About this file

This is a Sole Source Determination document for the State of New Mexico regarding CDL Driver Training and Third-Party Skills Testing Services. The determination authorizes a sole source procurement approach for driver training and commercial driver's license (CDL) testing services, establishing the justification for awarding the contract to a single vendor without competitive bidding. The document outlines the scope of services required, which includes comprehensive CDL driver training programs and third-party skills testing administration. The contract is set for a term through August 2026, with this determination dated August 2026, establishing the framework for direct award authorization.

The sole source determination identifies specific circumstances that necessitate procurement from a single source, likely based on vendor qualifications, specialized capabilities, or continuity of services. The document provides the rationale for bypassing the standard competitive procurement process and authorizes the contracting agency to proceed with direct negotiations or award to the identified vendor. This determination reflects New Mexico's need for qualified CDL training and testing services and establishes the contractual authority required to execute the procurement through the specified end date, ensuring continuity of driver training and certification services for the state.

V. Agency is required to provide the detailed scope of work (or amendment) for this sole source. Scope of work must match the scope included in the services determination and Horizons declination.

Clovis Community College requires a qualified contractor to provide a comprehensive, turnkey Commercial Driver's License (CDL) training and testing program for eligible students. The Contractor shall provide all personnel, instruction, curriculum, instructional materials, commercial motor vehicles, trailers, fuel, training equipment, driving range, training and testing facilities, maintenance, insurance, recordkeeping, testing, administrative support, and other resources necessary to operate and deliver the complete CDL training and testing program. Except for the College responsibilities expressly identified in this scope of work, the Contractor shall be responsible for all resources, costs, and activities necessary to provide the required services.

1. CDL Classifications The Contractor shall provide training for the following CDL classifications, as applicable to student and program needs:

• Class A CDL;

• Class B CDL; and

• Class C CDL.

2. Geographic Service Area and Equitable Access All required components of the CDL training and testing program shall be provided within a 50-mile radius of Clovis Community College in Clovis, New Mexico. This requirement applies to all instruction, practice, training, range activities, behind-the-wheel driving, vehicle inspection training, skills preparation, testing, and other required components of the program.

The Contractor shall provide or secure appropriate facilities and locations within the 50-mile service area necessary to deliver the complete program, including an appropriate driving range and authorized CDL skills testing facility.

The geographic requirement is intended to ensure equitable and reasonable access to CDL training and testing for individuals residing in the College’s service area and to minimize transportation, travel, and other barriers that could prevent eligible students from participating in and completing the program. The Contractor shall be responsible for ensuring that students are not required to travel outside the 50-mile service area to complete required instruction, practice, training, or testing.

3. Student Assessment and Training Duration The Contractor shall conduct an initial assessment of each student’s existing knowledge, driving experience, skills, and training needs.

Based on the assessment, the Contractor shall determine the appropriate level and duration of training necessary for the individual student. Training may be provided in two-week and/or four-week increments. The Contractor shall determine whether a student requires a two-week or four-week training period based upon the student assessment and demonstrated progress.

4. Classroom Instruction The Contractor shall provide comprehensive classroom instruction designed to prepare students for the applicable CDL knowledge requirements and knowledge examination. The Contractor shall provide and maintain all curriculum, instructional content, lesson materials, assessments, and other instructional resources necessary to deliver the classroom portion of the program.

The College shall provide a computerized classroom at its Clovis campus for classroom instruction.

5. Hands-On and Behind-the-Wheel Training The Contractor shall provide comprehensive hands-on, range, and behind-the-wheel instruction necessary to prepare students for the applicable CDL skills examination.

All hands-on, range, and behind-the-wheel training shall occur within the required 50-mile service area.

6. Training Vehicles, Equipment, Fuel, and Maintenance The Contractor shall provide, operate, maintain, and insure all commercial motor vehicles, trailers, training equipment, and safety equipment necessary to deliver the CDL training and testing program. This shall include, as applicable, tractors, trailers, Class B and Class C training vehicles, vehicles appropriate for applicable endorsements, and all other equipment necessary to conduct classroom, range, vehicle inspection, behind-the-wheel, and CDL skills testing activities. The Contractor shall provide and pay for all fuel and routine operating costs associated with Contractor-provided vehicles and equipment used in the delivery of the program and shall be solely responsible for all routine maintenance, repairs, inspections, upkeep, and operational readiness of Contractor-owned or Contractor-provided vehicles, trailers, equipment, and other resources used to provide the program. All vehicles and equipment shall be properly maintained and shall comply with all applicable federal and New Mexico safety, licensing, registration, inspection, insurance, and operational requirements throughout the term of the agreement.

