About this file

This document is a justification and approval for using other than full and open competition to award a sole source contract. The Marine Corps Logistics Command intends to award a contract to Phillips Corporation Federal Division for an Omax Water Jet with options, accessories, and workstation. The estimated value of the contract is $800,000. The justification for the sole source award is that no other vendor can meet the tolerance and accuracy requirements of minimum linear positional accuracy of +/- 0.001 over the entire work envelope, minimum repeatability of +/- 0.001 over the entire work envelope, and a ball bar circularity of +/- 0.005. Omax Corporation is the original equipment manufacturer but does not sell directly to the public, with Phillips Corporation being the authorized exclusive dealer. The agency posted a sources sought notice but only received one other response that did not meet requirements. The contracting officer determined the anticipated cost to be fair and reasonable.

MARINE CORPS LOGISTICS COMMAND

814 RADFORD BOULEVARD

ALBANY, GEORGIA 31704-0301

ANNEX 1 – JUSTIFICATION AND APPROVAL

J&A No. 15015

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Marine Corps Logistics Command (M67004) Albany, Georgia

2. Description of the Action Being Approved.

Inclusion of a proprietary specification or standard in M67004-23-Q-0073 for a Omax Water Jet with options, accessories, and workstation. The Government intends to award a contract to Phillips Corporation Federal Division (PCFD) UEI: YFJ5M3N6EKY8, Cage:(3MPQ0), on a sole source basis, for a Omax Water Jet with options, accessories, and workstation.

3. Description of Supplies/Services.

Marine Depot Maintenance Command (MDMC) Production Plant Barstow, CA will utilize navy working capital funding for this requirement.

Estimated Dollar Value

Item Description Quantity Total Omax Water Jet with options, accessories and Workstation

Total $800K

4. Statutory Authority Permitting Other Than Full and Open Competition.

This document meets the regulatory requirement at 10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

It is in the Governments best interest to utilize a sole source purchase for the Omax Water Jet and accessories, because no other vender appears capable of holding a tolerance of minimum Linear Positional accuracy of +/- 0.001 over the entire work envelope, a minimum repeatability of +/- 0.001 over entire work envelope, and a Ball Bar circularity of +/- 0.005. PCFD is the only company that can offer a machine that will provide the desired rebuild work within the tolerances and accuracy for the work to be performed by the customer. The Original Equipment Manufacturer (OEM) is Omax Corporation, UEI: HH9YQK3L5N24, Cage: (1X7J7). However, Omax Corporation does not sell to the public. Phillips Corporation owns the proprietary data rights and is the only authorized exclusive dealer for the Omax machines.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The Government posted a Sources Sought, M67004-23-Q-0073 at the Government Point of Entry, SAM website on 5 July 2023 and only one other company came forward with a similar machine the Flow Water Jet System, but it did not meet the users’ specifications for tolerance and acceptable accuracy for the desired machine rebuild work. Considering only two replies were received from the sources sought, with only one meeting the requirements, additional research was not conducted.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, the MARCORLOGCOM has no plans at this time to compete future contracts for the supplies covered by this document. If another potential source emerges, the MARCORLOGCOM will assess whether competition for future requirements is feasible.
