About this file
Justification for Other Than Full & Open Competition
This document is a Justification and Approval (J&A) for a single-source contract award by the Department of the Navy, NAVSUP WSS (Naval Supply Systems Command Weapon Systems Support) located in Mechanicsburg, Pennsylvania.
The acquisition covers spare parts for the Nuclear Reactor Program, specifically one unit of nomenclature NQB-A-1600 CKT BRKR (NSN 7HH 5925 016963046 X3, P/N ETN3699400O0C) with an estimated value of $559,464.00. The contract will be awarded to L3 Harris Maritime Power & Energy Solutions, Inc. (Cage code 30086), identified as the original equipment manufacturer (OEM) and sole source capable of manufacturing this component. The expected final delivery date is August 3, 2028. The justification is based on 10 USC 3204(A)(1), citing that only one or a limited number of responsible sources can satisfy agency requirements. The acquisition rationale relies on A/RMC classification 1 (suitable for competitive acquisition for second or subsequent time) and A/RMSC classification P (data rights not owned by the Government, reverse engineering uneconomical). Market research conducted per FAR Part 10 confirmed that L3 Harris maintains exclusive manufacturing rights and design standards. A class waiver dated March 15, 2019 exempts the requirement to post a Request for Information or Sources Sought notice. The contract was synopsized on the government-wide point of entry on January 1, 2026, with no competing sources expressing interest. Future competition will be pursued if alternative qualified manufacturers emerge.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document.