7. Driving Range and Training Facility The Contractor shall provide access to an appropriate commercial vehicle driving range and other facilities necessary to conduct the hands-on and behind-the-wheel portions of the CDL training program. The driving range shall be located within the required 50-mile service area and shall be suitable for the applicable CDL classifications and provide adequate space and conditions for required vehicle inspection, basic control, backing, maneuvering, and other skills training. The Contractor shall be responsible for all costs associated with the use, operation, maintenance, and upkeep of the Contractor-provided driving range and training facilities.

8. CDL Skills Testing and Examiner Requirements The Contractor shall be an approved New Mexico third-party CDL testing organization, or shall otherwise be authorized by the New Mexico Motor Vehicle Division (MVD) to administer CDL skills examinations. The Contractor shall provide appropriately qualified and currently authorized CDL examiners capable of administering official CDL skills tests for the applicable CDL classifications and endorsements.

The Contractor shall provide and be responsible for all facilities, personnel, vehicles, equipment, scheduling, administration, documentation, and other resources necessary to conduct CDL skills examinations. This shall include an authorized CDL skills testing facility; qualified and authorized CDL examiners; appropriate testing vehicles and equipment; scheduling and administration of CDL skills tests; vehicle inspection testing;

basic control skills testing; road testing; required testing documentation; and electronic submission or reporting of test results to the New Mexico MVD or other applicable regulatory systems as required.

The CDL skills testing facility and all testing activities shall be located within the required 50-mile service area. The Contractor shall maintain all required New Mexico MVD approvals, examiner authorizations, certifications, licenses, registrations, and testing facility requirements throughout the term of the agreement. The Contractor shall be solely responsible for ensuring that all CDL testing activities are conducted in accordance with applicable federal and New Mexico laws, regulations, MVD requirements, and testing standards.

9. Licensed and Qualified Instructors The Contractor shall provide sufficient qualified and experienced CDL instructors to provide all required classroom, range, and behind-the-wheel instruction.

Instructors shall meet all applicable federal and New Mexico requirements for commercial motor vehicle instruction. The Contractor shall ensure that instructors possess the appropriate CDL class and endorsements and meet all applicable experience and qualification requirements.

10. Entry-Level Driver Training (ELDT) Compliance The Contractor shall be registered and listed on the Federal Motor Carrier Safety Administration (FMCSA) Training Provider Registry (TPR) for all training subject to federal Entry-Level Driver Training (ELDT) requirements and shall maintain such registration throughout the term of the agreement. The Contractor shall comply with all applicable federal and New Mexico ELDT requirements, including requirements governing curriculum, instructors, facilities, vehicles, training records, and submission of required training certification information. The Contractor shall promptly notify the College of any change in its TPR status or eligibility to provide ELDT-required training.

11. CDL Testing and Licensure Preparation The Contractor shall provide instruction and preparation designed to enable students to successfully complete the applicable CDL knowledge and skills requirements. The Contractor shall coordinate the transition from training to testing and shall provide the official CDL skills examination when the student has completed the applicable training and otherwise meets all federal and New Mexico requirements for testing. The Contractor shall not guarantee that a student will pass the CDL examination or obtain a CDL.

12. Endorsement Training The Contractor shall provide additional endorsement training when requested by the College and when sufficient student demand exists.

Endorsement training may include:

• Hazardous Materials (Hazmat);

• Tanker;

• Double/Triple Trailers; and

• Passenger.

All endorsement training shall comply with applicable federal and New Mexico requirements, including ELDT requirements when applicable, and shall be available within the required 50-mile service area.

13. Student Records and Documentation The Contractor shall maintain a comprehensive and secure recordkeeping system for all students participating in the CDL training and testing program. Records shall include, as applicable, student enrollment information, initial assessment results, attendance, training dates and hours, CDL classification, endorsements pursued and obtained, training progress, training completion, ELDT certification information, CDL skills testing information and results, and other documentation reasonably required by the College for institutional, regulatory, grant, audit, compliance, or student-record purposes.

