Source Selection Information - See FAR 2.101 and 3.104 Rev 10/2015

CONTROL NUMBER 2020-012

N00406-18-C-0005

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

NAVSUP Fleet Logistics Center Puget Sound (FLCPS)

2. Description of Action Being Approved.

NAVSUP FLCPS proposes to execute an out of scope modification to Contract N00406-18-C-0005 by means of other than full and open competition. The scope of the modification includes planning for repairs to the Aircraft Elevator (ACE) #4’s guide roller and web bulkhead and minor material with long lead-time. N00406-18-C-0005 was awarded for ACE #3, #1 and #4 Hitch Girder fabrication and advance planning for the installation of the Hitch Girders. The final option for the ACE #4 was exercised on 10 October 2019.

3. Description of Supplies/Services.

Repairs are needed to the web bulkhead of ACE #4 and two of ACE #4’s lower guide roller foundations, which need to be removed and replaced.

This modification will allow for planning in order for these repairs to take place in coordination with the planned Hitch Girder repairs.

Repairs will take place concurrently with the currently contracted ACE #4 Hitch Girder repairs, and this modification will allow for planning to occur in time to allow repairs to be made.

The estimated value of this modification is and will be funded by FY20 O&M,N.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source.

5. Rationale Justifying Use of Cited Statutory Authority.

This is an out of scope modification to N00406-18-C-0005. Previous ACE repairs have been solicited as sole source to Huntington Ingalls Incorporated – Newport News Shipbuilding (HII) or have been competed

Source Selection Information - See FAR 2.101 and 3.104 Rev 10/2015 as full and open with only HII expressing interest. HII is the Original Equipment Manufacturer (OEM) of the ACE. Drawings and other technical information, such as the cutting requirements for ACE systems are proprietary to HII and they are the only known source for engineering design drawings as well as the technical knowledge to design the repairs to the ACE.

Additionally, as repairs will be carried out concurrently with the Hitch Girder repairs, HII is the only company capable of creating a repair plan that deconflicts the repairs to the Hitch Girders along with the repairs to the Roller Guide foundations and web bulkhead.

These repairs are occurring on the same ACE, during the same time period and will require extensive work integration to accomplish all the repairs during the Ship’s availability. Excess Hitch Girder fabrication material under this contract can be repurposed for use in the Web Plate and Guide Roller repairs and modifying this contract will allow the Government to have it packaged in the CONEX boxes with the Hitch Girder repair material, saving a significant amount of money by eliminating the need to ship the material separately.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Review of previous market research done prior to solicitation for the original award indicates that only HII-NNS is capable of providing the required engineering and repair plans. Previous solicitations and sources sought (11 May 2017 for ACE #2) for the Hitch Girder repairs to the ACE found no interested parties beyond HII. Based on the lack of interest and capability of other companies in performing Hitch Girder repairs, no other sources were sought. Additionally, HII-NNS continues to be the only Prime shipbuilder for the CVN and LHA/D classes, which are the only ships to utilize ACEs.

7. Determination of Fair and Reasonable Cost.

The contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable utilizing the appropriate methodology for the contract type.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP FLCPS has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLCPS will assess whether competition for future requirements is feasible.
