About this file
This is a Questions and Answers document for ITB 70-00000-26-00010 General Construction Services, a statewide price agreement issued by the State of New Mexico General Services Department Purchasing Division. The procurement solicits bids from New Mexico-licensed general contractors to provide on-call construction services including general building construction, renovations, equipment installation, site and utility work, demolition and abatement projects, security installations, and associated design and permitting services for state agencies, commissions, political subdivisions, and local public bodies statewide. Sealed bids were due September 24, 2026 at 2:00 p.m., with opening via Microsoft Teams immediately thereafter. The contract term is one year from award with options to extend for three additional one-year periods by mutual agreement, not to exceed four years total. Amendment No. 1 was issued August 14, 2026, and all bidders were required to acknowledge receipt via the online bidding portal.
Pricing is structured around hourly rates for three personnel levels (Superintendent, Journeyman/Experienced Worker, and Laborer) with separate regular and after-hours rates, plus mileage reimbursement for distances exceeding fifty miles one way from dispatch to job site, material discounts, and profit and overhead percentages. Profit and overhead are capped at ten percent of total quoted costs with no markups allowed on materials and supplies; subcontractor markups are limited to five percent for administrative costs only. Gross receipts tax is excluded from the profit and overhead calculation, while all other costs including bonds, permits, insurance, design fees, direct site overhead, equipment, per diem, and subcontractor costs are included. Per diem and mileage rates for employee travel are set annually by the Department of Finance and Administration and are not bid items. Individual project compensation is capped at seven million dollars, with an aggregate cap of thirty million dollars across all projects and renewals over a ten-year period per contractor. Performance and payment bonds equal to one hundred percent are required for projects exceeding twenty-five thousand dollars, and contractors must carry public liability insurance of at least one hundred thousand dollars per occurrence for property damage and three hundred thousand dollars per person for other damages. For public works projects exceeding sixty thousand dollars, contractors must be registered with the Department of Workforce Solutions and must apply the highest applicable prevailing wage rate for their classification.

Q&A
Question: On the first page there is not a place for an "Authorized Signature" under a head-ing of "The Terms and Conditions shall not be modified or Supplemented." .... and on Page 4 under #12 it reads: Non-Collusion: In signing this bid the Contractor certifies he/she has not, either directly, entered into action in restraint of free competitive bid-ding....etc.... I just do not see a place on the ITB Document where bidding contractor signs...maybe somewhere in the ITB site?
Answer: Signature is only required for a paper bid submission.
Question: 2. In the Bidder Response Spreadsheet, Older version has "Diagnosis, project estimates, troubleshooting, other" Is this now covered under Profit and Overhead? Or is it being removed entirely for this ITB?
Answer: See previous answer.
Question: • Also "Daily per diem rate for overnight stay as needed. Including dinner and breakfast per person. This is not listed.
I apologize that I am confused because on Page 14 Second Paragraph it reads:
The Contractor's quote for mileage and per diem associated with employee's travel is not a bid item and must be priced as follows:
"Per Diem Rate" means lodging, meals and incidentals (excluding taxes) shall be determined by the Mileage Act....etc.
"Mileage Rate" Means "only the mileage from the dispatch to the job site....etc.
Also on last Paragraph Page 14, it reads:
Direct Site Overhead Expenses:
The Contractor's per diem expenses, as shown by the itemized accounting, for the following allowable applicable, direct Site overhead expenses....etc.
Answer: This is not a bid item. It is a set rate determined by DFA annually.
Question: • Also Page 16 Mileage: Item #7 - with Amendment #3 this becomes Item #17..... I think?
Answer: Mileage rate in the bid items is not for employee travel; it is for dispatch to the job site.
Question: • And.... it reads....Does not include per diem and mileage associated with employee's travel expenses" I apologize for being confused. I guess Per Diem is included in "Overhead Expenses"?
Answer: Yes.
Question: Please clarify whether the $30 million, 10-year maximum applies to each individual contractor or to the overall program across all awarded contractors.
Additionally, will you explain the rationale for this limitation?
Answer: 1.This applies to each contractor individually.
2. 13-1-154.1. Multiple source contracts; architectural and engineering services contracts; indefinite quantity construction contracts.
B. A state agency or local public body may procure multiple indefinite quantity construction contracts pursuant to a price agreement for multiple projects under a single request for proposals; provided that the total amount of all contracts and all renewals does not exceed thirty million dollars ($30,000,000) in a period of no more than ten years and the contract provides that any one purchase order under the contract may not exceed seven million dollars ($7,000,000).
Question: The MM98 was left out of the updated contract.
Answer: Contractors are to possess the licensure appropriate for the work they are quoting. The GB 98, GA 98, etc. shown are used as an example not the comprehensive list.
Question: Profit and loss is a new section of this submission. What is the reason behind this? Will this be paid out separately from the project?
Answer: Previously answered.
Question: Page 13 states that “Profit and Overhead shall not exceed ten percent (10%) of the total quoted cost.” Please clarify whether the 10% limitation applies only to the Contractor’s combined profit and overhead fee, or whether it also includes the separately permitted 5% administrative markup on subcontractor quotes.
Answer: This applies to the total combined profit and overhead fee.
Question: Please confirm that the maximum 5% administrative markup allowed on subcontractor quotes is permitted in addition to the Contractor’s Profit and Overhead percentage, and is not required to be included within the 10% Profit and Overhead limitation.
Answer: Yes.
Question: Please clarify what costs are included in the “total quoted cost” used to calculate the 10% Profit and Overhead limitation. Specifically, should bonds, permits, insurance, design fees, direct site overhead/general conditions, equipment, per diem, mileage, subcontractor costs and gross receipts tax be excluded before calculating the allowable Profit and Overhead? The ITB requires these costs to be separately identified in project quotes.
Answer: Gross receipts tax should be excluded before calculating the profit and overhead. All other costs are to be included in the calculation.
Question: For projects over $60,000 there are multiple prevaling wage rates that could potentially be applied to the project. Some have zone pay, and appreticship fees and the pay rates vary. Should our rates just incorporate the hightest that could potentially be paid or will you issue another bid sheet with mulitple rates for each prevailing classification (A,B & H)?
Answer: No other bid sheets will be issued.