The Contractor shall provide the College with copies or electronic records of required student completion, training, certification, and testing documentation in a timely manner and in a format reasonably acceptable to the College. The Contractor shall maintain and retain all program records for the period required by applicable federal and state laws, regulations, funding requirements, and the College's records-retention requirements, while complying with all applicable confidentiality and student-record requirements. The Contractor shall provide records to the College upon request and, upon expiration or termination of the agreement, shall transfer all required student and program records to the College in an accessible electronic format at no additional cost to the College.

14. Insurance and Risk Management The Contractor shall obtain, maintain, and provide evidence of all insurance coverage required by applicable federal, state, and local laws and regulations and by the College’s contract requirements. The Contractor shall be responsible for ensuring that all vehicles, facilities, equipment, instructors, examiners, employees, and training and testing activities are appropriately insured and legally authorized.

15. Regulatory Compliance The Contractor shall comply with all applicable federal, state, and local laws, regulations, licensing requirements, safety standards, and other requirements governing CDL training, commercial motor vehicles, CDL testing, and operation of training facilities.

The Contractor shall immediately notify the College of any suspension, restriction, expiration, or loss of any license, certification, registration, authorization, or approval necessary to perform the services.

16. Program Administration The Contractor shall provide all administrative coordination necessary for the effective operation of the CDL training and testing program, including instructor, vehicle, range, and testing schedules; student progress monitoring and status communication;

maintenance and submission of required training, testing, and regulatory records;

regulatory reporting; and ongoing coordination with the College regarding scheduling, student participation, program delivery, and other operational matters. The Contractor shall ensure that all administrative activities are conducted accurately, timely, and in accordance with applicable regulatory and College requirements.

17. College Responsibilities The College shall coordinate student enrollment and student participation, establish student charges as applicable, provide a computerized classroom and reasonable access to the classroom during scheduled training, provide information reasonably necessary for enrollment and program delivery, maintain College-owned facilities and equipment, maintain institutional records associated with the program, and coordinate with the

Contractor regarding student participation and program scheduling.

18. Location and Hours of Performance Classroom instruction shall be conducted at Clovis Community College, 417 Schepps Boulevard, Clovis, New Mexico, unless otherwise approved by the College. All other required components of the program, including hands-on training, range training, behind-the-wheel driving, vehicle inspection training, skills preparation, and official CDL skills testing, shall be conducted at Contractor-provided facilities or other approved locations within 50 miles of Clovis Community College. The Contractor shall provide sufficient scheduling availability to meet student and program needs. The Contractor shall be prepared and capable of commencing CDL training services immediately upon final execution of the contract and receipt of authorization from the College to begin services.

The Contractor shall maintain the personnel, vehicles, equipment, facilities, driving range, testing capacity, and other resources necessary to begin serving eligible students without an additional implementation or mobilization period.

19. Performance Standard The Contractor shall provide a complete, safe, compliant, and operational CDL training and testing program capable of taking an eligible student from initial assessment through completion of required training and, when eligible, administration of the official CDL skills examination. The Contractor shall maintain sufficient qualified personnel, vehicles, equipment, fuel, facilities, range capacity, testing capacity, and administrative resources to provide uninterrupted delivery of scheduled services. The Contractor shall promptly notify the College of any condition that may materially affect the Contractor’s ability to provide scheduled training or testing services.

The Contractor shall be fully operational and capable of commencing scheduled CDL training immediately upon final execution of the contract and authorization by the College to begin services. The Contractor shall not require an additional start-up, mobilization, equipment acquisition, facility preparation, or staffing period before beginning services.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

Clovis Community College identified the following criteria as necessary for successful delivery of its CDL training and testing program:

Integrated, turnkey delivery.

The contractor must be capable of providing an integrated CDL training and testing program through a single contractor. The contractor must provide the personnel, curriculum, instructional materials, commercial vehicles, trailers, equipment, driving range, training and testing facilities, fuel, maintenance, insurance, recordkeeping, testing, and administrative support necessary to deliver the program. This criterion is necessary because the College intends to provide a complete CDL training and testing program without separately procuring and coordinating multiple providers for instruction, vehicles, equipment, facilities, and testing services.

CDL training experience and regulatory compliance.

The contractor must have demonstrated experience providing CDL training and must be capable of delivering training in compliance with applicable federal and New Mexico requirements. For training subject to federal Entry-Level Driver Training (ELDT) requirements, the contractor must be listed on the Federal Motor Carrier Safety Administration (FMCSA) Training Provider Registry (TPR) and remain eligible to provide the applicable training throughout the term of the contract. This criterion is necessary to ensure that students receive training that satisfies applicable requirements for obtaining the CDL classifications and endorsements offered through the program.

