SIMPLIFIED ACQUISITION PROCEDURES (SAP)
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE
CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE
SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT'S REQUIREMENT.
STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE
TO SUPPORT A SOLE SOURCE PURCHASE. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
PURCHASE REQUEST OR
REQUISITION NUMBER
2019087-HE02
PROJECT/TASK NUMBER
N/A
ESTIMATED AMOUNT (Over Micro-Purchase Threshold, but up to the Simplified Acquisition
Threshold)
$240,820
BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
The Department of Homeland Security (DHS), United States Coast Guard (USCG), Aviation Logistics Center (ALC), Long Range
Surveillance (LRS) Product Line Division (PLD), Elizabeth City, NC proposes to issue one (1) purchase order on a limited sources basis and provides this J&A for review and approval. The statutory authority permitting other than full and open competition is 10
USC 2301(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This J&A requests approval to award, on a limited source basis, one order for overhaul of HC-130 Hydraulic Boost
Assemblies as specified by the attached procurement request.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR
SERVICES CAN BE USED:
The Hydraulic Boost Assemblies are Flight Critical Safety Items (CSI) and LRS Engineering has determined that in order to ensure safety of flight, overhaul functions must be overhauled IAW specific Air Force Technical Orders (AFTO) which require the use of test jigs manufactured and/or certified by either the Original Equipment Manufacturer (OEM) or the US Air Force (USAF). The test jigs are referenced in the AFTO by OEM part numbers and no other jig is approved for use. The only sources in possession of the required test jigs are Tactair Fluid Controls, the OEM and Frazier Aviation.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:
As stated above, specific test jigs are required for use by the applicable technical directives and market research reveals that only
Tactair Fluid Controls, a large business and Frazier Aviation, a small business possess the required test jigs. These specific jigs are required to ensure the boost assemblies test satisfactorily in accordance with the applicable technical directives, thus ensuring the boost assemblies function properly in flight. The use of any other jig would require extensive oversight and duplication of costs on the USCG and would likely require the use of RFI assets, which are chronically in short supply. Additionally, the USAF is the configuration design authority for the C-130 program for all military users and is the only source other than the OEM with the authority to certify any “equivalent” test jig.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND
OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE:
The test jigs required for use are specified by OEM part numbers in the applicable AFTOs and the OEM is the only source capable of providing an OEM certification. Additionally, as the CDA, the USAF is the only other source with the vested authority to certify
“equivalent” test jigs through their own rigorous testing process. The USCG does not have the data necessary to assist interested parties with OEM certification and does not have the authority to certify “equivalent” jigs.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS
TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:
The Coast Guard does not have the required data or drawings not the authority to overcome the limited sources barrier to foster competition.
