1. CONTRACTING AGENCY: U.S. Army Engineer District, Alaska, Contracting Division, P.O.

Box 6898, JBER, Alaska 99506-6898.

2. DESCRIPTION OF ACTION: This is a justification and approval (J&A) for other than full and open competition to increase the capacity of an existing indefinite delivery architect-engineer (AE) contract for Geotechnical Design and related services, primarily various locations in Alaska, but also include Hawaii, Japan, Korea and other Pacific Rim areas. The contract has a current value of $4,750,000 for five years. This request is to increase the capacity by $750,000 to $ .

3. BACKGROUND: On 31 December 2012, the Alaska District advertised for a new indefinite delivery AE architectural design contract with the intent of awarding two contracts. One contract was awarded to (W911KB-17-D-0002) on 29 November 2016. To date has been awarded to The following task order is anticipated within the next 2 - 3

a. BAR008 Barrow Alaska Coastal Erosion, Value

4. DESCRIPTION OF SERVICES: The proposed contract action will provide continued support to the Alaska District for architectural geotechnical design and related services. Typical types of services include: Geotechnical Design and Engineering Services for Design Support. Design Support includes but is not limited to: geotechnical design recommendations, subsurface/field investigation, and reports/studies including design failure reports and forensic analysis of vertical/horizontal facilities, pavements and structures; safety inspection of existing facilities; field and laboratory testing of soil, rock, groundwater, and various construction materials; groundwater studies; material source evaluations; and environmental site investigations involving hazardous, toxic, or radiological waste (HTRW). The A-E may also be required to provide geotechnical analyses and recommendations IAW CLIN 0001 Description.

5. AUTHORITY CITED: Other than Full and Open Competition is authorized pursuant to:

an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

6. REASON FOR AUTHORITY CITED: The referenced contract to has only of remaining capacity. This will not be adequate for the task order that the Alaska District expects to award in the next 2 to 3 months. Another IDIQ AE Geotechnical Design SATOC was awarded to on 29 November 2016. If the anticipated task order was to be put on planned to be on that contract. A new IDIQ AE Geotechnical Design SATOC contract has been advertised, but the award is not anticipated until September-October 2021, which is too late to meet the proposals was problematic, and the AE selection process had to be managed electronically and it was necessary for these processes to be re-conceived. This situation has greatly delayed the expected award of the new AE contract.

Control No. FY21-14 each project within the summer/early fall season in Alaska due to the nature of the work (geotechnical site investigation). The future task order will provide geotechnical drilling, sampling, laboratory testing, and a Geotechnical Design Summary Report in support of a geotechnical site investigation for the Barrow Alaska Coastal Erosion project located in Utqiagvik, Alaska. Utqiagvik experiences frequent and severe design efforts by the Alaska District will be delayed for the approximately 25,000 linear feet of armor rock revetment along the northern shore of Utqiagvik to mitigate further coastal erosion. Failure to award this future task order this FY is not optional, and failure to provide the timely approval of extended

b. The District will rely heavily upon our Architect/Engineering consultants and design/ build acquisition strategies to support the development of the design for the approximately 25,000 linear feet of armor rock revetment along the norther shore of Utqiagvik.

c. The referenced contract to Golder Associates Inc. is nearly at capacity and will be exceeded with the next task order award with BAR008 Barrow Alaska Coastal Erosion, Value contract for this project nor is it possible to wait for the new indefinite delivery contracts to be awarded and still meet the dates for successfully meeting the required schedule of the customer.

7. EFFORTS TO OBTAIN COMPETITION: The Alaska District is in the process of establishing replacement IDIQ AE Geotechnical Design contracts which will be procured in accordance with the Brooks Act as outlined in paragraphs 8 and 9 below.

8. ACTIONS TO INCREASE COMPETITION: The Alaska District advertised on the beta.SAM website for two new indefinite delivery Geotechnical Design and Related Engineering Services Single Award Task Order Contract (SATOC). The award is anticipated for September/October 2021.

9. MARKET SURVEY: Market research for the new IDIQ AE Geotechnical Design contracts was accomplished via sources sought notice responses on 29 November 2019. Based on the interested firms that responded to the sources sought notice, the new IDIQ AE Geotechnical Design contracts cannot be set-aside for a small business program.

10. INTERESTED SOURCES: N/a.

11. OTHER FACTORS: N/a.

12. FAIR AND REASONABLE COST DETERMINATION: Total cumulative contract action amount will not exceed $750,000.
