(7) Any other facts supporting the justification.

APMS uses a specific software suite, SAS enterprise BI v9.4, and is in an operating and maintenance phase. If the SAS software licenses are not procured, the system they are supporting will cease to function, as the requiring activity will be unable to address future patches and cybersecurity requirements from the USCG. To procure an entirely new software for the system would require starting from the beginning of procurement and would take years to get back to the operating and maintenance phase the system is currently in. During those intervening years, the users of the current system employing SAS software would have no other system to turn to for their reporting needs.

(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.

The requirement for a BI and Performance Management system was initially competed and SAS software was selected as the basis of the APMS system due to its lower total ownership costs.

The APMS is now in an operating and maintenance phase and annual software licenses renewals are necessary in order to maintain the system. Previously, this requirement for SAS software was to be combined with a requirement for support services for the APMS. However, market research was conducted and it was determined that there may be other contractors capable of providing the support services for the APMS. As a result, the support services will be competed and not sole sourced to EIS.

In accordance with FAR 8.405-6(a)(2)(i), a notice will be published in accordance with FAR

5.301 and this Limited Sources Justification will be posted at the GPE http://www.fedbizopps.gov for a minimum of 30 days. Any responses to the Limited Sources Justification will be noted and taken into consideration for future procurements. Market research will continue to be conducted for subsequent actions to determine if additional contractors are capable of providing SAS software or if there are better BI and Performance Management system software available in the market.
