Justification for Other than Full and Open Competition Simplified Acquisition Threshold

1. Vessel: CGC BERTHOLF

2. PR# 858P45466

3. Description of Supplies or Services:

Tech Rep for inspection and overhaul of #1 and #2 Reverse osmosis

4. Estimated Value of Procurement:

5. Sources Available:

Name: Lifestream Watersystems Inc.

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

Check the appropriate reason below:

_X_ Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or Brand Name Mandatory

_X__Unusual & Compelling Urgency
___Exclusive Licensing Agreements
___Industrial Mobilization/Standardization

7. Impact Statement (describe the impact on the mission or property)

CGC BERTHOLFcurrently has a severly degraded Reverse Osmosis which does not meet operating standards for patrol. System has severe operating malfunctions and leaks, which are also causing severe corrosion of the system and surrounding supports. BERTHOLF is unable to sail without functional R/Os and in current configuration is not mission capable due to inability to operate potable water system (a safe to sail item). BERTHOLF inability to get u/w on scheduled date would cause them to miss nessessary reactivation trials and leave a gap in coverage in AOR.

8. Explain why an adequate purchase description or other information suitable to solicit by Full and Open Competition has not been developed or are not suitable.

Lifestream Inc. is the OEM of WMSL’s Reverse Osmosis and are the only experienced and qualified technical representatives/service engineers of Lifestream systems. Their proprietary knowledge of the system is critical for service and repairs, any third party vendors would require Lifestream as subcontractor to affect repairs.

9. Provide a Statement of Actions, if any, the government may take to remove or overcome any barriers to competition before future acquisitions are required.

The Coast Guard will continue to try and obtain the proprietary data to solicit other vendors to meet the needs of the Coast Guard as well as looking at other systems that would open up competition to other vendors. The Coast Guard will also look into having their Machinery Technicians/Ship’s Force trained in order to complete repairs organically
