ADDENDUM NO. 2: JUNE 19, 2014
RESPONSES TO CONTRACTOR QUESTIONS
MASS BAY ELECTRICAL CORP. EMAIL DATED JUNE 16, 2014 @ 10:20 AM
Question #1) Plans show a quantity of 4 of Bid Item 821.26 HIGHWAY LIGHTING POLE
(ANCHR BASE) TWIN FOOT BRACKET (TYPE B). The quantity on the bid form is 8. Please correct.
Response #1) Please see this Addendum. Quantity changed to 4
Question #2) Special Provisions page A00801-137 lists Spare Parts as “A Complete Type A. B, C and D pole/luminaire assembly”.. How is the contractor paid for these spare parts? Is it by one each of bid item 821.16, 821.26, 821.27 and 821.28?
Response #2) The spare parts for each type of light are incidental to the bid item for that particular light.
Question #3) On Utility Plan 31 there are 4 instances of street lighting conduit and wire being extended to connect to existing street lights on both sides of Hancock St. and both sides of Glover Ave. Please provided distances to these 4 light poles. It is particularly important because there are no linear foot wire pay items on the bid form.
Response #3) The distance from the limit of work on Hancock to the existing light on the west side of Hancock is 40 feet. The distance from the limit of work on Hancock to the existing light on the east side of Hancock is 90 feet. There are 3 existing lights on each side of Glover with the following distances: On the south side, there are existing lights 15 feet, 95 feet and 175 feet from the limit of work on Glover. On the north side, there are existing lights 55 feet, 130 feet and 240 feet from the limit of work on Glover
Question #4) There are at least 11 locations where a new National Grid electrical service is required. These include 2 for street lighting, 4 for traffic signal, and 5 for relocated utility poles. Since National Grid will not provide a cost for these 11 services prior to the bid date, could an allowance item please be added to the bid form so that the contractor doesn’t have to guess at the charges?

Response #5) Private utility manholes and vaults shall be installed in accordance with all requirements of the respective utility company
Question #6) On the utility plans there are at least two locations calling for fiberglass or concrete pads for future transformers (by others). Are the pads and transformers by others, or just the transformers? If pads are required by the contractor, please provide details including grounding details
Response #6) Transformers and pads are all by others
PINE RIDGE TECHNOLOGIES, INC. EMAIL DATED JUNE 17, 2014 @ 12:54 AM
Question #1) It appears the street lighting conduit is shown on the utility plans. However, the conductor sizes/locations are not shown; they are only shown on the lighting detail plans. For sake of clarity, can the utility plans be updated to show the location and quantity of conductor for each circuit?
Response #1) The utility plans will not be revised. The utility plans together with the lighting details and specs show all information required for installation of complete lighting system
Question #2) There are no pay items for the wiring of the lighting, but instead appear incidental to item 823.63. Will pay items be added to pay for the wiring?
Response #2) Separate pay items will not be added. The wiring is paid for under Item 823.63 as noted in the last 2 paragraphs of the Special Provision for Item 823.63.

VIII. Sanctions
Whenever the administering agency believes the General or Prime Contractor or any subcontractor may not be operating in compliance with the provisions of the Fair Employment Practices Law of the Commonwealth (Massachusetts General Laws Chapter 151B), the administering agency may refer the matter to the Massachusetts Commission Against Discrimination ("Commission") for investigation.
Following the referral of a matter by the administering agency to the Massachusetts Commission Against Discrimination, and while the matter is pending before the MCAD, the administering agency may withhold payments from contractors and subcontractors when it has documentation that the contractor or subcontractor has violated the Fair Employment Practices Law with respect to its activities on the Project, or if the administering agency determines that the contractor has materially failed to comply with its obligations and the requirements of this Section. The amount withheld shall not exceed a withhold of payment to the General or Prime Contractor of 1/100 or 1% of the contract award price or $5,000, whichever sum is greater, or, if a subcontractor is in non-compliance, a withhold by the administering agency from the General Contractor, to be assessed by the General Contractor as a charge against the subcontractor, of 1/100 or 1% of the subcontractor price, or $1,000 whichever sum is greater, for each violation of the applicable law or contract requirements. The total withheld from anyone General or Prime Contractor or subcontractor on a Project shall not exceed $20,000 overall. No withhold of payments or investigation by the Commission or its agent shall be initiated without the administering agency providing prior notice to the Contractor.
If, after investigation, the Massachusetts Commission Against Discrimination finds that a General or Prime Contractor or subcontractor, in commission of a state construction contract or state-assisted construction contract, violated the provisions of the Fair Employment Practices Law, the administering agency may convert the amount withheld as set forth above into a permanent sanction, as a permanent deduct from payments to the General or Prime Contractor or subcontractor, which sanction will be in addition to any such sanctions, fines or penalties imposed by the Massachusetts Commission Against Discrimination.
No sanction enumerated under this Section shall be imposed by the administering agency except after notice to the General or Prime Contractor or subcontractor and an adjudicatory proceeding, as that term is used, under Massachusetts General Laws Chapter 30A, has been conducted.
IX. Severability
The provisions of this section are severable, and if any of these provisions shall be held unconstitutional by any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining provisions.
ADDENDUM NO.2: JUNE 19, 2014

PART 2
U.S. DEPARTMENT OF LABOR - DECISION WLSA-1
U.S. DEPARTMENT OF LABOR
OFFICE OF THE SECRETARY
WASHINGTON
DECISION OF THE SECRETARY
This case is before the Department of Labor pursuant to a request for a wage predetermination as required by law applicable to the work described.
A study has been made of wage conditions in the locality and based on information available to the Department of Labor the wage rates and fringe payments listed are hereby determined by the Secretary of Labor as prevailing for the described classes of labor in accordance with applicable law.
This wage determination and any modifications thereof during the period prior to the stated expiration date shall be made a part of every contract for performance of the described work as provided by applicable law and regulations of the Secretary of Labor, and the wage rates and fringe payments contained in this decision, including modifications, shall be the minimums paid under any such contract by contractors and subcontractors on the work.
The contracting officer shall require that any class of laborers and mechanics which is not listed in the wage determination and which is to be employed under the contract, shall be classified or reclassified conformably to the wage determination, and a report of the action taken shall be sent by the Federal agency to the Secretary of Labor.
In the event the interested parties cannot agree on the proper classification or reclassification of a particular class of laborers and mechanics to be used, the question accompanied by the recommendation of the contraction officer shall be referred to the Secretary for determination.
Before using apprentices on the job the contractor shall present to the contracting officer written evidence of registration of such employees in a program of a State apprenticeship and training agency approved and recognized by the U.S. Bureau of Apprenticeship and Training. In the absence of such a State agency, the contractor shall submit evidence of approval and registration by the U.S. Bureau of Apprenticeship and Training.
The contractor shall submit to the contracting officer written evidence of the established apprentice-journeyman ratios and wage rates in the project area, which will be the basis for establishing such ratios and rates for the project under the applicable contract provisions.
Fringe payments include medical and hospital care, compensation for injuries or illness resulting from occupational activity, unemployment benefits, life insurance, disability and sickness insurance, accident insurance (all designated as health and welfare), pensions, vacation and holiday pay, apprenticeship or other similar programs and other bona fide fringe benefits.
By direction of the Secretary of Labor, Alfred L. Ganna, Director Division of Wage Determinations Workplace Standards Administration

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.
Union Identifiers
An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the
00880 - 12 four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination.
The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.
Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rates.
0000/9999: weighted union wage rates will be published annually each January.
Non-Union Identifiers
Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union majority rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.
Survey wage rates will remain in effect and will not change until a new survey is conducted.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
