STATEMENT-OF-WORK

INSTALLATION OF NEW WINDOWS AT ZERO DECK

LOCATED AT THE

U.S. MERCHANT MARINE ACADEMY

SECTION 1 - INTRODUCTION

1.1 This statement of work describes the services

of the contractor for the installation of new replacement windows at the zero deck of the dormitories.

1.2 The Academy is in operation 365 days a year, 24 hours a day, and must continue to be in operation during all phases of the design and construction.

1.3 The contractor is responsible to field verify

all measurements and locations.

1.4 All new work must be coordinated and approved

if required by authorities having jurisdiction.

1.5 Construction shall be in accordance with all

current local, state and federal regulations, building codes as applicable and authorities having jurisdiction. The New York State Building

Code will primarily govern and all OSHA regulations will apply.

1.6 All work shall be done in accordance with

Specifications provided in Appendix A.

SECTION 2 - PURPOSE

2.1 The primary purpose of this statement of work

is to install new replacement windows at the zero deck (basement) of the dormitories.

2.2 All work shall be in accordance with all

current local, state and federal regulations, building codes as applicable and authorities having jurisdiction.

2.3 A proposal and schedule shall be submitted to

the Academy for approval before any work shall commence.

SECTION 3 - SCOPE

3.1 The project shall consider the following but

not be necessarily limited to:

3.1.1 Investigate and review the window locations

at the zero deck.

3.1.2 The contractor shall demolish and dispose

of the existing windows, plywood, frames, molding, and associated material at 94 locations throughout zero deck of the dormitories. The zero deck of the dormitories in this project includes Barry, Jones, Rogers, Cleveland and

Delano halls. The basements of all the buildings are connected.

3.1.3 The contractor shall replace any existing

blocking that is deteriorated and not usable for new window installation. Wood is deteriorated at a majority of the locations. Molding will be replaced with approved submissions.

3.1.4 The contractor shall furnish and install 88

YKK YES 45FI Storefront Framing System at

Exterior Windows or approved equal. These are the non-opening style window. See attached cut sheet for specifications of window.

3.1.5 The contractor shall furnish and install 6

YKK SSG Vent Windows in YES 45FI Storefront

Framing System at Exterior Windows or approved equal. Locations of the operable windows will be given by the Contracting Officer Representative

(COR). See attached cut sheet for specifications of window.

3.1.6 All windows shall be in Dark Bronze

Anodized Finish.

3.1.7 The contractor shall install waterproofing

at all exterior perimeter window locations ensuring a waterproof connection between window

3.1.8 The contractor shall install all windows to

manufacturer specifications.

3.1.9 The contractor shall ensure all windows are

caulked on both exterior and interior for moisture, air, insect, and aesthetic purposes.

3.1.10 The contractor shall patch, repair and

paint any areas damaged during construction.

3.1.11 The contractor shall provide a shop

drawing submittal prior to any work being completed for approval by the COR. All material to be used will be submitted to the COR for approval.

3.1.12 The contractor will furnish all labor, materials, tools, transportation, supervision, testing, and equipment required to install all new windows at zero deck.

3.1.13 The contractor shall be responsible for

presenting his best efforts for phasing of the project in order to obtain maximum efficiency, cohesive design, and minimum adverse impact on the Academy.

3.1.14 At the conclusion of the project the

Contractor shall furnish three (3) sets of any operating, maintenance, parts, and warranty manuals.

SECTION 4 - CONSULTATIONS, REPORTS, DRAWINGS,

DATA, ETC.

4.1 During the life of the project the contractor

shall periodically formally consult with the

Academy. The consultations/meetings may be requested by the contractor or established by the

Contracting Officer (CO) or COR.

4.1.1 The Academy shall establish an official

committee with one individual designated as

Chairman to provide authoritative decisions. The committee members may be rotated from time to

SECTION 5 - DELIVERY SCHEDULE

5.1 The contractor shall prepare and submit a

milestone Schedule for the Academy review within one (1) week after receipt of authorized

Notice-to-Proceed.

5.2 The contractor shall complete the window

installations no later than forty five (45) days after the notice to proceed.

