4. Authority Cited:
(a) FAR 13.106-1(b) (1) (i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b) (1) (ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a) (1) (i) (A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a) (1) (i) (B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(c): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
(f) FAR 6.302-1: Only One Responsible Course and No Other Supplies or Services Will Satisfy Agency Requirements: 10 U.S.C. 2304 (c) (1).
5. Reason for Authority Cited: Womack Army Medical Center, as designated by the Army of the Surgeon General, is responsible for conducting residency and fellowship programs in order to train physicians in a variety of specialty programs in support of the Army’s mission. In order to conduct a residency or fellowship program, all of the programs must meet the accreditation standards and undergo a site review in order to be accredited through the ACGME. WAMC has existing residents in the Optometry Residency Program that have already been accredited by the ACOE. All Army Optometry residency programs are accredited by the ACOE. ACOE accreditation is only given by one source; American Optometric Association.
6. Actions to Increase Competition: If in the future other accreditation services become available, research will be performed to consider other products that meet or exceed the current training requirements. All reasonable resources were used to verify and confirm that this is the only sole source for this service. The ACOE is the only organization that evaluates and provides accreditation to physician residency and fellowship programs in the United States.
a. Effective competition. There is no effective competition since there is only one accrediting body for physician residencies in the military.
b. Subcontracting completion. The ACOE does not subcontract out work.
7. Market Survey: The Accreditation Council on Optometric Education is the only accrediting body for Optometry residency programs in the United States.
8. Procurement History: WAMC has historically paid the ACOE for accreditation services with a Government Purchase Card. In prior years, there was not a requirement to have a contract in place for these services. WAMC Optometry Residency Program submitted a DA Form 3953 and an invoice and the ACOE was paid for these services. In FY19, this process changed, now requiring a DA Form 3953 and a contracting package.
Previous Contract or Purchase Order Number: N/A Previously competed? N/A No Yes Previous authority for less than Full & Open Competition: NA
