About this file

This is a Questions and Answers document for ITB 70-00000-26-00010, a statewide price agreement for on-call general construction services administered by the State of New Mexico General Services Department Purchasing Division. The procurement requests sealed bids for hourly rates across three personnel levels—Superintendent (regular and after-hours), Journeyman or Experienced Worker (regular and after-hours), and Laborer (regular and after-hours)—plus pricing for mileage reimbursement, material discounts, and profit and overhead percentages. The scope encompasses general building construction, renovations, equipment installation, site and utility work, demolition and abatement projects, and security installations for all New Mexico state agencies and local public bodies statewide. Sealed bids were due September 24, 2026 at 2:00 p.m. The agreement runs for one year from award with options to extend for three additional years on a year-to-year basis by mutual agreement, not to exceed four years total. Amendment No. 1 was issued August 14, 2026, and all bidders were required to acknowledge receipt.

The Q&A document addresses multiple pricing and submission clarifications. Bidders must submit labor rates applicable to all areas of the state and all construction trades without separate discipline or geographic breakdowns. Profit and overhead are capped at ten percent of total quoted costs with no markups allowed on materials and supplies; subcontractor markups are limited to five percent for administrative costs. Per diem is set by the Mileage Act annually, and no charges for estimating are permitted. A Revised Items list was promised via amendment to clarify whether labor rates should be submitted as all-in prices or direct employee costs before overhead and profit, and to address wage rate considerations for projects over $60,000. Public works projects exceeding sixty thousand dollars require contractors to be registered with the Department of Workforce Solutions and comply with New Mexico wage rates. Bidders must hold valid New Mexico Construction Industries Division licenses, and performance and payment bonds equal to one hundred percent are required for projects exceeding twenty-five thousand dollars.

Q&A

Question: Reading the Wage Rates specifications, we noticed the clause regarding projects over $60,000; However, the unit price in the pricing proposal section only has one column without separation between under/over projects over $60,000.

Would you like the Unit Price for the proposed line items be assumed under or over the $60,000 wage rate consideration?

Answer: A Revised Items list will be submitted via amendment.

Question: This pricing proposal does not consider per-diem rates nor does it include a diagnosis/estimating rate. In the Scope of Work specification, paragraph 14 mentions '...per diem, and any other fees necessary to perform the work called for in the Using Agency's request for quote for this project.' Will per diem and Estimating costs need to be proposed as additional line items within this RFP submission, or will they be considered during the decision-making process of project bids utilizing this award?

Answer: Per diem is set by the Mileage Act annually. No charges for estimating allowed.

Question: Does the State intend items 1-6 to represent the contractor’s all-in price or a direct employee labor cost before overhead and profit? The RFP seems to indicate that the rates are contractor hourly rates (all-in), however the separate line Item 9 for P&O is slightly confusing. We want to make sure we understand which number the RFQ is requesting. We do understand that these numbers are supposed to be broken out.

Answer: A Revised Items list will be submitted via amendment.

Question: In past years there used to be a big packet that was filled out to be submitted with bid. Is there still additional information that must be submitted with our bid?

Answer: No.

Question: Profit and loss is a new section of this submission. What is the reason behind this? Will this be paid out separately from the project?

Answer: To ensure there are no hidden costs.

Question: Should the labor rates required for this RFP be bid as over $60,000 using NM Wage Rates or under $60,000 not requiring NM Wage Rates?

Answer: A Revised Items list will be submitted via amendment.

Question: Does the State intend items 1-6 to represent the contractor’s all-in price or a direct employee labor cost before overhead and profit? The ITB seems to indicate that the rates are contractor hourly rates (all-in), however the separate line item 9 for P&O is slightly confusing.

We want to make sure we understand which number the ITB is requesting. We do understand that these numbers are supposed to be broken out.

Answer: A Revised Items list will be submitted via amendment.

Question: How do I obtain this number for our company as this is a requirement for this procurement. Please advise.

Answer: unable to answer this question.

Question: There are not separate rates for each construction discipline. Does this mean that the rates we provide must be covered for all trades such as electricians, plumbers, carpenters, etc.?

Answer: Yes.

Question: The rates are not broken out into areas of the state so should the rates cover all areas of the entire state?

Answer: Yes.

Question: Page one states, "Bidder MUST complete as applicable and sign the following in order for Bid to be valid..." There is no place provided for a signature. Where should offerors sign?

Answer: TBD.

Question: If your over the 10% markup do this atomically kick you out of the contract.

Answer: There is no markup allowed.
