About this file
This file is a Resident Veteran's Preference Affidavit form used by the State of New Mexico for procurement opportunities, specifically applicable to the Re-Bid Modular Home Contractor and Construction Services solicitation for teacher housing sites within a school district. The affidavit allows qualified New Mexico resident veteran businesses to certify their eligibility for a 10% preference discount on the contract award. To qualify, vendors must possess a current Resident Veteran's Preference Certificate and certify that their prior year revenue does not exceed $3 million for the preceding tax year. The form requires an authorized business representative to sign under penalty of perjury, confirming the accuracy of all representations made regarding veteran status and business revenue thresholds.
The affidavit establishes important restrictions and reporting obligations for resident veteran businesses claiming the preference. Businesses may not benefit from the preference for more than ten consecutive years, and individuals cannot benefit based on more than one business concurrently. Upon contract award based on veteran preference status, vendors must submit annual reports to the State Purchasing Division of the General Services Department declaring the awarded contract amount and categorizing it as either a public body purchase or public works contract. False or misleading information provided on either the initial certification or subsequent reports constitutes a criminal offense. The representations made through certification are material and subject to protest, with potential consequences including denial or removal of the contract award if statements are determined to be incorrect.
