Worker Safety Contractor shall comply with all applicable safety and worker protection ordinances, rules, and regulations, the following practices and any Owner directive or instruction concerning worker protection or safety practices. Owner may suspend Contractor's or its subcontractor's performance of the work for failure to comply with any applicable worker protection or safety ordinance, rule, or regulation, for failing to implement and adhere to the following practices or for failing to obey Owner's directive or instruction concerning worker protection or safety practices.

Construction Site Worker Protection Issues

Trenches / Excavations

• Trenches greater than 5 feet need either shoring, shielding or sloping (depending upon soil type A, B, or C).

• Trenches greater than 4 feet deep need a ladder or stairway for every 25' of length.

• Spoils, tools and equipment shall be at least 2 feet away from trench edge.

• Trenches shall be inspected daily by a competent person and inspections shall be documented with date, time and competent person's signature.

Fall Protection

• Fall protection needs to be in-place for workers working on elevated surfaces above 6 feet.

• There are three types of fall protection (for contractors) to choose from: Personal PPE (harness/lanyard/anchor point), safety nets, or guardrails.

• Safety nets and PPE for fall-protection shall be checked prior to use on a daily basis; Inspections shall be documented with date, time and competent person's signature.

• Standard guardrails are 4 feet high with a mid-rail and toe-board.

Scaffolds

• Scaffolds shall have fall-protection for heights greater than six feet (which typically means guardrails around three open sides (w/ mid-rails & toe-boards).

• Scaffolds need to be "fully-planked" with board extensions of 6" across pipes at a minimum.

• Scaffolds shall be inspected daily by a competent worker; Inspections shall be documented with date, time and competent person's signature.

Ladders

• Ladders must have a 4 to 1 ratio for pitch (wall to base).

• Ladders must extend 3 feet above "targeted surface".

• Fixed ladders extending upwards of 20 feet require fall-protection in the form of cages or harness w/ "post-up" pole, to a maximum of 30' (they then would need a platform or landing surface).

Electrical Work

• All power tools and (electrical) extension cords shall be equipped with GFCI protection

• Contractor shall provide its employees with flame retardant clothing (FRC) when working on live parts is anticipated

• Contractor shall comply with the requirements of NFPA 70E, the "Standard for Electrical Safety in the Workplace", where applicable

• Contractor shall comply with the SCWA "Energy Control Program", specifically Appendix D, which is entitled "Contractor Electrical Work", included with this contract document:

Suffolk County Water Authority Appendix D – Contractor Electrical Work

• Contractor will be aware at bid proposal and certainly in our contract verbiage that SCWA has an "Energy Control Program"

• Contractor will be required to follow our procedure:

o PC employee (or authorized individual, meaning Electrical Engineer having received approval from PC) will be sent to a pump station for electrical shut-down o PC employee will apply zip-ties to energy control devices and a "tag" stating that the _________ is shut-down for contractor work or the Electrical Engineer will simply de-energize and apply the (purple) Engineering lock and accompanying tag communicating actions.

o Engineering will meet the contractor at project start-up and apply the (purple) Engineering locks and tags to the energy control device(s) (replacing the zip-ties, if initiated by a PC employee) and provide keys to the contractor o Contractor will follow 1910.147(f)(1) while testing and/or trouble-shooting, followed by the re-application of locks and tags after testing is completed o Contractor will not leave the pump station (each day while project continues) without ensuring that locks are applied where warranted and (communicative) tags are in-place to advise/inform SCWA PC personnel on "status" (can't leave ambiguity, especially with electrical equipment and current) o Engineering will meet with contractor at projects end to Verify work completed Remove/collect locks and tags

• Additionally, whenever projects involving contractors/Engineering are either lengthy in "scope of anticipated work" or will directly involve CM or PC employees at some juncture, Engineering will first apply a locking "hasp" that will allow for individuals/departments to apply their lock to the hasp when they are working on the equipment/piping connected to the project. When their work is completed (CM/PC) they will simply remove their lock from the hasp.

Engineering's hasp and lock will be removed last, only after project is completed and all locks from other parties are removed as well. Nobody shall remove another party's lock without obtaining authorization.

Permit-Required Confined Space Work

• All confined spaces (as per the OSHA definition) owned and operated by SCWA shall be treated by the Contractor (or Subcontractor as applicable) as "permit-required" confined spaces due to the potential for oxygen deficiency and/or the presence of a flammable gas, and as such should be tested by the Contractor (or Subcontractor as applicable) prior to entry with a dual-gas instrument (%oxygen and %LEL). Examples of these spaces are well vaults, meter vaults, Venturi and altitude pits.

• Additionally, pipe galleries that have chemical injectors for sodium hypochlorite shall be tested by the Contractor (or Subcontractor as applicable) for the presence of chlorine gas prior to entering.

• SCWA requires its employees to eliminate all hazards prior to entering its confined spaces using the OSHA approved re-classification process.

• Any hazards or problems encountered during contractor project work in SCWA confined spaces should be reported to SCWA.

There shall be paid to each employee engaged in work on this project, in the trade or occupation listed on pages attached hereto, not less than the wage rate, including supplements for welfare, pension, vacation and other benefits, set opposite the same.

IRAN DIVESTMENT ACT

As a result of the Iran Divestment Act of 2012 (Act), Chapter 1 of the 2012 Laws of New York, a new provision has been added to the State Finance Law (SFL), § 165-a, effective April 12, 2012. Under the Act, the Commissioner of the Office of General Services (OGS) will be developing a list (prohibited entities list) of “persons” who are engaged in "investment activities in Iran" (both are defined terms in the law). Pursuant to SFL § 165-a(3)(b), the initial list is expected to be issued no later than 120 days after the Act’s effective date, at which time it will be posted on the OGS website.

By entering into this Contract, Contractor (or any assignee) certifies that once the prohibited entities list is posted on the OGS website, it will not utilize on such Contract any subcontractor that is identified on the prohibited entities list.

Additionally, Contractor agrees that after the list is posted on the OGS website, should it seek to renew or extend the Contract, it will be required to certify at the time the Contract is renewed or extended that it is not included on the prohibited entities list.

Contractor also agrees that any proposed Assignee of the Contract will be required to certify that it is not on the prohibited entities list before SCWA may approve a request for Assignment of Contract

During the term of the Contract, should SCWA receive information that a person is in violation of the above-referenced certification, SCWA will offer the person an opportunity to respond. If the person fails to demonstrate that it has ceased its engagement in the investment which is in violation of the Act within 90 days after the determination of such violation, then SCWA shall take such action as may be appropriate including, but not limited to, imposing sanctions, seeking compliance, recovering damages, or declaring the Contractor in default.

SCWA reserves the right to reject any request for assignment for an entity that appears on the prohibited entities list prior to the award of a contract, and to pursue a responsibility review with respect to any entity that is awarded a contract and appears on the prohibited entities list after contract award.
