About this file
This document is a Federal Highway Administration (FHWA) compliance report on construction contract administration procedures regarding the definitization of equitable adjustments for change orders.
FHWA reports that it currently has no agency-specific additional policies and procedures beyond Federal Acquisition Regulation (FAR) requirements for definitizing equitable adjustments on construction contracts. The document provides historical performance data for fiscal years 2021 through 2023 on the time required to definitize change order proposals after receipt of adequate definitization proposals. The data shows a three-year trend where definitization timeframes varied considerably: in FY 2021, nine total change orders were processed with two taking 366 or more days and five taking 91-180 days; in FY 2022, only two total change orders were processed with one each in the 0-30 day and 91-180 day categories; and in FY 2023, thirteen total change orders were processed with significant delays, including three in the 181-365 day range and four in the 91-180 day range. Notably, no change orders were definitized within 0-30 days in FY 2023, and no undefinitized equitable adjustments remained pending after contract completion in any of the three fiscal years.
