About this file

This is an Emergency Procurement Determination Form submitted by the New Mexico Department of Information Technology (DoIT) for the provision of high-speed internet services. The emergency procurement authorizes the engagement of three contractors—CenturyLink Communications, LLC; Plateau Telecommunications Incorporated LLC; and 7200 NW Fiber Platform LLC/Unite Private Networks—to provide secure, symmetrical high-speed internet service and related support throughout New Mexico. The scope of work includes high-speed internet service as direct connections, internet service support and monitoring, outage notifications, professional services and training for ISP services, and distributed denial of service (DDoS) attack prevention solutions. The emergency procurement is limited to a six-month term and excludes construction services, tangible goods, and equipment or hardware purchases. The emergency procurement was approved on June 29, 2026, and is intended to serve as a temporary measure until the completion of a competitive Request for Proposals (#60-36100-25-06699).

The total contract value for the emergency procurement is $100,000.00. The emergency procurement is justified under New Mexico Statute Section 9-27-20 NMSA 1978, which mandates that DoIT establish telecommunication networks for executive, legislative, and judicial branches of state government. The determination identifies critical operational impacts of internet service loss, including the inability of hospitals to access health records, emergency services to respond to incidents, state agencies to deliver constituent services such as driver's licenses and vehicle renewals, and financial and payroll operations through the State's SHARE System to function. The emergency procurement applies to numerous state agencies, facilities, and correctional institutions across New Mexico. The agency commits to implementing measures to prevent future emergency procurements by maintaining appropriate staffing levels, providing contract training to DoIT managers, and implementing systems to monitor contract expiration dates in advance.

The loss of internet services will affect the availability of critical telecommunication services and support will threaten the functioning of government as well as threaten public health, welfare, safety or property; hospitals in New Mexico will be unable to rely on updated health records, law enforcement and emergency services would be unable to receive/respond to emergencies, will create critical delays in how the Department of Homeland Security is able to respond to terror threats and natural disasters; New Mexico constituents will not be able to obtain services such as driver’s licenses, vehicle renewals, birth certificates, building construction permits, pay taxes, and other approvals via the internet; reports of child abuse and neglect could not be made to the

Children, Youth, and Families Department, health and welfare processes through the Health Care

Authority would be challenged, and all financial/payroll operations through the State’s SHARE

System would be unavailable. High-Speed Internet Services provides essential connectivity for

V. Describe what measures are being taken to minimize the duration and effect of this particular emergency procurement (for example: is the emergency only in place until a competitive process can be completed, etc.).

The emergency procurement will only be in place until the competitive process for Request for

Proposals # 60-36100-25-06699 is completed, it is currently pending agency draft contract, SPD will be completing the procurement awards once they have received the draft contract and have vetted it.

VI. Describe what measures the Agency will take in the future to prevent/mitigate use of an emergency procurement under similar circumstances.

The IT competitive RFP procurements are complex and require coordination and planning across several key resources and State Agencies. This can be mitigated by maintaining appropriate staff levels, contract training, and management. DoIT will continue to build on its training for all DoIT managers of contracts to understand and anticipate contract expiration dates.

ELECTRONIC RECORD AND SIGNATURE DISCLOSURE

A. ELECTRONIC RECORD AND SIGNATURE DISCLOSURE (ERSD)

From time to time, New Mexico General Services Department (GSD), on behalf of the State of

New Mexico (SONM), may be required by law to provide you with certain written notices or disclosures. Stated below are the terms and conditions for GSD's providing you such notices and disclosures electronically through the DocuSign system. Please read this information carefully. If you are able to access this information electronically and agree to this Electronic Record and

Signature Disclosure (ERSD), please confirm your agreement by selecting the check-box next to “I agree to use electronic records and signatures” before clicking “CONTINUE” within the

DocuSign system.

B. Obtaining paper copies

At any time up to twenty (20) calendar days following your use of DocuSign to electronically sign a document, you may request a paper copy of any record provided or made available electronically to you by GSD. You will have the ability to download and print documents SONM sends you through the DocuSign system during and immediately after the signing session and, if you elect to create a DocuSign account, you may access the documents for a twenty (20) calendar day period after such documents are first sent to you. Following the twenty (20) day period, if you want GSD to send you paper copies of any such documents from GSD's office, you will be charged a $1.00 per-page fee plus postage. You may request delivery of such paper copies from GSD by following the procedure stated in Section H, below.

C. Withdrawing your consent

If you decide to receive notices and disclosures from GSD electronically, you may at any time change your mind and inform GSD you want to receive required notices and disclosures only in paper format. The procedure concerning how you may inform GSD of your decision to receive future notices and disclosures in paper format as well as withdraw your consent to receive notices and disclosures electronically is stated in Section D, immediately below.

D. Consequences of changing your mind

If you elect to receive required notices and disclosures only in paper format, it will slow the speed with which GSD will be able to complete certain steps in specific transactions and deliver paper copies to you. GSD will need: (1) to send the required notices or disclosures to you in paper format; and (2) wait until GSD receives your acknowledgment of your receipt of such paper notices or disclosures. Further, you will no longer be able to use the DocuSign system to receive required notices and consents electronically from SONM or to electronically sign documents generated and sent to you from SONM.

Electronic Record and Signature Disclosure created on: 4/14/2020 1:18:28 PM Parties agreed to: Jason Clack, Silvia O. Rodarte, Manny Barreras

Unless you inform GSD otherwise according to these procedures, GSD will electronically provide you through the DocuSign system all required notices, disclosures, authorizations, acknowledgements and other documents that are required to be provided or made available to you during the course of your electronic signature relationship with SONM. To reduce the possibility of inadvertent non-receipt, GSD prefers to provide all required notices and disclosures by the same method and to the same email or physical address that you furnish to GSD. Thus, you may receive the disclosures and notices electronically or in paper form. If you do not agree with this procedure, please inform GSD according to the procedures stated in Section I, below.