Commercial vehicles, equipment, and hands-on training capability.

The contractor must provide the commercial vehicles, trailers, equipment, and other resources necessary for students to receive hands-on and behind-the-wheel training.

Training must include, as applicable to the CDL classification and endorsements offered, vehicle inspection, basic vehicle control, backing maneuvers, range instruction, and public-road driving instruction. The contractor must be responsible for the maintenance, safety, insurance, and operational readiness of the vehicles and equipment used for training. These requirements are necessary because the College does not intend to purchase, maintain, insure, or independently operate a commercial vehicle training fleet.

Appropriate driving range and training facilities.

The contractor must provide access to an appropriate commercial vehicle driving range and other facilities necessary to conduct the hands-on portions of the program. The facilities must be suitable for the CDL classifications and training activities offered. This criterion is necessary because students must have access to appropriate facilities and space to safely practice and develop the vehicle control and driving skills required for CDL licensure.

Official CDL skills testing capability.

The contractor must be authorized by the New Mexico Motor Vehicle Division (MVD) to administer official CDL skills examinations and must provide appropriately qualified and currently authorized CDL examiners. The contractor must have the facilities, vehicles, equipment, and administrative capability necessary to conduct the required skills examinations. This criterion is necessary because the College intends to provide students with a complete training-to-testing program through one contractor and does not intend to separately procure or coordinate an additional provider for the official CDL skills examination.

Local service delivery.

The contractor must be capable of providing classroom instruction at Clovis Community College and all required hands-on training, range activities, behind-the-wheel driving, and CDL skills testing within a fifty (50) mile radius of the College. This geographic requirement is necessary to provide reasonable access for students in the College's service area, minimize transportation and travel barriers, and allow the College to effectively coordinate and oversee the program.

Qualified instructional personnel.

The contractor must provide sufficient qualified and experienced CDL instructors capable of providing classroom, range, and behind-the-wheel instruction for the CDL classifications offered. Instructors must meet applicable federal and New Mexico qualification requirements. This criterion is necessary to ensure that students receive instruction from personnel qualified to provide the required CDL training.

Training for required CDL classifications and endorsements.

The contractor must be capable of providing training appropriate to the CDL classification being pursued, including Class A, Class B, and, when included in the College's program needs, Class C CDL training. The contractor must also be capable of providing applicable endorsement training requested by the College, which may include Passenger (P), School Bus (S), Hazardous Materials (H), Tank Vehicle (N), and Double/Triple Trailers (T), as applicable. The contractor must meet all federal and New Mexico requirements applicable to each CDL classification and endorsement offered.

This criterion is necessary to allow the College to serve varying workforce and student needs through a single CDL training and testing program rather than requiring separate providers for different CDL classifications or endorsements.

Student records and program administration.

The contractor must have the operational capacity to maintain required student training, completion, certification, and testing records and provide the administrative support necessary for continuous program delivery and regulatory compliance. This includes maintaining records required by applicable federal and state requirements and providing the College with required documentation of student training and completion. This criterion is necessary to ensure that the College can document student participation and completion and meet institutional, regulatory, grant, audit, and reporting requirements.

Vehicle, facility, and program operational responsibility.

The contractor must have the operational capacity to provide and maintain the vehicles, equipment, facilities, personnel, insurance, fuel, and other resources necessary for continuous program delivery. This criterion is necessary because the College's intended program model places responsibility for the operational resources associated with CDL training and testing with the contractor rather than requiring the College to acquire and manage those resources itself.

Immediate Operational Readiness The contractor must have the personnel, vehicles, equipment, facilities, driving range, testing capacity, and other resources already in place or otherwise immediately available to begin providing CDL training and testing services upon final execution of the contract and authorization by the College. The contractor must not require an extended implementation or start-up period before serving students. This criterion is necessary because the College's program requires continuity of CDL training services and the ability to begin serving eligible students promptly following execution of the contract.

Review of Available Sources Using these criteria, Clovis Community College reviewed available sources to determine whether other reasonably available providers could meet the full combination of services required by the College. The criteria were developed from the College's operational need to provide an integrated CDL training and testing program that takes students from initial assessment and instruction through hands-on training and, when eligible, the official CDL skills examination.