SECTION 6 - CONTRACT PRICE AND PAYMENT SCHEDULE

6.1 The Government shall pay the contractor on a

percentage complete basis the total sum to be negotiated which shall constitute full compensation for all services, materials, expenses, indirect costs, and profit for the program detailed herein except as herein after identified.

6.2 Invoices from the contractor shall be

submitted to the following:

6.3 The processing of the invoice for payment

shall only commence after the COR or his designee has certified, in writing, that the invoice is correct and proper for payment.

SECTION 7 - ADDITIONAL SITE VISITS

7.1 Only when authorized by the CO shall

additional site visits be subject to reimbursement at a rate to be negotiated per day, including all expenses based on an approximated 8 hour day or equivalent segments adding up to a full day (i.e. - ½ day units).

SECTION 8 - ADDITIONAL SERVICES

8.1 If the Government requires additional

services beyond this Statement of Work, the compensation shall be negotiated and, in any event, shall not exceed the following:

8.1.1 Time for employee will be based on direct

labor costs multiplied by an overhead rate to be negotiated, and profit on direct labor costs and overhead.

8.1.2 Time for principals will be based on a

maximum total cost of an hourly rate to be negotiated.

SECTION 9 - NORMAL WORKING HOURS

9.1 Normal working hours are 0800 to 1700 hours

Monday through Friday excluding Federal holidays.

All work shall be performed during these hours, unless otherwise approved by the CO. The contractor may be required to reimburse the

Government for the cost of inspecting work performed outside of normal working hours. No work shall be performed during graduation and homecoming.

SECTION 10 - CLEAN UP

10.1 The contractor shall clean up all debris and

discard materials resulting from his operations at the end of each workday. Materials shall be

6923G217B00001 disposed of off campus in accordance with local, state and federal laws and regulations. In case of conflict among these laws and regulations, the most stringent law or regulation will apply.

Open burning of scrap or unsalvageable materials are forbidden.

SECTION 11 - PROJECT ACCESS

11.1 The contractor shall be responsible to

maintain access to the job site at all times under all normal seasonal weather conditions, at no additional cost to the government.

SECTION 12 - UTILITIES

12.1 Existing utilities will be available to the

Contractor for his use. Any extension of or connections to the above utilities and their restoration to original condition and removal of extension and connections will be at the expense of the Contractor. The above utilities will be provided at no cost, as needed to perform this contract. All connections to existing utilities shall be coordinated with the COR.

12.2 Contractor shall obtain digging permits

prior to start of excavation by contacting the CO

15 calendar days in advance. Contractor shall scan the construction site with electronic equipment and mark the surface of the ground where existing underground utilities are discovered. Contractor shall notify the CO at least 48 hours prior to starting excavating work.

SECTION 13 - OSHA

13.1 All work and materials called for in the

specifications and drawings will conform to the applicable OSHA standards.

SECTION 14 - CONTRACTOR'S REPRESENTATIVE

SECTION 15 - SUBMITTALS

15.1 Submittals shall be provided as required by

the specification and contract. Failure to furnish submittals could result in a work stoppage and in addition, materials furnished and/or installed may not meet the specifications and may be rejected by the CO or COR.

15.2 Manufacturer¿s catalog cuts of all materials

and supplies used shall be submitted for approval.

SECTION 16 - FIRE PREVENTION

16.1 The contractor shall comply with the most

current editions of the National Fire Codes, Installation fire prevention standards, USMMA

Safety regulations and all OSHA Standards. All open flame/hot work or disconnection of fire protection alarms or suppression systems require prior approval of the COR, CIP department (516)

726-5907. Dormitories above the work area will remain occupied during all phases of this project.

The Contractor shall be required to (a) commence work under this contract within five (5) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 1 DAYS after commencement. The time stated for completion shall include final cleanup of the premises.

The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifteen (15) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the

Government.

