3. Description of Supplies/Services: Womack Army Medical Center (WAMC) has a requirement to test and calibrate existing Bayer Equipment provide their technicians with accurate imaging in accordance with TB MED 750-1, paragraph 9-13.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization).
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item.
Controlled by: USAHCA CUI Category: SP-PROCURE Limited Dissemination Control: FED ONLY POC: Cynthia Rhone-Richardson (910) XXX-XXXX
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists and following the procedures would result in unacceptable delays.
(d) FAR 8.405-6(a)(1)(i)(B): Only one source can provide the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: Womack Army Medical Center (WAMC) has a requirement to test and calibrate existing equipment to provide accurate imaging as required in TB MED 750-1, paragraph 9-13. The maintenance is requested by WAMC for annual calibration services to perform services and repairs of all existing Injectors. According to the proprietary letter filed in PCF folder A.02, all calibrations and updates “shall be completed by Bayer authorized field service engineers” as WAMC Maintenance Technicians are not certified to provide maintenance or repair equipment.
Additionally, WAMC does not have the money to send technicians to a Bayer Trained School. If not approved, the hospital will not be able to perform multiple calibrations on existing equipment.
Currently, WAMC has imaging equipment located in Radiology, Magnetic Resonance Imaging, Computerized Topography, Cardiac Catheterization Lab procedures, Interventional Radiology studies and some in the Operating Room cases. If this action is not approved, this will impact the hospital’s ability to accept trauma cases which would downgrade the hospital to be a clinic level center. Bayer Healthcare LLC also provides updates, tests, and calibration that uses proprietary software. Bayer Healthcare does not authorize third party service providers except for authorized dealers. This contract will support any software upgrades as the sole source for this equipment.
6. Actions to Increase Competition: The solicitation will be synopsized and posted to SAM.gov to increase competition on future requirements. No further actions will be taken to increase competition for this requirement.
7. Market Survey: Market Research conducted in accordance with FAR Part 10. On 18 April 2023 and an on-line search was conducted on the Small Business Administration (SBA) Quick Market Research using NAICS 811210 (Electronic and Precision Equipment Repair and maintenance) Size Standard $34 million and key words “Test Contrast Injectors”. The results showed that there were small businesses under the General NAICS Code but not any small businesses that met the search criteria for the specific word search.