The criteria were not established to exclude otherwise capable contractors. Each criterion is directly related to the College's intended purpose of providing a complete, compliant, accessible, and operational CDL training and testing program while minimizing the need for the College to separately procure, coordinate, maintain, or manage vehicles, equipment, facilities, testing services, and related operational resources.

The College therefore reviewed available providers based on their ability to meet the full combination of requirements, including CDL training experience, applicable ELDT/TPR requirements, qualified instructors, Class A/B/C training capability, commercial vehicles and equipment, hands-on training facilities and driving range, official CDL skills testing capability, required records and administrative support, and delivery of required services within the fifty (50) mile service area.

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

Reasons, Qualifications, or Unique Capabilities of Prospective Contractor Vehicle Safety Programs, LLC (VSP) is the only known source identified by Clovis Community College capable of providing the complete combination of services required for the College's integrated CDL training and testing program under a single contract and within the College's required service area.

The College requires a contractor capable of providing qualified CDL instructors; CDL curriculum and instructional materials; classroom instruction in coordination with the College; hands-on and behind-the-wheel training; appropriate commercial motor vehicles, tractors, trailers, and training equipment; a suitable driving range; vehicle inspection and skills training; official CDL skills testing by an authorized New Mexico CDL examiner; vehicle and equipment maintenance; fuel; insurance; regulatory compliance; required training and testing documentation; and administrative support necessary to operate the program in compliance with applicable federal and New Mexico requirements.

VSP possesses the personnel, commercial vehicles, training equipment, facilities, and operational capability necessary to provide the required hands-on and behind-the-wheel CDL training within the College's specified geographic area. VSP is also the existing provider of the practical training component of the College's CDL program. The College's current program utilizes VSP's qualified CDL instructor(s), and the College's program documentation identifies VSP's Portales facility as the location for hands-on and practical training. These existing resources demonstrate that VSP has the facilities, equipment, personnel, and operational capacity necessary to integrate the hands-on portion of the program with the College's classroom instruction.

VSP also meets the regulatory requirements necessary to provide the complete program.

VSP is listed on the Federal Motor Carrier Safety Administration (FMCSA) Training Provider Registry for applicable Entry-Level Driver Training (ELDT) services. VSP has represented that it is authorized to provide CDL skills testing in New Mexico and has an appropriately authorized CDL examiner available to administer the required skills examinations. This capability allows VSP to provide both the required ELDT training and the official CDL skills testing component of the program through a single contractor. VSP therefore has the ability to provide both the required ELDT training and the official CDL skills testing component of the program.

The College's market review considered reasonably available sources that provide CDL training and related services and evaluated whether those sources could meet the full combination of requirements established for this program. The College identified other entities that provide certain CDL-related services; however, the College did not identify another reasonably available source capable of providing the complete combination of qualified instructional personnel, applicable ELDT training, commercial vehicles and equipment, suitable driving range access, hands-on and behind-the-wheel training, official CDL skills testing, required documentation and administrative support, and delivery within the College's specified geographic area under a single contract.

The College's requirement is therefore not for an individual CDL instructor, a standalone CDL course, or an individual component of CDL training. The requirement is for an integrated, turnkey CDL training and testing program that can be implemented in conjunction with the College's classroom instruction and provide the vehicles, equipment, facilities, training, testing, records, and operational support necessary to take eligible students from initial assessment through required training and, when eligible, the official CDL skills examination. Based on the College's good-faith review of reasonably available sources and the specific requirements established for the program, Vehicle Safety Programs, LLC is the only known source identified by the College capable of providing the complete required scope of services as an integrated program under a single contract and within the required service area.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The service required by Clovis Community College is unique because it requires the integration of multiple specialized CDL training and testing resources into a single service capable of supporting the College's CDL program from initial assessment through required training and, when the student is eligible, the official CDL skills examination. The required service combines qualified CDL instructors, applicable ELDT training, commercial motor vehicles and trailers, specialized training equipment, access to a suitable driving range, vehicle inspection and basic control training, behind-the-wheel public-road instruction, required training and testing documentation, regulatory compliance, official CDL skills testing, and program administration. The College requires these resources to be available as an integrated program rather than as separate services that the College would have to procure and coordinate independently.