52.222-8 Payrolls and Basic Records. (May 2014)

a) Payrolls and basic records relating thereto shall be maintained by the Contractor during the course of the work and preserved for a period of

3 years thereafter for all laborers and mechanics working at the site of the work. Such records shall contain the name, address, and social security number of each such worker, his or her correct classification, hourly rates of wages paid (including rates of contributions or costs anticipated for bona fide fringe benefits or cash equivalents thereof of the types described in 40

U.S.C. 3141(2)(B) (Construction Wage Rate

Requirement statute)), daily and weekly number of hours worked, deductions made, and actual wages paid. Whenever the Secretary of Labor has found, under paragraph (d) of the clause entitled

Construction Wage Rate Requirements, that the wages of any laborer or mechanic include the amount of any costs reasonably anticipated in providing benefits under a plan or program described in 40 U.S.C. 3141(2)(B), the Contractor shall maintain records which show that the commitment to provide such benefits is enforceable, that the plan or program is financially responsible, and that the plan or program has been communicated in writing to the laborers or mechanics affected, and records which show the costs anticipated or the actual cost incurred in providing such benefits. Contractors employing apprentices or trainees under approved programs shall maintain written evidence of the registration of apprenticeship programs and certification of trainee programs, the registration of the apprentices and trainees, and

(b)

(1) The Contractor shall submit weekly for each week in which any contract work is performed a copy of all payrolls to the Contracting Officer.

The payrolls submitted shall set out accurately and completely all of the information required to be maintained under paragraph (a) of this clause, except that full social security numbers and home addresses shall not be included on weekly transmittals. Instead the payrolls shall only need to include an individually identifying number for each employee (e.g., the last four digits of the employee¿s social security number).

The required weekly payroll information may be submitted in any form desired. Optional Form

WH-347 is available for this purpose and may be obtained from the U.S. Department of Labor Wage and Hour Division website at http://www.dol.gov/whd/forms/wh347.pdf . The

Prime Contractor is responsible for the submission of copies of payrolls by all subcontractors. Contractors and subcontractors shall maintain the full social security number and current address of each covered worker, and shall provide them upon request to the

Contracting Officer, the Contractor, or the Wage and Hour Division of the Department of Labor for purposes of an investigation or audit of compliance with prevailing wage requirements. It is not a violation of this section for a Prime

Contractor to require a subcontractor to provide addresses and social security numbers to the

Prime Contractor for its own records, without weekly submission to the Contracting Officer.

(2) Each payroll submitted shall be accompanied by a "Statement of Compliance," signed by the

Contractor or subcontractor or his or her agent who pays or supervises the payment of the persons employed under the contract and shall certify --

(i) That the payroll for the payroll period contains the information required to be maintained under paragraph (a) of this clause and that such information is correct and complete;

(ii) That each laborer or mechanic (including each helper, apprentice, and trainee) employed on

6923G217B00001 the contract during the payroll period has been paid the full weekly wages earned, without rebate, either directly or indirectly, and that no deductions have been made either directly or indirectly from the full wages earned, other than permissible deductions as set forth in the

Regulations, 29 CFR Part 3; and

(iii) That each laborer or mechanic has been paid not less than the applicable wage rates and fringe benefits or cash equivalents for the classification of work performed, as specified in the applicable wage determination incorporated into the contract.

(3) The weekly submission of a properly executed certification set forth on the reverse side of

Optional Form WH-347 shall satisfy the requirement for submission of the "Statement of

Compliance" required by subparagraph (b)(2) of this clause.

(4) The falsification of any of the certifications in this clause may subject the

Contractor or subcontractor to civil or criminal prosecution under Section 1001 of Title 18 and

Section 3729 of Title 31 of the United States

Code.

(c) The Contractor or subcontractor shall make the records required under paragraph (a) of this clause available for inspection, copying, or transcription by the Contracting Officer or authorized representatives of the Contracting

Officer or the Department of Labor. The

Contractor or subcontractor shall permit the

Contracting Officer or representatives of the

Contracting Officer or the Department of Labor to interview employees during working hours on the job. If the Contractor or subcontractor fails to submit required records or to make them available, the Contracting Officer may, after written notice to the Contractor, take such action as may be necessary to cause the suspension of any further payment. Furthermore, failure to submit the required records upon request or to make such records available may be grounds for debarment action pursuant to 29 CFR

5.12.

52.228-5, Insurance -- Work on a Government

Installation (Jan 1997)

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the

Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting

Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the

Government¿s interest shall not be effective --

(1) For such period as the laws of the State in which this contract is to be performed prescribe;

or

(2) Until 30 days after the insurer or the

Contractor gives written notice to the

Contracting Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors¿ proofs of required insurance, and shall make copies available to the Contracting Officer upon request.
