computer Hardware Enterprise Software and Solutions (CHESS) Indefinite Delivery/Indefinite Quantity (ID/IQ) contracts are the mandatory source for commercial information technology (IT) hardware and software purchases.

Research of the CHESS website revealed there were no contracting vehicles available with the required Global Mapper software and that a Statement of Non-Availability (SONA) and Information Technology Approval System (ITAS) waiver would need to be obtained prior to procuring through an alternate approach.

Based on the non-availability through CHESS, SONA Request 216757644 was obtained and approved for the software purchase on 13 April 2020 and the corresponding ITAS waiver approval was signed on 23 April 2020. SASD and AGC contracting conducted additional market research to determine additional sources by querying various internet websites and databases such as General Services Administration (GSA) Advantage and the Blue Marble corporate website. Market research was conducted from March 2020 through May 2020 through CHESS EIS.

Further, a special notice of intent to award to a single source was posted on beta.sam.gov to allow vendors to submit capability statements if they sold the software or felt that they had a comparable software. The Government did not receive any responses. For this reason, there are no other viable solutions at this time.

9. Other Facts: This is a new requirement with no purchase history at the AGC.