This integrated service is substantially related to the intended purpose of the contract because the College's objective is to provide students with a complete and accessible pathway to CDL licensure and entry into the commercial transportation workforce. The College does not seek to independently acquire and maintain a commercial vehicle training fleet, establish and maintain a driving range, employ specialized CDL instructional personnel, or separately coordinate the operational components required to provide hands-on training and CDL skills testing. Having these services provided through an integrated program establishes clear responsibility for training delivery, vehicle and equipment readiness, required documentation, testing coordination, and compliance with applicable federal and New Mexico requirements.

The service is also unique in its required local delivery model. Classroom instruction is conducted on the Clovis Community College campus, while all hands-on driving, range, behind-the-wheel, and official CDL skills testing required under the program must be provided within a fifty (50) mile radius of Clovis, New Mexico. This requirement is substantially related to the purpose of the contract because it provides reasonable access for CCC students, limits travel associated with required hands-on training and testing, and allows the College to coordinate and oversee the program as part of its workforce development offerings.

The combination of specialized CDL personnel, applicable ELDT training, commercial training vehicles and equipment, appropriate hands-on training and testing facilities, authorized CDL testing capability, local delivery, regulatory compliance, required student documentation, and integrated program operations is therefore substantially related to the College's intended purpose of providing a complete CDL workforce training and testing program without requiring the College to independently establish and operate the specialized infrastructure necessary to deliver the program.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

Clovis Community College conducted due diligence to identify available sources capable of providing the comprehensive turnkey Commercial Driver's License (CDL) training and testing services required by the College. The review was conducted to determine whether a provider other than the prospective contractor could satisfy the College's complete scope of work, including qualified CDL instructors, applicable ELDT training, curriculum and instructional materials, commercial vehicles and trailers, driving range access, hands-on and behind-the-wheel training, official CDL skills testing, equipment maintenance, required training and testing documentation, regulatory compliance, administrative support, and delivery within the College's required geographic service area.

The College conducted internet-based research of CDL training providers and commercial driver training organizations serving Clovis, Portales, and the surrounding eastern New Mexico area. The College reviewed publicly available provider information, including descriptions of CDL training programs, training locations, available commercial vehicles and equipment, instructional services, driving ranges and training facilities, testing capabilities, geographic service areas, and other information relevant to the College's established requirements. The College also reviewed available workforce development and industry resources to identify potential providers.

The College reviewed available State Purchasing Division resources and statewide purchasing agreements to determine whether an existing Statewide Price Agreement or other established procurement vehicle could satisfy the College's requirements. The College did not identify an existing statewide purchasing agreement that provides the complete combination of CDL training and testing services, commercial training vehicles and equipment, local hands-on training facilities, and program support required by the College.

The College evaluated identified providers against the criteria established for the procurement. The review focused on whether a provider could furnish the complete required service as an integrated turnkey operation, rather than whether a provider could furnish only an individual component of CDL training. The College considered the provider's ability to furnish qualified instructional personnel, applicable ELDT training, commercial vehicles and equipment, suitable range and training facilities, hands-on and behind-the-wheel instruction, official CDL skills testing, required records and documentation, administrative support, and delivery within the required geographic service area.

The College's review identified organizations that provide CDL-related instruction or individual components of CDL training. However, the College did not identify another reasonably available provider that could satisfy the complete combination of requirements established for this procurement under a single contract and within the required geographic area. Where available information indicated that a provider offered only individual CDL-related services or did not meet one or more of the College's required criteria, the provider was not considered capable of fulfilling the complete scope of the procurement.

The College also considered the existing delivery of its CDL program. Vehicle Safety Programs, LLC currently provides the practical/hands-on component of the College's CDL training program, including qualified CDL instructional personnel and use of its Portales training facilities. This existing arrangement provides documented evidence of VSP's ability to provide the specialized hands-on training, commercial vehicle resources, and local facilities required by the College and to coordinate those services with the College's classroom-based program.

The College documented its due-diligence activities and maintained supporting information regarding identified providers, available services, geographic locations, and the reasons providers were determined to be unable to satisfy the complete scope of the procurement. The businesses contacted, dates of contact, methods of contact, and available supporting documentation are identified in the accompanying market research documentation.

Based on the College's documented internet and industry research, review of available State Purchasing Division resources and statewide purchasing agreements, evaluation of identified providers against the established criteria, and review of available provider capabilities, Vehicle Safety Programs, LLC was determined to be the only known source identified by the College capable of providing the complete required scope of services as an integrated turnkey CDL training and testing program within the required service area.
