Office of Civil Rights

Statement of Work or Performance Work Statement

For

DBE Research Project

1.0 Overview

This is a service contract to provide a research paper and literature review on the secondary effects participation by small businesses in the highway transportation market have on national and local economies, job growth, community safety, and family stability. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such service providers must be accountable solely to the Contractor who, in turn is responsible to the Government as defined in this Statement of Work (SOW). The Contractor must perform to the standards herein.

1.1 Background

Congress established the Disadvantaged Business Enterprise (DBE) Program in 1982 to ensure nondiscrimination in the award and administration of United States Department of Transportation (USDOT)-assisted contracts, help remove barriers to allow DBEs the ability to compete fairly for USDOT-assisted contracts, and assist in the development of firms that can compete successfully in the marketplace outside of the DBE program. Implementation of the DBE program is a requirement for recipients and subrecipients of the Federal Highway Administration (FHWA), Federal Transit Administration, and Federal Aviation Administration funds.

DBEs are for-profit, small businesses that are owned and controlled by minorities, women or other socially and disadvantaged persons. FHWA recipients, State Departments of Transportation (State DOTs), in partnership with other state agencies, review applications from firms to determine if they qualify for the DBE program.

Each State DOT, sets an overall DBE participation goal, reflected as a percentage of its total FHWA apportionment dollars. To reach the goal, State DOTs, in part, include DBE subcontracting goals in their Federally-assisted contracts for prime Contractor offerors to use good faith efforts to meet. Overall goals can also be met when DBEs are the successful offerors on a prime contract.

In 2019, FHWA State DOT recipients awarded contracts to 29,543 DBEs totaling $5,063,710,100. This amount represents over 10% of the FHWA apportionment dollars, and the numbers are similar from year to year.

1.2 Objective

The DBE program positively affects DBE firms by providing them with contracting opportunities that they would not have in the absence of the program.1 What we don’t know is how participation by these, by definition, small firms, contributes to local and national economic growth, including the creation of employment opportunities. We can make assumptions that DBEs, as small businesses, positively contribute to local and national economies, and as they

1 In 2006, in the aftermath of a 9th Circuit Court of Appeals decision Western States Paving Co. v. Washington State DOT, 407 F.3d 983 (9th Cir. 2005), cert. denied, 546 U.S. 1170 (2006), U.S. DOT directed State DOTs under the jurisdiction of the 9th Circuit Court of Appeals to suspend the use of DBE subcontracting goals. This resulted in a dramatic reduction in DBE participation.

grow, they contribute to job creation, but we have no data to support these assumptions. Such data would assist FHWA’s Office of Civil Rights with marketing the positive effects of the DBE program to our recipients and other stakeholders. Thus, the Contractor must perform the following tasks:

1. Conduct a complete literature search of existing research on the secondary effects small businesses have on local and national economies, job growth, community safety, and family stability, synthesizing and summarizing results.

2. Conduct new research to determine what secondary effects participation by small businesses in the highway transportation market has on national and local economies, job growth, community safety, and family stability.

3. Conduct a complete literature search and new research to determine what secondary effects participation by small firms owned by racial and ethnic minorities has on communities with a large representation of these groups, with respect to job growth, community safety, and family stability.

4. Conduct a complete literature search and conduct new research to determine what secondary effects participation by small businesses owned by racial and ethnic minorities in the highway transportation market has on those communities with a large representation of these groups, with respect to job growth, community safety, and family stability.
