JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Six-Month No-Cost Extension for Indefinite Delivery, Indefinite Quantity (IDIQ) Contract 693JK418D500001 KIK Technologies
The Department of Transportation (DOT) makes this Justification for Other Than Full and Open Competition orders pursuant to Federal Acquisition Regulation (FAR) 6.302.
1. Identification of Agency and Contracting Activity:
Agency:
DOT, Office of the Secretary (OST) Office of the Chief Information Officer (OCIO) 1200 New Jersey Avenue, SE Washington, DC 20590
Contracting Activity:
Federal Highway Administration (FHWA)
IT ACE
1200 New Jersey Avenue, SE Washington, D.C. 20590
2. Nature and/or Description of Action Being Approved:
The OCIO requests to extend the Period of Performance (PoP) of KIK Technologies IDIQ 693JK418D500001 by six months, from April 14, 2021 to October 14, 2021 for Non-Core Telecommunications support. The extension will be at no cost to the Government. This action is necessary to provide continuity of services while the contract is re-competed. The OCIO is requesting this action while the Government completes the re-procurement of a new IDIQ which is expected to be awarded in the fourth quarter of FY21.
3. A Description of Supplies/Services Required to Meet Agency’s Need:
Services are provided on a task order basis and include the management and maintenance of the Non-Core telecommunication environment to include its assets, infrastructure environments, and operation and maintenance (O&M) support services and related supplies.
Non-Core O&M includes any and all services and supplies required to provide O&M support for DOT telecommunication’s cabling and connectivity infrastructure; telecommunications closets management and connectivity, telecommunication’s assets inventory; the moves, adds and changes (MAC) of customer provided equipment (CPE); telecommunications environment management and other support services and related supply requirements used throughout the entire DOT headquarters building and FAA locations in the Washington DC
IT ACE is a Client Support Center housed within DOT/FHWA Page 2 area.
The contractor also provides support for any non-core telecommunications needs for the Stennis, MS Disaster Recovery/COOP, and other DOT field sites environment to include cabling and connectivity of servers.
The period of performance will be extended by six (6) months, from April 14, 2021 to October 14, 2021.
4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
This justification is made is pursuant to FAR 6.302-1:
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. A Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited:
DOT requires support for the Non-Core telecommunication environment and its assets, infrastructure environment, and O&M support services and related supplies. The DOT has considerable investment in the Non-Core telecommunication environment within its headquarters building at 1200 New Jersey Avenue SE, adjacent east tower and other metropolitan area locations. DOT has also non-core infrastructure components at the Disaster Recovery location in Stennis, MS which includes wiring, cabling and other related activities to ensure DOT has redundancy in our infrastructure environment to mitigate the catastrophic failure of our production environment (including mail, servers, applications, storage, etc.) in the event of a disaster at the DOT headquarters.
KIK Technologies has several unique capabilities including 1) ability to quickly provide support for non-core telecommunications support, enhancements and/or maintenance as necessary to maintain critical and ongoing operations without delay, and 2) significant familiarity with the complete list/parts used throughout DOT’s non-core telecommunications infrastructure and can react almost immediately to critical needs.
Also, due to the consistent on-demand nature of these services and the considerable lead time required for staffing security clearances, certification, training, badging and knowledge transfer, KIK Technologies is the only vendor currently capable of providing the services required for the ongoing work within the time constraints and at the level of quality required.
KIK Technologies is already on-board at DOT and has all the necessary clearances, certifications, and badging to ensure continuous service. The lead time to bring a new vendor on at this time will cause a significant schedule delays, gaps in service and non-compliance with Service Level Agreement (SLA) turn-around times as the new vendor works to get staffing cleared through security, trained and OEM certified.

6. A Description of Efforts Made to Ensure that Offers are Solicited From as Many Potential Sources as Practicable:
The follow-on acquisition will be competed open market as this IDIQ was completed previously. The solicitation will be advertised on the appropriate Government Point of Entry, Beta.Sam.Gov.
7. A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
This action will not affect the IDIQ pricing, as KIK Technologies has agreed to adhere to their current rates. All work conducted under this action will be in accordance with the fixed rates under the contract, which were set under competitive circumstances. Furthermore, each task order awarded under the IDIQ is subject to a price reasonableness determination by the Contracting Officer prior to award.
8. A Description of the Market Research Conducted and the Results or a Statement of the Reason Market Research was not Conducted:
During the Acquisition Planning for the Non-Core re-compete, the Integrated Procurement Team (IPT) conducted Market Research by releasing two (2) Request for Information (RFI) via GSA’s Connections II and open market via Beta.Sam.Gov. As a result of the Market Research conducted, it was determined that the Non-Core re-compete will be a small business set-aside to be released on the open market.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition:
Not applicable.
10. A Listing of the Sources, if any, That Expressed, In Writing, An Interest in the Acquisition:
Not applicable.
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required:
No actions are necessary to remove barriers to competition. This contract is in the process of being re-competed to provide for adequate competition.
12. Contracting Officer Certification that the Justification is Accurate and Complete to the
Best of the Contracting Officer’s Knowledge and Belief:
Through my signature on the following page, I certify that this justification is accurate and complete to the best of my knowledge and belief, and I determine on the basis of the findings above that this other than full and open competition approach is in accordance with the requirements and is in the best interest of the Government.
