These statements raise the following questions: 1) The first two sentences make it clear that the Contractor is not responsible for providing health care services. However, the second two sentences contradict the first two sentences in that the Contractor is being required to maintain medical facilities, medical equipment, and ensure adequate stocks of medical supplies are maintained; which are all part of providing health care services. Will the Government remove the second two sentences, which are out of scope? 2) It is patently unfair to ask the detention contractor to provide these medical supplies and services used by IHSC under an FFP CLIN that does not require provision of health care services in it's scope. IHSC may execute differently than the contractor assumes making it nearly impossible for the contractor to be able to provide accurate estimates/pricing for these items. Furthermore, it may create a constant conflict that ICE has to get in the middle of to resolve when IHSC demands quantities of supplies that the contractor has not included in its price; or if equipment is damaged during IHSC use. If ICE has no other contract or means to procure, maintain, and repair these medical facilities, medical equipment, and medical supplies, will the Government provide a separate cost reimbursable CLIN for these specific medical services with a plug number to ensure all bidders are evaluated equally? | The medical consumable requirement has been removed from the PWS. The Contractor will only be responsible for the maintenance of the medical equipment as outlined in a revised Medical Equipment and Maintenance attachment (the attachment has been revised to remove p. 1-24). The maintenance requirements of the equipment will remain in the FFP CLIN. | |

However, in lines 18 through 30, these same columns have notes directing a dollar value be entered, which appear to contradict the instructions that percentages are to be used. Which is accurate? If the offeror does not have any actual prior year costs to enter, the calculation will always show an increase of 100%. In this instance, is the explanation for large increase in cost in Column H that this is a new effort sufficient? Please advise. Expenses Section 2 Per the instructions in lines 62-66 for Section 2 - Contract Services, we are advised to enter the actual prior year cost in column F and provide explanation for large increases in column H. In review of the DSCS Handbook (2.2.1_Attachment_4), we learn that any entries that calculate an increase/percentage change of 10% or more need to be explained. If the offeror does not have any actual prior year costs to enter, the calculation will always show an increase of 100%.
