Justification for Other Than Full and Open Competition
Under 10 U.S.C. 2304 (c)(1)
Only One Responsible Source and No Other Supplies or Services Will Satisfy
Agency Requirements
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by
FAR 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security, United States Coast Guard (USCG), Aviation Logistics
Center, Business Operations Division (BOD), proposes to enter into a modification to extend services on Purchase Order 70Z03818PS0000056 on a basis other than full and open competition.
(2) Nature and/or description of the action being approved.
The USCG, ALC, BOD has a requirement to extend the current purchase order for four (4) months. This purchase order is a sole source firm fixed price bridge for the procurement of
Business Operations Professional Support Services in order to maintain continuity of operations of providing the capabilities to support real time business analytics, ALC business model growth, and ALC’s International standards growth. The estimated cost is $651,000.00.
The task order, HSCG23-12-D-ATB002/HSCG38-15-J-410004, expired on 16 June 2018. A protest was issued against the following on task order number 70Z03818FS0000030 for BOD
Professional Services. Therefore, the Government determined it was necessary issue a sole source purchase order based on a logical follow on for the existing services. Therefore, Purchase
Order 70Z03818PS0000056 was awarded to continue the services until the anticipated completion of the protest. The Purchase order expires on 16 January 2019 and the protest has not been finalized. Therefore, it is necessary to extend the purchase order four (4) months.
The proposed source is:
BayFirst Solutions, LLC
6856 Eastern Ave., NW Suite 100
Washington, DC 20012

(4) Identification of the justification and the rationale.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by the FAR 6.302-1 entitled “Only One Responsible Source and No Other
Supplies or Services will Satisfy Agency Requirements.” BayFirst Solutions, LLC is the current provider of these services and in the interest of economy and efficiency, is the only company who can fulfill these requirements without degraded performance for the required short term effort.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
This requirement is to bridge services for BOD Professional Services at the USCG ALC BOD.
The services within the BOD play a vital role to the ALC, by driving ALC’s business decisions through strategic alliances, process planning, data analysis and compliance with quality and environmental international standards. These systems enable our organization to develop and implement policy, objectives and processes that address and fulfill customer requirements while maintaining strict adherence to all legal requirements. These services also allow ALC BOD to manage the business process change driven by CG-LIMS implementation while sustaining ALC quality and environmental management system.
Solicitation 70Z03818RS0000001 was issued on 06 March 2018; and closed on 05 April 2018.
Adequate competition was received and fair opportunity consideration selection has commenced.
Award was made, however a protest was received. The protest is still ongoing. The final resolution is being hampered by a lack of personnel resources due to the Government shut down.
This modification is deemed necessary to allow time to complete the protest and it represents the most advantageous offer to the Government.
The incumbent contractor, BayFirst Solutions, LLC, has proven its ability to provide quality services, sustaining stability of support and consistency in the services currently being provided to the BOD. They have been performing these services since September 2015. BayFirst
Solutions, LLC is the only contractor that is able to perform these services at this time.
The Contracting Officer has determined that issuing the proposed modification to BayFirst
Solutions, LLC to continue these services represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government’s needs. Prior to issuance of the modification, the Contracting Officer will consider the level of effort and the mix of labor proposed to perform the specific task being ordered, and for determining that the total price is reasonable
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.
In accordance with FAR Part 5.2, a notice of intent will be posted on the government-wide point of entry (GPE) website, www.fbo.gov, upon approval of this document. Any eligible contractor may submit a quotation. All responsible contractors will be considered, however, in the interest of economy and efficiency, the incumbent, BayFirst Solutions, LLC, is the only source that can provide these continued services.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The Contracting Officer anticipates incumbent prices to be consistent with current pricing. Prices were determined to be fair and reasonable based on the last option period pricing of under Task
Order HSCG38-15-J-410004, which expired on 6/16/18.
(8) Description of market research.
A task order with a five year period of performance is currently in the award process for the continuation of these services. The follow-on task order will be competitively awarded utilizing the Department of Homeland Security’s (DHS) General Services Administration (GSA)’s One
Acquisition Solution for Integrated Services (OASIS) contract. In the interim, this purchase order modification will allow for the continuation of these services.

(9) Any other facts supporting the use of other than full and open competition.
Other than Full and Open Competition applies only to the bridge. The future requirement was solicited utilizing full and open competition procedures. It is anticipated that GAO’s recommendation will be enacted so that award will be made by 16 April 2019.
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
In accordance with FAR 6.302-1(d), the Government will consider all capability statements, quotes and proposals submitted in response to the FedBizOpps notice, should any responses be received. However, it is unlikely that any other sources would have successful performance based on the nature, scope and complexity of this work, as well as the aggressive phase-in timeframe for this this short fuse effort.
(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.
The Government will award a modification to BayFirst Solutions, LLC for four (4) months, to begin 17 January 2019 through 16 April 2019. This Purchase Order is only in effect until the new
Task Order is awarded under Solicitation Number 70Z03818RS0000001, which is currently closed and under review.
