Version 2.0 October 2020

Date: 1/14/2021 PR Number: 20124018

1. Nature and/or description of the item/service being procured and anticipated cost:

CBP intends to award a brand name-specific contract to a DSX Access Systems, Inc. (DSX) authorized reseller in accordance with FAR Subpart 13. This requirement is for the maintenance of the existing DSX-brand Physical Access Control System (PACS), Closed Circuit Television (CCTV), Intrusion Detection Systems (IDS), and other surveillance equipment previously installed at 12 CBP OIT locations in the Washington DC National Capitol Region.

2. Sole Source Determination Rationale in accordance with FAR 13.106-1(b)(1)(i) and (ii).

(Check one and explain below):

_________ Only one source reasonably available.

_________ Urgent and compelling circumstances exists.

_________ Exclusive licensing agreement exists.

X Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.

_________ Industrial Mobilization _________ Other. Explain:

This requirement is for maintenance of existing DSX software/hardware that was developed by DSX and installed by DSX certified technicians. The existing software/hardware is proprietary and only DSX certified technicians may make the modifications and provide maintenance services. DSX will only provide its equipment to authorized dealers that have DSX certified technicians.

In order to use an alternate source, CBP would have to procure new security systems consisting of hardware, software, and software licenses. The estimated cost of replacing the security systems in all the covered facilities is approximately , which far exceeds the estimated cost of this procurement. Additionally, CBP is currently working on a prospectus to consolidate the existing locations due to leases expiring in the next 1 to 2 years. With the leases expiring soon and the potential for consolidating facilities in the future, there would be no return on investment for CBP were it to switch to a new system at this time.

3. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106-3(a)(2).
