BRAND NAME DETERMINATION
Far Subpart 13.106-1(b) and FAR 11.105(a)(1)
1. CONTRACTING AGENCY: The U.S. Army Corps of Engineers, Walla Walla District, (CENWW- CT) 201 North 3rd, Walla Walla, WA 99362.
2. DESCRIPTION OF THE ACTION: The U.S. Army Corps of Engineers, Walla Walla District has a requirement for the purchase of fourteen (14) Brand Name Nelson Irrigation Big Gun Sprinklers. The Nelson Big Gun Sprinklers will be in use at the Ice Harbor Project Habitat Management Units (HMUs), Ice Harbor Project, Tri Rivers Natural Resources.
3. DESCRIPTION OF THE SUPPLIES: Approval is being requested for a new firm-fixed-price, brand name requirement for the procurement of Nelson Irrigation big gun sprinklers, Model F100-24xQC with a .75 100T nozzle equipped with a Nelson quick connect (QC) key with upper line pilot assembly.
The estimated cost of this procurement is $19,175.24, below the simplified acquisition threshold.
4. AUTHORITY CITED:
FAR 13.106-1 (b), Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
FAR 11.105(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Governments’ requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s need.
5. REASON FOR AUTHORITY CITED:
a. JUSTIFICATION: Ice Harbor Dam recently took on the Operation and Maintenance of three (3) irrigated HMU’S that were formerly under contract for the past thirty (30) years.
It was discovered that there are over 1200 sprinkler risers with the Nelson (QC) valves on all the risers. The QC Key produced by Nelson Irrigation is the only mechanism that matches up to the QC valve., and the risers will take no other mechanism to hook the sprinkler up to the irrigation water. The Nelson Irrigation sprinklers, F100-24xQC, are not interchangeable with other brand products and are essential to the Government’s requirements. Market research indicates other companies’ similar products, or products lacking the feature, do not meet, and cannot be modified to meet, the agency’s needs. It is not possible to add other brands to the Nelson QC valve on the irrigation risers, the equipment must be Nelson QC equipment. Nelson QC valves are designed to be compatible with the Nelson QC Key.
b. IMPACT: Alternative sprinklers are not interchangeable with the current irrigation system and will cause the current system to shut down. If alternate sprinklers are purchased, the entire irrigation system will need to be replaced using the new manufacturers complete system. If the irrigation system is shut down it will cause USACE to violate our part of the agreement in the Snake River Comprehensive plan failing to provide suitable habitat for wildlife.

c. ALTERNATIVES: The Government is unable to purchase brands that are equal to the requested brand due to the incompatibility issues with Nelson QC equipment. If Ice Harbor cannot purchase the Nelson Irrigation sprinklers, F100-24xQC, and another manufacturer’s product is purchased, existing equipment will cease to function. New equipment will need to be purchased to be compatible with the new sprinklers. Valuable time needed to maintain the HMUs and funding will be wasted while installation of new equipment takes place.
6. DETERMINATION OF FAIR AND REASONABLE COSTS: Price competition is expected. A price analysis will be completed after receipt of quotes. No award will be made unless prices are determined fair and reasonable. Fair and reasonable cost will be evaluated at time of award.
7. EFFORTS TO OBTAIN COMPETITION: Nelson Irrigation was contacted, they identified vendors that carry their equipment, and three (3) vendors were contacted for quotes and all are attached.
8. MARKET RESEARCH: Preliminary market research has identified three (3) small business vendors who are able to provide the requested Nelson F100-24xQC sprinklers.
9. OTHER SUPPORTING FACTS: N/A
10. INTERESTED SOURCES: Irrigation Specialists, Isaacs and Associates, Lad Irrigation Company.
11. ACTIONS TO INCREASE COMPETITION: None. See paragraph 7.
12. TECHNICAL CERTIFICATION: I certify that the information supporting this Brand Name Determination is accurate and complete to the best of my knowledge based on the supporting data provided by technical or requirements personnel and my research.
