JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Task Order RFP No. 9P3PSDC150047

“Redesign 5th Floor Chambers,” Lloyd D. George US Courthouse, Las Vegas, Nevada

1. Agency and the Contracting Activity: GSA, Acquisition Management Division, San Diego (9PQ2SD)

2. Nature and/or description of the action being approved: Sole source award of “Redesign 5th Floor Chambers,” Lloyd D. George US Courthouse, Las Vegas, Nevada to The Architecture Company.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value): The requirement is for Architect-Engineer services to modify existing and completed construction documents to show one (1) Sr. Judges Chamber, create a common hallway, relocate the staff restroom, and to provide an Option for Post Construction Contract Services (PCCS) and Record Documents. The total estimated amount of the project is $ .

4. Statutory authority permitting other than full and open competition: FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 3304(a)(1).

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

a. The Architecture Company (TAC) completed Construction Documents in September of 2013 for the construction of two (2) Sr. Judges Chambers on the fifth floor of the Lloyd D George US Courthouse. The USDC has elected to downsize and wants to construct only one (1) Sr. Judges Chamber on the fifth floor. To incorporate this redesign, a modification of the construction documents is necessary. Additionally, the task order for the original design included PCCS and Record Document options. The task order and the base IDIQ contract under which it was issued have both expired and therefore the Government has a requirement for these services as well.

b. TAC completed the original design and therefore has unique capabilities to incorporate changes to the design and maintain design continuity. Additionally, under FAR 52.236-23, AE firms are responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and under FAR 52.236-23 and FAR 36.609-2, an AE firm is responsible to make any corrections at no cost to the Government whenever any errors, deficiencies, or inadequacies are found. In order to maintain a clear line of responsibility for the design, the same firm that created the original design should be used for the redesign.

c. The agency’s requirement can only be satisfied by TAC based on TAC’s capability to maintain design continuity and TAC, as the original designer, is the only firm in the position to maintain a clear line of responsibility for the design.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: Per FAR 5.201(b)(1)(i), a synopsis of the proposed contract action is not required to be posted to FBO because the estimated amount of this requirement does not meet the threshold in 5.101(a)(1). However, a notice of the solicitation for this requirement will be posted in a public place in accordance with 5.101(a)(2).

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: Once a proposal is received by GSA for this work, it will be reviewed and compared to an
