ADDENDUM TO 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Proposal Submission:

Submit one original electronic version of the proposal to: Sara.Riordan@uscis.dhs.gov and

Nacole.R.Greenwood@uscis.dhs.gov.

The proposal shall be received by 10:00 AM ET, Friday June 29, 2018.

Offerors must provide responses to all of the highlighted areas below and provide with their submission.

An offer not complying with these instructions may be rejected at the Contracting Officer’s discretion.

One document shall be submitted with the following factors for evaluation:

FAR 52.212-2 Evaluation – Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Price

(ii) Technical Acceptability

(iii) Past Performance http://www.acquisition.gov/far http://farsite.hill.af.mil/vffara.htm mailto:Sara.Riordan@uscis.dhs.gov

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Basis of Award / Evaluation of Offers:

USCIS intends to award a task order, in accordance the Lowest Price Technically Acceptable

(LPTA) source selection process. Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price. Technical acceptability is comprised of meeting the requirements as outlined in the statement of work, adherence to the delivery schedule in the solicitation, and acceptable or neutral past performance. Award will be made on the basis of the lowest evaluated price of quotes meeting the Technical Acceptability for non-cost factors.

Offers will be evaluated for Technical Acceptability in order based on their total evaluated price, and only the lowest priced offer will be evaluated until it is determined the lowest priced offer does not meet technical acceptability criteria; at that point, the next lowest priced offer will be evaluated for technical acceptability. This process will continue until a technically acceptable offer is identified.

The lowest price solution will be evaluated as to whether it meets the requirements of the statement of work and whether its past performance is acceptable or neutral. The Government may use present or past performance data obtained from a variety of sources, to include publicly available reports, information obtained from Government wide databases, and the Government’s personal knowledge. Only recent past performance within the last 3 years shall be evaluated. In the case of an offeror without a record of recent past performance or for whom information on past performance is not available, a rating of Neutral shall be assigned; the offeror may not be evaluated favorably or unfavorably on past performance.

Technical Acceptability

Technical acceptability is comprised of meeting the requirements as outlined in the solicitation, statement of work, and the adherence to the delivery schedule. Specifically, Offerors shall certify they provide the following:
